  1. Bahawasanya hasil yang dikenakan bagi tanah yang tersebut dan yang kena dibayar bagi tahun ini telah tidak dibayar dan adalah terhutang mulai dari 1 Jun. Tuan/Puan dengan ini dikehendaki, dalam tempoh tiga bulan dari tarikh notis ini disampaikan, supaya membayar di Pejabat Tanah daerah ini di Seremban segala wang yang sekarang ini kena dibayar sebagaimana yang tercatat dalam ruangan tiga hingga enam dalam Jadual itu dan yang dijumlahkan dalam ruangan akhirnya. Dan lagi notis diberikan bahawa, jika jumlah yang dinyatakan dalam ruangan akhir itu tidak dibayar dengan sepenuhnya dalam tempoh tiga bulan yang tersebut itu, maka saya yang bertandatangan di bawah ini, menurut kuasa yang diberikan oleh seksyen 100 Kanun Tanah Negara, akan mengisytiharkan dengan jalan perintah tanah itu dilucuthakkan kepada Pihak Berkuasa Negeri. 31hb Julai 2003] 655

Medan Setia 1, Plaza Damansara, Bukit Damansara, 50490 Kuala Lumpur,

Pemegang gadai.

Sekiranya tuan/puan ada sebab untuk mempercayai bahawa bagi tanah yang dijadualkan di atas itu dan yang atasnya tuan/puan ada hak mempunyai atau menuntut sesuatu kepentingan akan mungkir daripada membayar wang-wang yang sekarang ini ditetapkan sebagai kena dibayar berkenaan dengannya maka tuan/puan boleh mengelakkan tanah itu daripada dilucuthak dengan membayar sepenuhnya kepada Pentadbir Tanah, dalam tempoh yang dinyatakan itu, jumlah wang yang kena dibayar berkenaan dengan tanah itu.

Dan lagi notis diberikan bahawa (dengan tidak melemahkan apa-apa hak di bawah seksyen itu untuk mendakwa tuan punya itu secara terus) menurut seksyen 98 Kanun Tanah Negara, hak-hak istimewa bagi mendapat balik bayaran-bayaran adalah seperti berikut:

(IC. 6976824) of 15 Persiaran Wira, Jaya Barat, 48 Desa Perwira, 31350 Ipoh,

Perak, proprietor of the land described in the 1st and 2nd columns of the

Schedule below.

Whereas the rent reserved on the said land and due in respect of the current year is unpaid and, with effect from the 1st day of June, in arrears.

You are hereby required, within three months of the date of service of this notice, to pay at the Land Office of this district at Seremban all the sums now due as entered in the 3rd-6th columns of the Schedule and totalled in the final column thereof.

And take notice that, if the total specified in the final column is not paid in full within the said period of three months, then I the undersigned, by virtue of the powers conferred by section 100 of the National Land Code, shall by order declare the land forfeited to the State Authority.

SUPPLEMENT

To Southern Bank Berhad of Menara Southern Bank, 83 Medan Setia 1,

Plaza Damansara, Bukit Damansara, 50490 Kuala Lumpur, Chargee.

Should you have reason to believe that the proprietor of that land scheduled above in which you possess or claim an interest will make default in payment of the sums now declared due thereon, you may avoid the forfeiture of such land by paying in full to the Land Administrator, within the time specified, the total specified in respect of that land.

And take notice that (without prejudice to any right under that section to sue the proprietor direct) the following special rights of recovery exist by virtue of section 98 of the National Land Code:

(a)

any sum paid by a chargee shall be added to the first payment thereafter due under the charge;

(b)

any sum paid by a lessee, sub-lessee or tenant may be recovered by deducting the amount of such sum from any rent then or there after due from him to the proprietor or other person under whom the land is held;

(c)

any lessee, sub-lessee or tenant who incurs any additional liability or suffers any deduction under that section may recover the amount of such liability or deduction by making a corresponding deduction from the amount of the rent payable by him.
