Section 4
The principal Act is amended by inserting after section 4
the following section:
“Resolution without meeting 4a. (1) Subject to subsection (2), the Poisons Board may, where necessary, pass a resolution without meeting.
(2)
Where the Board wishes to pass a resolution without meeting, the Board shall comply with the following conditions:
(a)
all members of the Board have been informed of the proposed resolution, or reasonable efforts have been made to inform all members of the Board of the proposed resolution; and
(b)
all members of the Board indicate agreement with the resolution in accordance with the method determined by the Board under subsection (3).
(3)
Subsection (2) applies only if the Board decides—
(a)
that the subsection applies; and

the method by which members of the Board are to indicate agreement with the resolution.”.
