Pindaan Jadual Kedua

Jadual Kedua kepada Peraturan-Peraturan ibu dipinda—

(a)

dengan memotong butiran 2;

(b)

dalam butiran 3, dengan menggantikan perkataan “Kelengkapan rumah dan taman permainan awam” dengan perkataan “Kelengkapan taman permainan awam”;

(c)

dalam teks bahasa kebangsaan, dalam butiran 19, dengan menggantikan perkataan “mainan” dengan perkataan “bayi”; dan

(d)

dalam butiran 22, dengan memasukkan selepas perkataan “tujuan utama untuk permainan” perkataan “dan tidak dimaksudkan untuk kanak-kanak di bawah umur empat belas tahun”.

Kecualian 4.

(1)

Mana-mana mainan yang—

(a)

telah mematuhi standard keselamatan yang ditetapkan di bawah

Peraturan-Peraturan ibu; dan

(b)

telah dibekalkan untuk dijual di pasaran,

sebelum permulaan kuat kuasa Peraturan-Peraturan ini hendaklah diuruskan seolah-olah

Peraturan-Peraturan ibu tidak dipinda oleh Peraturan-Peraturan ini.

(2)

Mana-mana barang yang—

(a)

tidak dianggap sebagai mainan di bawah Peraturan-Peraturan ibu; dan

(b)

telah dibekalkan untuk dijual di pasaran, sebelum permulaan kuat kuasa Peraturan-Peraturan ini hendaklah diuruskan seolah-olah

Peraturan-Peraturan ibu tidak dipinda oleh Peraturan-Peraturan ini.

CONSUMER PROTECTION (SAFETY STANDARDS FOR TOYS) (AMENDMENT)

REGULATIONS 2016

IN exercise of the powers conferred by section 19

of the Consumer Protection Act 1999 [Act 599], the Minister makes the following regulations:

Citation and commencement 1.

(1)

These regulations may be cited as the Consumer Protection (Safety

Standards for Toys) (Amendment) Regulations 2016.

(2)

These Regulations come into operation on 1 January 2018.

Substitution of First Schedule 2.

The Consumer Protection (Safety Standards for Toys) Regulations 2009

[P.U. (A) 275/2009], which are referred to as the “principal Regulations” in these Regulations, are amended by substituting for the First Schedule the following Schedule:

Standard consumer safety specification for toy safety

Amendment of Second Schedule 3.

The Second Schedule to the principal Regulations is amended—

(a)

by deleting item 2;

(b)

in item 3, by substituting for the words “Home and public playground equipment” the words “Public playground equipment”;

(c)

in the national language text, in item 19, by substituting for the word “mainan”

the word “bayi”; and

(d)

in item 22, by inserting after the words “primarily of play value” the words

“and not intended for children under fourteen years of age”.

Savings 4.

(1)

Any toy which—

(a)

has complied with the safety standards prescribed under the principal

Regulations; and

(b)

has been supplied for sale in the market, before the commencement of these Regulations shall be dealt with as if the principal

Regulations had not been amended by these Regulations.

(2)

Any goods which─

(a)

is not regarded as a toy under the principal Regulations; and

(b)

has been supplied for sale in the market, before the commencement of these Regulations shall be dealt with as if the principal

Regulations had not been amended by these Regulations.
