KAEDAH-KAEDAH PENGANGKUTAN JALAN (KESALAHAN YANG DIRAKAMKAN MELALUI KAMERA) 2012

Dalam Kaedah-Kaedah ini, melainkan jika konteksnya menghendaki makna yang lain, “depoh” ertinya suatu tempat untuk memproses imej yang dirakamkan melalui kamera mudah alih.

Walau apa pun peruntukan Kaedah-Kaedah ini, pengecualian diberikan bagi maksud dan keadaan yang dinyatakan dalam Jadual Kelima.

JADUAL PERTAMA

[Perenggan 3(1)(a)]

SPESIFIKASI BAGI KAMERA STATIK DAN KAMERA MUDAH ALIH

Kamera statik dan kamera mudah alih yang digunakan bagi maksud kesalahan yang dirakamkan melalui kamera hendaklah memenuhi spesifikasi yang berikut:

(a)

kamera statik dan kamera mudah alih hendaklah berupaya merakamkan imej tampak sama ada pegun atau bergerak;

(b)

unit pemprosesan utama kamera statik dan kamera mudah alih hendaklah berupaya mengukur data kelajuan kenderaan motor dari arah yang sama atau arah yang bertentangan;

(c)

lensa kamera statik dan kamera mudah alih hendaklah berupaya memfokus untuk menghasilkan imej yang berkualiti dan boleh dilaras secara manual atau automatik;

(d)

kamera statik dan kamera mudah alih disambungkan dengan punca kuasa yang berupaya untuk membekalkan kuasa kepada kamera; dan

(e)

kamera statik dan kamera mudah alih hendaklah mempunyai kilauan tambahan bagi maksud kualiti imej yang dirakamkan.

JADUAL KEDUA

[Subkaedah 5(2)]

UJIAN DAN PENENTUKURAN BAGI KAMERA STATIK DAN KAMERA MUDAH ALIH

Kamera statik dan kamera mudah alih hendaklah diuji dan ditentukur mengikut prosedur yang berikut:

(a)

ujian dan penentukuran hendaklah dijalankan—

(i)

berhubung dengan kamera statik, di lokasi pemasangan kamera; atau

(ii)

berhubung dengan kamera mudah alih, di mana-mana depoh atau mana-mana tempat yang diluluskan oleh Ketua Pengarah;

(b)

tiap-tiap kamera statik dan kamera mudah alih hendaklah diuji dan ditentukur bagi maksud ketepatannya;

(c)

cara bagi ujian dan penentukuran hendaklah mengikut piawai antarabangsa menurut prosedur yang ditentukan oleh Makmal Standard Pengukuran

Kebangsaan yang ditubuhkan di bawah seksyen 9 Akta Sistem Pengukuran

Kebangsaan 2007 [Akta 675] yang berhubungan dengan ketepatan speedometer, alat pengukur yang tepat atau kelajuan setara kenderaan motor;

(d)

ujian dan penentukuran disifatkan sebagai tepat jika nilai yang diukur adalah dalam selisih yang dibenarkan 3 km/j bagi kelajuan kurang daripada 100 km/j

dan dalam selisih yang dibenarkan tiga peratus bagi kelajuan lebih daripada 100 km/j;

(e)

saiz sampel atau ujian keberterusan bagi maksud ketepatan hendaklah dijalankan—

(i)

berhubung dengan kamera statik, lebih daripada lima kali; atau

(ii)

berhubung dengan kamera mudah alih, lebih daripada sepuluh kali;

(f)

seseorang pekhidmat awam yang jurutera elektrik atau jurutera mekanik hendaklah memperakui keputusan ujian dan penentukuran itu dalam suatu perakuan yang dinyatakan dalam Jadual Ketiga; dan

(g)

perakuan yang disebut dalam perenggan (f) hendaklah sah bagi tempoh masa lapan bulan dari tarikh perakuan itu dikeluarkan melainkan jika kamera statik atau kamera mudah alih itu dibaik pulih atau mana-mana komponennya diganti selama tempoh itu.

IN exercise of the powers conferred by section 53A of the Road Transport Act 1987 [Act 333], the Minister makes the following rules:

Citation and commencement 1.

(1)

These rules may be cited as the Road Transport (Camera-Recorded

Offences) Rules 2012.

(2)

These Rules come into operation on 23 September 2012.

Interpretation

2.

In these Rules, unless the context otherwise requires, “depot” means a place to process recorded image captured via mobile camera.

Camera 3.

(1)

A camera used for the purpose of camera-recorded offences shall—

(a)

consist of a static camera or mobile camera that conform to the specifications as specified in the First Schedule;

(b)

be tested and calibrated in accordance with rule 5; and

(i)

a static camera, be installed; or

(ii)

a mobile camera, be operated, as the case may be, at the locations as the Minister may determine.

Detector system 4.

(1)

The detector system used for the purpose of camera-recorded offences shall—

(a)

in relation to a static camera, consist of any or all of the following equipment:

(i)

inductive loop;

(ii)

piezo lines;

(iii)

radar;

(iv)

camera flash; or

(b)

in relation to a mobile camera, consist of any or all of the following equipment:

(i)

radar;

(ii)

laser;

(iii)

camera flash.

