Jika Lembaga berpuas hati dengan notis pengeluaran yang dikemukakan oleh ahli Kumpulan Wang,

Lembaga boleh membenarkan ahli Kumpulan Wang itu untuk mengeluarkan suatu amaun yang tidak melebihi lima ribu ringgit pada tarikh notis pengeluaran itu dibenarkan tertakluk kepada—

(a)

amaun yang ada pada kredit dalam

Akaun II ahli Kumpulan Wang itu digunakan sepenuhnya; dan

Suggest a correction

(b)

amaun yang ada pada kredit dalam

Akaun I ahli Kumpulan Wang itu digunakan jika terdapat apa-apa kekurangan dalam amaun yang ada pada kredit yang disebut dalam perenggan

  1. IN exercise of the powers conferred by section 73 of the Employees Provident Fund Act 1991 [Act 452], the Board makes the following rules: Citation and commencement 1.

(1)

These rules may be cited as the Employees Provident Fund

(Amendment) (No. 4) Rules 2021.

These Rules come into operation on 15 July 2021.

Amendment of rule 41 2.

The Employees Provident Fund Rules 1991 [P.U. (A) 493/1991] are amended in rule 41 by inserting after subrule (10ZA) the following subrules:

(10ZB)

Where a notice of withdrawal is made under paragraph 54(6)(m) of the Act on the ground that a member of the Fund requires financing to increase his income for the purposes of continuance of life due to the implementation of the National Recovery Plan under the Prevention and Control of Infectious Diseases Act 1988 [Act 342] to control or prevent the spread of Coronavirus Disease 2019

(COVID-19), the member of the

Fund shall give a notice of withdrawal to the Board in accordance with any manner as determined by the Board.

(10ZC)

The notice of withdrawal referred to in subrule (10ZB) shall be submitted by the member of the

Fund to the

Board at any time between 15 July 2021 to 30 September 2021.

“Member of

Fund requires financing to increase his income for the purposes of continuance of life due to the implementation of the

Recovery Plan under the

Prevention and

Control of Infectious

Diseases

Act 1988

[Act 342] to control or prevent the spread of

Coronavirus

Disease 2019 (COVID-19).

(10ZD)

Where the Board is satisfied with the notice of withdrawal submitted by the member of the Fund, the Board may authorize the member of the Fund to withdraw an amount not exceeding five thousand ringgit on the date of the notice of withdrawal is authorized subject to—

(a)

the amount standing to the credit in

Account II of the member of the Fund is fully utilized; and

Suggest a correction

(b)

the amount standing to the credit in

Account I of the member of the Fund is utilized if there is any deficiency in the amount standing to the credit referred to in paragraph (a) for the purposes of the withdrawal.

(10ZE)

For the purposes of subrule (10ZD)—

(a)

the total number of withdrawal shall not exceed five times from the date of the notice of withdrawal is authorized;

and

Suggest a correction

(b)

the amount of withdrawal is not less than fifty ringgit and not exceeding one thousand ringgit for each withdrawal.

(10ZF)

The member of the Fund shall, at all times within the period of total number of withdrawal referred to in paragraph (10ZE)(a), have amount standing to his credit in Account I at least one hundred ringgit.

(10ZG) (a)

The member of the Fund may request to the Board to revoke the notice of withdrawal at any time.

If the former notice of withdrawal has been revoked, the member of the Fund is not allowed to submit a new notice of withdrawal under subrule (10ZB).

(10ZH)

Notwithstanding subrules (10ZC) and (10ZD), the Board has a discretion to determine any other period and any other amount for the member of the Fund to increase his income for the purposes of continuance of life due to the implementation of the National Recovery Plan under the

Prevention and Control of Infectious Diseases Act 1988

[Act 342] to control or prevent the spread of Coronavirus

Disease 2019 (COVID-19).”.
