  1. PADA menjalankan kuasa yang diberikan oleh seksyen 41 Akta Zon Ekonomi Eksklusif 1984 [Akta 311], Yang di-Pertuan Agong membuat peraturan-peraturan yang berikut:

Bahagian I

BAHAGIAN I

Seksyen 2

Dalam Peraturan-Peraturan ini, melainkan jika konteksnya menghendaki makna yang lain—

“bendera negara” berhubung dengan sesuatu vesel, ertinya Negara yang vesel itu didaftarkan dan dilesenkan di bawah undang-undang Negara itu dan Negara yang benderanya berhak dikibar oleh vesel;

“ejen” ertinya seorang wakil yang diberi kuasa untuk bertindak bagi pihak pemunya sesuatu vesel untuk menguruskan keperluan penjalanan dan pentadbiran vesel itu;

“fitur” ertinya apa-apa flora, fauna, habitat atau fitur lain yang boleh menjadi fitur yang dilindungi;

“fitur yang dilindungi” berhubung dengan kawasan sensitif laut, ertinya—

(c)

mana-mana tapak yang terdiri daripada tinggalan mana-mana vesel, pesawat udara, pepasangan dan struktur yang mempunyai kepentingan sejarah atau arkeologi;

“kawasan sensitif laut” ertinya kawasan yang ditetapkan sebagai kawasan sensitif laut di bawah peraturan 3;

“lepas” berhubung dengan sesuatu vesel, ertinya sesuatu vesel yang tidak berlabuh, yang tidak ditambat ke pantai atau yang tidak terkandas;

“operasi mengisi bunker” ertinya pemindahan minyak di antara vesel bagi penggunaan enjin vesel yang menerima minyak itu;

“pelan operasi vesel ke vesel” ertinya suatu dokumen yang mengandungi maklumat mengenai operasi pemindahan kargo sebagaimana yang diluluskan oleh kerajaan bendera Negara;

“pemindahan kargo” ertinya pemindahan minyak, gas cecair, bahan kimia pukal cecair atau keluaran-keluaran petroleum di antara dua vesel yang diangkut melalui salah satu atau kedua-dua vesel yang berlabuh atau lepas, tetapi tidak termasuk operasi mengisi bunker;

“struktur laut” termasuklah kabel bawah tanah, talian paip, pulau-pulau buatan, perhentian luar pantai, pepasangan, struktur atau alat di laut.

BAHAGIAN II

KAWASAN SENSITIF LAUT

Penetapan kawasan sensitif laut

Seksyen 3

(1)

Kerajaan hendaklah mengeluarkan notis secara bertulis menetapkan mana-mana kawasan dalam zon ekonomi eksklusif atau pelantar benua sebagai kawasan sensitif laut bagi maksud yang berikut:

(a)

bagi perlindungan, pemeliharaan, pemuliharaan atau keselamatan fitur yang dilindungi;

bagi pencegahan, pengurangan dan kawalan pencemaran daripada struktur laut;

(c)

bagi perlindungan apa-apa pepasangan dan struktur bagi pengeksploitasian ekonomi dan penjelajahan zon ekonomi eksklusif atau pelantar benua;

(d)

bagi perlindungan garis pantai Malaysia atau apa-apa bahagian atau unsur alam sekitar atau kepentingan yang berkaitan, daripada pencemaran atau ancaman pencemaran berikutan daripada bencana laut atau perbuatan yang berhubungan dengan bencana laut itu yang boleh dijangkakan dengan munasabahnya berlaku akibat merbahaya yang besar; dan

bagi pemulihan keadaan mana-mana kawasan akibat daripada pencemaran laut.

(2)

Notis yang disebut dalam subperaturan (1) hendaklah mengandungi butir-butir yang berikut—

(a)

perihalan sempadan kawasan sensitif laut yang terlibat;

langkah-langkah bagi perlindungan kawasan sensitif laut; dan

Suggest a correction

(d)

apa-apa maklumat lain sebagaimana yang ditentukan oleh Kerajaan.

