Section 36
Section 39 of the principal Act is amended—
(a)
in subsection (1)—
(i)
by inserting after the word “removed” the word
“immediately”; and
(ii)
by substituting for the word “detained” the word
“placed”;
(b)
by inserting after subsection (1) the following subsection:
“(1a) If the person ordered under subsection (1)
fails to comply within twenty-four hours with the order made under that subsection, the Protector or police officer may remove the child and temporarily place the child in a place of refuge.”;
(c)
in subsection (2)—
(i)
by substituting for the word “detained” the word
“placed”; and
(ii)
by substituting for the words “subsection (1)” the words “subsections (1) and (1a)”;
(d)
in subsection (3), by substituting for the words “subsection (1)”
the words “subsection (2)”; and
(e)
by substituting for subsection (4) the following subsection:
“(4) If the Court For Children is satisfied that a child brought before it is in need of protection and rehabilitation, the Court For Children may order for the child to be placed in a place of refuge until an order is made by the Court under section 40.”.
