PADA menjalankan kuasa yang diberikan oleh seksyen 87 Akta Paten 1983 [Akta 291], Menteri membuat peraturan-peraturan yang berikut: Nama dan permulaan kuat kuasa

(Pindaan) (Pindaan) 2022.

Peraturan-peraturan ini disifatkan telah mula berkuat kuasa pada 18 Mac 2022.

Pindaan peraturan 64

Seksyen 2

Peraturan-Peraturan Paten (Pindaan) 2022 [P.U. (A) 68/2022] dipinda dalam peraturan 64 dengan menggantikan perenggan 64(4)(c) dengan perenggan yang berikut:

“(c) seseorang yang telah lulus peperiksaan di bawah peraturan 45D

Peraturan-Peraturan ibu sebelum tarikh mula berkuat kuasanya

Peraturan-Peraturan ini dan berhasrat untuk didaftarkan sebagai ejen paten hendaklah, dalam tempoh tiga tahun dari tarikh mula berkuat kuasanya

Peraturan-Peraturan ini, membuat suatu permohonan untuk didaftarkan sebagai ejen paten di bawah peraturan 45C Peraturan-Peraturan ibu sebagaimana yang dipinda dalam peraturan 46 Peraturan-Peraturan ini dan orang itu hendaklah dianggap telah memenuhi kehendak perenggan 45C(2)(c)

dan subperaturan 45C(7) Peraturan-Peraturan ibu sebagaimana yang dipinda dalam peraturan 46 Peraturan-Peraturan ini;”.

PATENTS (AMENDMENT) (AMENDMENT) REGULATIONS 2022

Opening note

Preamble

IN exercise of the powers conferred by section 87 of the Patents Act 1983 [Act 291], the Minister makes the following regulations: Citation and commencement 1.

(1)

These regulations may be cited as the Patents (Amendment) (Amendment)

Regulations 2022.

(2)

These Regulations shall be deemed to have come into operation on 18 March 2022.

Amendment of regulation 64 2.

The Patents (Amendment) Regulations 2022 [P.U. (A) 68/2022] are amended in regulation 64 by substituting for paragraph 64(4)(c) the following paragraph:

“(c) a person who has passed the examination under regulation 45D of the principal Regulations before the date of coming into operation of these

Regulations and intends to be registered as a patent agent shall, within the period of three years from the date of coming into operation of these

Regulations, make an application to be registered as a patent agent under regulation 45C of the principal Regulations as amended in regulation 46

of these Regulations and the person shall be deemed to have fulfilled the requirements of paragraph 45C(2)(c) and subregulation 45C(7) of the principal

Regulations as amended in regulation 46

of these Regulations;”.
