The Chief Public Defender may issue a public defence certificate to the applicant after payment of the prescribed fee and after considering the application under section 53 and being satisfied that–
(a)
the applicant has reasonable grounds to obtain public defence services in the criminal proceedings;
(b)
the applicant meets the criteria and the means test as prescribed by the Minister; and
(c)
the offence charged against the applicant is within the scope of the public defence services.
