Registration of new plant variety and grant of breeder’s right
(1)
If the Board is satisfied that the applicant has complied with requirements of section 27, the Board shall register the new plant variety and grant the breeder’s right to the applicant and shall—
(a)
issue a certificate of registration of the new plant variety and grant of a breeder’s right to the applicant in the prescribed form;
(b)
record the denomination of the new plant variety and the registration of the new plant variety and grant of a breeder’s right in the Register of New Plant Varieties;
and
(c)
publish in the Gazette a reference to the registration of the new plant variety and grant of a breeder’s right.
(2)
The contents of the certificate of a breeder’s right shall be prima facie evidence of the facts stated therein and the duration of the protection granted.
