  1. PADA menjalankan kuasa yang diberikan oleh seksyen 98 Akta Keselamatan Sosial Pekerja 1969 [Akta 4], Menteri membuat pemberitahuan yang berikut: Nama dan permulaan kuat kuasa

(1)

Menteri mengecualikan daripada kuat kuasa Akta—

(a)

mana-mana pekerja domestik yang diambil kerja oleh majikan, yang merupakan saudara terdekat;

mana-mana pekerja domestik asing yang diambil kerja oleh majikan asing; dan

Suggest a correction

(i)

bekerja di Malaysia pada atau selepas tarikh permulaan kuat kuasa

Pemberitahuan ini; atau

(ii)

telah bekerja di Malaysia sebaik sebelum tarikh permulaan kuat kuasa Pemberitahuan ini, tanpa suatu Pas Lawatan (Kerja Sementara) yang sah yang dikeluarkan di bawah peraturan 11 Peraturan-Peraturan Imigresen 1963

[F.L.N. 228/1963] tetapi kemudiannya, selepas tarikh permulaan

kuat kuasa Pemberitahuan ini, suatu Pas Lawatan (Kerja Sementara)

yang sah dikeluarkan kepada pekerja domestik asing itu.

Pengecualian di bawah subsubperenggan (1)(c) hendaklah terpakai bagi pekerja domestik asing itu bagi apa-apa tempoh sebelum tarikh pengeluaran

Bagi maksud perenggan ini—

(a)

“pekerja domestik” ertinya seseorang yang diambil kerja semata-mata dalam kerja atau yang berkaitan dengan kerja bagi suatu rumah kediaman persendirian dan bukan bagi apa-apa perdagangan, perniagaan atau profesion yang dijalankan oleh majikan dalam rumah kediaman itu dan termasuklah seorang tukang masak, pekhidmat rumah

(termasuk pekhidmat bilik tidur dan dapur), pelayan, butler, orang yang menjaga kanak-kanak atau bayi, valet, kundang, tukang kebun, lelaki pencuci kain atau perempuan pencuci kain, jaga, sais dan pemandu atau pencuci apa-apa kenderaan berlesen untuk kegunaan persendirian;

(b)

“pekerja domestik asing” ertinya seseorang pekerja asing yang diambil kerja semata-mata dalam kerja atau yang berkaitan dengan kerja bagi suatu rumah kediaman persendirian dan bukan bagi apa-apa perdagangan, perniagaan atau profesion yang dijalankan oleh majikan dalam rumah kediaman itu dan termasuklah seorang tukang masak, pekhidmat rumah (termasuk pekhidmat bilik tidur dan dapur), pelayan, butler, orang yang menjaga kanak-kanak atau bayi, valet, kundang, tukang kebun, lelaki pencuci kain atau perempuan pencuci kain, jaga, sais dan pemandu atau pencuci apa-apa kenderaan berlesen untuk kegunaan persendirian;

suami atau isteri;

(iii)

ibu atau bapa, adik-beradik atau datuk atau nenek termasuk ibu angkat atau bapa angkat, adik-beradik angkat dan datuk angkat atau nenek angkat, dan ibu tiri atau bapa tiri, adik-beradik tiri dan datuk tiri atau nenek tiri;

ibu mentua atau bapa mentua, menantu lelaki atau menantu perempuan termasuk ibu mentua angkat atau bapa mentua angkat, menantu lelaki angkat dan menantu perempuan angkat, dan ibu mentua tiri atau bapa mentua tiri, menantu lelaki tiri dan menantu perempuan tiri; atau

  1. IN exercise of the powers conferred by section 98 of the Employees’ Social Security Act 1969 [Act 4], the Minister makes the following notification: Citation and commencement 1.

(1)

This notification may be cited as the Employees’ Social Security

(Exemption) Notification 2021.

This Notification comes into operation on 1 June 2021.

(1)

The Minister exempts from the operation of the Act—

(a)

any domestic employee who is employed by an employer, who is a close relative;

any foreign domestic employee who is employed by a foreign employer;

and

Suggest a correction

(i)

works in Malaysia on or after the date of coming into operation of this Notification; or

(ii)

has worked in Malaysia immediately before the date of coming into operation of this Notification, without a valid Visit Pass (Temporary Employment) issued under regulation 11 of the Immigration Regulations 1963 [F.L.N. 228/1963]

but subsequently, after the date of coming into operation of this

Notification, a valid Visit Pass (Temporary Employment) is issued to such foreign domestic employee.

(2)

The exemption under subsubparagraph (1)(c) shall apply to such foreign domestic employee for any period before the date of issuance of the valid Visit Pass

(Temporary Employment).

For the purposes of this paragraph—

(a)

“domestic employee” means a person employed exclusively in the work or in connection with work of a private dwelling house and not of any trade, business or profession carried on by the employer in such dwelling house and includes a cook, house servant (including bedroom and kitchen servants), waiter, butler, child’s or baby’s nurse, valet, footman, gardener, washerman or washerwoman, watchman, groom and driver or cleaner of any vehicle licensed for private use;

(b)

“foreign domestic employee” means a foreign employee employed exclusively in the work or in connection with work of a private dwelling house and not of any trade, business or profession carried on by the employer in such dwelling house and includes a cook, house servant

(including bedroom and kitchen servants), waiter, butler, child’s or baby’s nurse, valet, footman, gardener, washerman or washerwoman, watchman, groom and driver or cleaner of any vehicle licensed for private use;

a spouse;

(ii)

a child including an adopted child and a stepchild;

a parent, a sibling or a grandparent including an adopted parent, an adopted sibling and an adopted grandparent, and a step-parent, a step-sibling and a step-grandparent;

a parent-in-law, a son-in-law or a daughter-in-law including an adopted parent-in-law, an adopted son-in-law and an adopted daughter-in-law, and a step-parent-in-law, a step-son-in-law and a step-daughter-in-law; or

(i)

a non-citizen who is residing permanently in Malaysia and issued with an identity card as described under paragraph 5(3)(b) of the

National Registration Regulations 1990 [P.U. (A) 472/1990];

lawfully enters Malaysia under a valid immigration pass or permit;

(B)

is allowed to reside in Malaysia for a period of twelve months and above; and is issued with an identity card as described under paragraph 5(3)(c)

a person who is born in Malaysia but whose citizenship status cannot be determined, and issued with an identity card as described under paragraph 5(3)(c) of the National Registration

Regulations 1990;