(2)

For the purpose of a static camera, the inductive loop or piezo lines shall be installed on the road surface to detect the speed of motor vehicles or the failure to obey red signal at the traffic sign, as the case may be.

(3)

For the purpose of a mobile camera, a police officer or road transport officer shall activate radar or laser to detect the speed of motor vehicles.

Test and calibration

The static camera or mobile camera used for the purpose of camera-recorded offences shall be tested and calibrated to verify the accuracy of such camera.

(2)

A public servant who is an electrical engineer or a mechanical engineer shall certify that the static camera or mobile camera has been tested and calibrated for the purpose of its accuracy in accordance with the procedures as specified in the Second Schedule.

(3)

For the purpose of subrule (2), the certification shall be made in a certificate as specified in the Third Schedule.

Camera operation zone sign 6.

A camera operation zone sign as prescribed in the Traffic Signs

(Size, Colour and Type) Rules 1959 [L.N. 167/1959] shall be erected—

(a)

for the purpose of detecting the speed of motor vehicles, between two to three kilometres from the location of—

(i)

the detector system for a static camera; or

(ii)

mobile camera operation, as the case may be; or

(b)

for the purpose of failure to obey red signal at the traffic sign, between fifty to five hundred metres from the location of the detector system for a static camera.

Notice of camera-recorded offences 7.

(1)

If a registered owner of a motor vehicle commits a camera-recorded offence, a police officer or road transport officer may, in lieu of applying to the court for a summons, serve a notice as specified in the Fourth Schedule in accordance with the form of service referred to in section 118 of the Act.

(2)

If the registered owner of a motor vehicle who is served with the notice referred to in subrule (1) was not a driver of the motor vehicle at the time the offence

was committed, he shall produce the name and address of the driver of the motor vehicle to the authority issuing the notice within thirty days from the date of service of the notice in accordance with section 53B of the Act.

Exemption 8.

Notwithstanding the provisions of these Rules, exemption is given for the purpose and the events as specified in the Fifth Schedule.

FIRST SCHEDULE

[Paragraph 3(1)(a)]

SPECIFICATIONS FOR THE STATIC CAMERA AND MOBILE CAMERA

The static camera and mobile camera used for the purpose of camera-recorded offences shall fulfill the following specifications:

(a)

the static camera and mobile camera shall be capable to capture visual image whether still or moving;

(b)

the main processing unit of static camera and mobile camera shall be able to measure the speed data of motor vehicles from the same directions or opposite directions;

(c)

the lens of static camera and mobile camera shall be able to focus to produce quality images and shall be adjustable manually or automatically;

(d)

the static camera and mobile camera are connected to the power source which is able to supply power to such cameras; and

(e)

the static camera and mobile camera shall have additional flash for the purpose of quality recorded image.

SECOND SCHEDULE

[Subrule 5(2)]

TEST AND CALIBRATION FOR THE STATIC CAMERA AND MOBILE CAMERA

The static camera and mobile camera shall be tested and calibrated in accordance with the following procedures:

(a)

the test and calibration shall be conducted—

(i)

in relation to a static camera, at the location of camera installation; or

(b)

each static camera and mobile camera shall be tested and calibrated for the purpose of its accuracy;

(c)

the method for test and calibration shall be in accordance with the international standard pursuant to procedures as determined by the National Measurement

Standards Laboratory established under section 9 of the National Measurement

System Act 2007 [Act 675] relating to motor vehicle’s speedometer accuracy, precise measuring tools or equivalent speed;

(d)

the test and calibration are deemed as accurate if the measured values are within the permissible error of 3 km/h for speed less than 100km/h and within the permissible error of three percent for speed more than 100km/h;

(e)

a sample size or continuity test for the purpose of accuracy shall be conducted—

(i)

in relation to a static camera, more than five times; or

(f)

a public servant who is an electrical engineer or a mechanical engineer shall certify the result of such test and calibration in a certificate as specified in the

Third Schedule; and

(g)

the certificate referred to in paragraph (f) shall be valid for a period of eight months from the date the certificate is issued unless the static camera or mobile camera is repaired or any component is replaced during such period.

EXEMPTION

1.

Any motor vehicles carrying or escorting the Yang di-Pertuan Agong or the Raja Permaisuri Agong, the Rulers or their consorts, the Yang di-Pertua

Negeri of the States of Malacca, Penang, Sabah and Sarawak or their wives, the

Dato’-Dato’ Undang Negeri Sembilan or the Tengku Besar Tampin or their wives,

the Tengku Mahkota or the Raja Muda of any State or their wives, the Raja

Di-Hilir of Perak or his wife or any visiting foreign dignitary.

2.

Any motor vehicles carrying or escorting the Prime Minister, Deputy Prime

Minister or any State’s guests.

3.

All military motor vehicles belonging to the Government or to any visiting force as defined in the Visiting Forces Act 1960 [Act 432].

4.

All Government motor vehicles solely engaged in ambulance duties, fire fighting duties, police duties, road transport enforcement duties, customs enforcement duties or rescues duties inclusive of rescue team motor vehicles from the Civil

Defence Department and motor vehicles from the Prison Department whilst on prisoner’s escort duties.

5.

All non-Government motor vehicles solely engaged in ambulance duties, fire fighting duties and rescue duties.
