FEDERAL TERRITORY (PLANNING) (APPLICATION FOR PLANNING PERMISSION)
(FEDERAL TERRITORY OF KUALA LUMPUR) RULES 2025
IN exercise of the powers conferred by paragraphs 64(2)(j) and (l) of the
Federal
Territory
(Planning)
Act 1982
[Act 267], the
Commissioner, with the approval of the Minister, makes the following rules:
Citation and commencement 1.
(1)
These rules may be cited as the Federal Territory (Planning)
(Application for Planning Permission) (Federal Territory Of Kuala Lumpur)
Rules 2025.
(2)
These Rules come into operation on 16 June 2025.
Application for planning permission 2.
(1)
An application for a planning permission under section 21 of the Act shall be made by an applicant to the Commissioner in Form A1, A2, A3, A4, A5,
A6, A7, A8, A9 and A10 of the First Schedule together with the fee as prescribed in the Second Schedule.
(2)
At any time after receiving an application under subrule (1) and before the application is determined, the Commissioner may, in writing, require the applicant to give any further information as may be necessary to enable the Commissioner to decide on the application.
Consultation 3.
Before considering an application for a planning permission made under rule 2, the Commissioner may, if he thinks necessary, consult any relevant authority, department, society or any interested person upon the application.

Development order 4.
After considering the application made under rule 2, the Commissioner may—
(a)
grant planning permission and issue a development order in Form B of the First Schedule to the applicant; or
(b)
refuse to grant planning permission and issue a notice of refusal of the planning permission in Form C of the First Schedule to the applicant.
Application to extend development order 5.
(1)
An application to extend a development order under subsection 24(2) of the Act shall be made by the applicant to the Commissioner in Form D of the
First Schedule before the expiry of the period of development order together with the payment of fee as prescribed in the Second Schedule.
(2)
The Commissioner may grant or refuse to grant the application to extend a development order by issuing Form E1 or Form E2 respectively of the First Schedule to the applicant.
Revocation and modification of development order 6.
(1)
If it appears to the Commissioner that any development order issued in relation to such development should be revoked or modified in pursuant to subsection 25(1) of the Act, the Commissioner shall issue Form F of the First Schedule to the person to whom the development order is granted.
(2)
The person to whom the development order in relation to such development is issued who is aggrieved by the revocation or modification of the development order may claim compensation from the Commissioner in Form G of the First Schedule within the time specified in Form F of the First Schedule.

(3)
Upon receipt of Form G under subrule (2) and after the Commissioner give the aggrieved person a reasonable opportunity to be heard, the Commissioner shall offer a compensation to the aggrieved person in Form H of the First Schedule as the Commissioner thinks adequate.
Fees paid shall not be refunded 7.
All fees paid under these Rules shall not be refunded.
Revocation 8.
The Planning (Development) Rules, 1970 [P.U. (A) 7/1971] is revoked.
Saving and transitional provision 9.
(1)
Any application made under the Planning (Development) Rules, 1970
[P.U. (A) 7/1971], which are referred to as “the revoked Rules”, for a planning permission, development order or extension of development order or modification of development order which are pending before the date of the coming into operation of these Rules shall, after the date of the coming into operation of these Rules, be dealt with under the revoked Rules as if these Rules have not been made.
(2)
Any development order or extension of development order or modification of development order issued under the revoked Rules shall, after the date of the coming into operation of these Rules, continue to be in force and have effect until the development order or extension of development order or modification of development order expires or revoked.
(3)
Any proceedings, whether civil or criminal, or any enforcement action commenced under the revoked Rules which are pending on the date of the coming into operation of these Rules shall, on the date of the coming into operation of these Rules, be continued and concluded under the revoked Rules as if these Rules have not been made.
