Section 31

Section 31

(1A)

The office of a chief executive shall be located at the main administrative centre of a private higher educational institution.

(1B)

It shall be the responsibility of a chief executive to inform the

Registrar General of the address of his office and any change of that address from time to time.

(2)

A person appointed as a chief executive shall apply to be registered under this Part.

(3)

The Registrar General may refuse to register or cancel the registration of a chief executive—

(a)

if there has been proved against him, or he has been convicted on, a charge in respect of—

(i)

an offence involving fraud, dishonesty or moral turpitude;

(ii)

an offence under a law relating to corruption; or

(iii)

any other offence punishable with imprisonment

(in itself only or in addition to or in lieu of a fine)

for more than two years;

(b)

if he is or he becomes a bankrupt;

(c)

if he is of unsound mind or is otherwise incapable of discharging his duties;

(d)

if he acts in a manner which is detrimental to the interest of Malaysia, the public or the students;

(e)

if his appointment under subsection (1) is revoked; or

(f)

on any other reason that the Registrar General deems proper in the interest of the public or the students.

(4)

No person shall carry out the duties or functions of a chief executive under this Act where—

(a)

he is not registered as a chief executive; or

(b)

his registration as a chief executive has been cancelled under subsection (3) or paragraph 37(1)(bb).

(5)

Any person who contravenes the provisions of subsection (4)

shall be guilty of an offence.
