Amendment of section 75

(a)

in subsection (1)—

(i)

by substituting for paragraph (b) the following paragraph:

“(b) the probation report submitted to the

Court For Children shows that the child is not suitable to be rehabilitated in an approved school; and”; and

(ii)

by substituting for the words “on the recommendation of the probation officer” the words “after considering the probation report”;

(b)

in paragraph (2)(b)—

(i)

by deleting the word “and” at the end of subparagraph (i);

(ii)

in subparagraph (ii)—

(A)

by substituting for the words “Director

General of Prisons” the words

“Commissioner General of Prison”;

and

(B)

by substituting for the full stop at the end of the paragraph the words “; and”;

and

(iii)

by inserting after subparagraph (ii) the following subparagraph:

“(iii) in subsection 71(1), for the words “probation officer” there shall be substituted the words “prison officer”.”; and

(c)

in subsection (3), by substituting for the words “Director

General of Prisons” the words “Commissioner General of Prison”.
