(2)

Any person in charge of a building who fails to apply for the energy intensity label within the period as may be prescribed under subsection (1) shall pay a prescribed late fee.

(3)

An application for an energy intensity label under subsection (1)

shall be accompanied by payment of the prescribed fee and such information, particulars or document as may be determined by the Commission.

(4)

After considering the application, the Commission may—

(a)

approve the application and issue in respect of the building an energy intensity label in such form as may be determined by the Commission; or

(b)

refuse the application, stating the grounds for refusal.

(5)

The energy intensity label issued under this section shall be valid for a period as may be prescribed.
