Negeri 1981 [P.U. (A) 27/1981], yang disebut “Peraturan-Peraturan ibu” dalam
Peraturan-Peraturan ini, dipinda dengan menggantikan peraturan 5 dengan peraturan yang berikut:
“5. Tiap-tiap permohonan untuk mendapatkan lesen hendaklah dibuat kepada
Lembaga melalui cara elektronik atau dalam borang yang ditetapkan dalam
Jadual Pertama.”.
Penggantian peraturan 6 3.
Peraturan-Peraturan ibu dipinda dengan menggantikan peraturan 6 dengan peraturan yang berikut:
“Maklumat tambahan
6. (1) Lembaga boleh secara bertulis, selepas menerima sesuatu permohonan di bawah peraturan 5 tetapi sebelum sesuatu ketentuan dibuat, menghendaki pemohon untuk memberikan apa-apa maklumat atau dokumen tambahan

sebagaimana yang didapati perlu oleh Lembaga bagi maksud menentukan kesesuaian pemohon untuk lesen.
Jika apa-apa maklumat atau dokumen tambahan yang dikehendaki di bawah subperaturan (1) tidak diberikan oleh pemohon, permohonan bagi lesen hendaklah disifatkan telah ditarik balik dan tidak boleh diteruskan tetapi tanpa menjejaskan suatu permohonan baru bagi lesen kepada Lembaga.”.
Peraturan baru 6A
4. Peraturan-Peraturan ibu dipinda dengan memasukkan selepas peraturan 6
peraturan yang berikut:
“Kuasa Lembaga untuk meluluskan atau menolak permohonan 6A. (1) Apabila diterima suatu permohonan bagi lesen di bawah peraturan 5
dan apa-apa maklumat dan dokumen di bawah subperaturan 6(1), Lembaga boleh meluluskan atau menolak permohonan itu.
Jika
Lembaga menolak permohonan itu,
Lembaga hendaklah memaklumkan pemohon secara bertulis mengenai penolakan itu.”.
Pindaan peraturan 7 5.
Subperaturan (7)(1) dan (2) Peraturan-Peraturan ibu dipinda dengan menggantikan perkataan “fi yang berpatutan” dengan perkataan “fi yang ditetapkan”.
Pindaan peraturan 14 6.
Peraturan 14 Peraturan-Peraturan ibu dipinda–
dalam subperaturan (1), dengan memotong perkataan “dan tiap-tiap permohonan itu hendaklah disertakan dengan akuan berkanun yang dibuat oleh pemohon yang menyatakan maksud bahawa salinan asal lesen itu telah hilang atau rosak, mengikut mana-mana yang berkenaan”;

dalam subperaturan (2), dengan menggantikan perkataan “dalam borang yang ditetapkan dalam Jadual Ketiga” dengan perkataan “dalam borang yang ditentukan oleh Lembaga”; dan
dengan memasukkan selepas subperenggan (3) subperenggan yang berikut:
“(4)
Jika salinan asal lesen itu kemudiannya dijumpai selepas dikeluarkan suatu salinan lesen yang diperakui benar, lesen itu hendaklah dikembalikan kepada Lembaga dengan seberapa segera yang boleh.”.
Pindaan peraturan 15 7.
Peraturan 15 Peraturan-Peraturan ibu dipinda dengan menggantikan perkataan
“peraturan-peraturan 5, 6, 7,” dengan perkataan “peraturan-peraturan 5, 6, 6A, 7,”.
Pindaan peraturan 21 8.
Peraturan-Peraturan ibu dipinda dengan menggantikan peraturan 21 dengan peraturan yang berikut:
“21. Jika sesuatu lesen hilang atau rosak, pemegang lesen hendaklah–
(a)
memberitahu secara bertulis kepada Pegawai Pelabuhan di Jabatan
Laut berkenaan dengan kehilangan atau kerosakan itu; dan
(b)
mendapatkan suatu salinan lesen yang diperakui benar dengan seberapa segera daripada Lembaga.”.
Pindaan peraturan 24 9.
Peraturan 24 Peraturan-Peraturan ibu dipinda dengan menggantikan perkataan
“boleh apabila disabitkan dikenakan denda tidak lebih daripada satu ribu ringgit atau penjara selama tempoh tidak lebih daripada enam bulan atau kedua-duanya” dengan perkataan “boleh, apabila disabitkan, didenda tidak melebihi sepuluh ribu ringgit atau dipenjarakan selama tempoh tidak melebihi satu tahun atau kedua-duanya”.

