Gaji bulanan purata minimum yang disebut dalam subperaturan (1)
hendaklah terpakai bagi orang berinsurans jika kadar pencen ilat atau pencen penakat yang diterima pada 31 Disember 2022 oleh orang berinsurans itu atau orang tanggungannya, mengikut mana-mana yang berkenaan, kurang daripada lima ratus lima puluh ringgit.

EMPLOYEES’ SOCIAL SECURITY (MINIMUM AVERAGE MONTHLY WAGE)
REGULATIONS 2022
IN exercise of the powers conferred by section 105
of the
Employees’
Social
Security
Act 1969
[Act 4], the
Minister makes the following regulations:
Citation and commencement 1.
(1)
These regulations may be cited as the Employees’ Social Security
(Minimum Average Monthly Wage) Regulations 2022.
(2)
These Regulations come into operation on 1 January 2023.
Minimum average monthly wage
2. (1)
The minimum average monthly wage for an insured person for the purpose of invalidity pension referred to in subsection 20(2) of the Act or survivors’
pension referred to in paragraph 4 of the Eighth Schedule to the Act shall be one thousand and one hundred ringgit.
(2)
The minimum average monthly wage referred to in subregulation (1)
shall apply to an insured person if the rate of the invalidity pension or survivors’ pension received on 31 December 2022 by the insured person or his dependants, as the case may be, is less than five hundred and fifty ringgit.
