Section 62

Section 62

For the purposes of paragraph 60(1)(b), a failure to comply with a guarantee shall be of a substantial character where—

(a)

the product resulting from the services—

(i)

is substantially unfit for a purpose for which services of the type in question are commonly supplied; or

(ii)

where subsection 54(1) applies—

(A)

is unfit for a particular purpose made known to the supplier; or

(B)

of such a nature and quality that the product cannot be expected to achieve a particular result made known to the supplier, and the product cannot easily and within a reasonable time be remedied to make it fit for the particular purpose or to achieve the particular result; or

(b)

the product resulting from the services is unsafe.

Rules applying to cancellation of contract