MERCHANT SHIPPING ORDINANCE 1952
DOMESTIC SHIPPING LICENSING BOARD (AMENDMENT) REGULATIONS 2011
IN exercise of the powers conferred by section 65D of the Merchant Shipping Ordinance 1952 [Ord. 70/1952], the Domestic Shipping Licensing Board, with the approval of the
Minister, makes the following regulations:
Citation and commencement 1.
These regulations may be cited as the Domestic Shipping Licensing Board
(Amendment) Regulations 2011.
These Regulations come into operation on 30 December 2011.
Substitution of regulation 5
2. The Domestic Shipping Licensing Board Regulations 1981 [P.U. (A) 27/1981], which are referred to as the “principal Regulations” in these Regulations, are amended by substituting for regulation 5 the following regulation:
“5.
Every application for a licence shall be made to the Board through electronic means or in the form prescribed in the First Schedule.”.
Substitution of regulation 6
3. The principal Regulations are amended by substituting for regulation 6 the following regulation:
“Additional information
6. (1) The Board may in writing, after receiving an application under regulation 5 but before a determination is made, require the applicant to provide such additional information or document as may be considered necessary by the Board for the purposes of determining the suitability of the applicant for the licence.

If any additional information or document required under subregulation (1) is not provided by the applicant, the application for a licence shall be deemed to be withdrawn and shall not be further proceeded with but without prejudice to a fresh application for licence to the Board.”.
New regulation 6A
4. The principal Regulations are amended by inserting after regulation 6 the following regulation:
“Power of Board to approve or refuse application
6A. (1) Upon receipt of an application for licence under regulation 5 and any information and document under subregulation 6(1), the Board may approve or refuse the application.
Where the Board refuse the application, the Board shall notify the applicant in writing of such refusal.”.
Amendment of regulation 7 5.
Subregulations 7(1) and (2) of the principal Regulations are amended by substituting for the words “the appropriate fee” the words “the prescribed fee”.
Amendment of regulation 14 6.
Regulation 14 of the principal Regulations is amended–
in subregulation (1), by deleting the words “and every such application shall be accompanied by a statutory declaration made by the applicant to the effect that the original copy of the licence has been lost or damaged, as the case may be”;
in subregulation (2), by substituting for the words “in the form prescribed in the Third Schedule” the words “in the form as determined by the Board”; and
by inserting after subregulation (3) the following subregulation:

“(4) Where the original copy of the licence is subsequently found after the issue of a certified true copy of a licence, such licence shall be returned to the Board as soon as possible.”.
Amendment of regulation 15 7.
Regulation 15 of the principal Regulations is amended by substituting for the words “regulations 5, 6, 7,” the words “regulations 5, 6, 6A, 7,”.
Amendment of regulation 21
8. The principal Regulations are amended by substituting for regulation 21 the following regulation:
“21.
Where a licence is lost or damaged, the licensee shall–
inform in writing to the Port Officer of the Marine Department in respect of such loss or damage; and
obtain a certified true copy of the licence immediately from the
Board.”.
Amendment of regulation 24
9. Regulation 24 of the principal Regulations is amended by substituting for the words
“shall be liable on conviction to a fine not exceeding one thousand ringgit or to imprisonment for a term not exceeding six months or to both such fine and imprisonment” the words “shall, on conviction, be liable to a fine not exceeding ten thousand ringgit or to imprisonment for a term not exceeding one year or to both”.
Deletion of Third Schedule
10. The principal Regulations are amended by deleting the Third Schedule.
