Section 60

Regulations

(1)

The Minister may make regulations for the purpose of carrying into effect the provisions of this Act.

(2)

Without prejudice to the generality of subsection (1), regulations may be made—

(a)

to regulate the procedure for an application for the registration of a new plant variety and grant of a breeder’s right and the determination of questions in connection with such application, registration and grant, and in connection with the extension of the duration of such registration and grant, and the revocation, surrender, assignment or transmission of a breeder’s right;

(b)

prescribing the fees and charges payable under this Act and the manner for collecting and dealing with such fees and charges;

(c)

prescribing forms, book, registers, documents and other matters to be used under this Act and the information to be furnished for any of the purposes of this Act;

(d)

prescribing the size of a holding for the purposes of the definition of “small farmer”; and

(e)

providing generally for any other matter for the proper and effective implementation of this Act.