Kerajaan boleh, pada bila-bila masa, mengeluarkan suatu notis secara bertulis untuk menggantung, membatalkan atau mengubah notis yang dikeluarkan di bawah subperaturan (1).

Notis yang dikeluarkan di bawah subperaturan (1) dan (3) hendaklah disiarkan mengikut apa-apa cara yang difikirkan perlu oleh Kerajaan bagi memberitahu mana-mana orang yang berkemungkinan akan terjejas oleh pembuatan notis itu.

Walau apa pun peraturan 3, Kerajaan boleh mengeluarkan suatu notis interim secara bertulis bagi maksud melindungi mana-mana fitur dalam zon ekonomi eksklusif atau pelantar benua, jika Kerajaan mempunyai sebab untuk mempercayai bahawa terdapat keperluan mendesak untuk melindungi fitur itu.

Notis interim yang disebut dalam subperaturan (1) hendaklah mengandungi butir-butir yang berikut—

(c)

langkah-langkah bagi perlindungan fitur itu; dan

(d)

tempoh yang notis interim itu hendaklah berkuat kuasa.

Notis interim di bawah subperaturan (1) hendaklah disiarkan mengikut apa-apa cara yang difikirkan perlu oleh Kerajaan bagi memberitahu mana-mana orang yang berkemungkinan akan terjejas oleh pembuatan notis interim itu.

Notis interim yang dikeluarkan di bawah subperaturan (1) hendaklah terhenti berkuat kuasa selepas tempoh yang dinyatakan dalam notis interim itu.

Langkah-langkah bagi perlindungan kawasan sensitif laut dan perlindungan fitur

(1)

Kerajaan hendaklah menyatakan dalam notis yang dikeluarkan di bawah peraturan 3, langkah-langkah yang berikut bagi perlindungan kawasan sensitif laut untuk dipatuhi oleh pemunya, nakhoda atau ejen sesuatu vesel:

(a)

penentuan laluan layar atau alur laut bagi vesel;

larangan atau sekatan kemasukan, apa-apa pergerakan atau aktiviti lain oleh vesel dalam kawasan sensitif laut;

(c)

larangan atau sekatan penggunaan vesel bagi perihalan yang dinyatakan dalam kawasan sensitif laut;

(d)

pengawalseliaan kelajuan yang mana-mana vesel boleh berlayar dalam kawasan sensitif laut bagi maksud mencegah apa-apa kesan buruk mengenai tujuan kawasan sensitif laut itu;

(e)

larangan atau sekatan pembunuhan, pengambilan, kemusnahan atau gangguan flora dan fauna dalam apa-apa perihalan dalam kawasan sensitif laut;

(f)

larangan atau sekatan apa-apa aktiviti yang berkemungkinan menyebabkan kerosakan pada dasar laut atau fitur yang dilindungi dalam kawasan sensitif laut;

larangan atau sekatan pengeksploitasian sumber perikanan dalam tempoh yang dinyatakan dan apa-apa cara untuk mengeksploit sumber perikanan; atau

(h)

apa-apa langkah-langkah lain yang difikirkan perlu dan suai manfaat oleh Kerajaan.

Kerajaan hendaklah menyatakan dalam notis interim yang dikeluarkan di bawah peraturan 4, langkah-langkah bagi perlindungan fitur sebagaimana yang ditentukan oleh Kerajaan yang perlu dipatuhi oleh pemunya, nakhoda atau ejen vesel.

Mana-mana pemunya, nakhoda atau ejen vesel yang melanggar subperaturan (1) atau (2) melakukan suatu kesalahan.

Kerajaan, dalam menjalankan kuasa di bawah peraturan ini hendaklah mengambil kira hak dan kewajipan semua Negara, termasuk kebebasan navigasi oleh vesel asing dalam zon ekonomi eksklusif atau pelantar benua.

Walau apa pun subperaturan (4), penjalanan kebebasan navigasi oleh vesel asing dalam zon ekonomi eksklusif atau pelantar benua tidak menjejaskan hak kedaulatan dalam, dan bidang kuasa Malaysia ke atas zon ekonomi eksklusif atau pelantar benua.

BAHAGIAN III

LANGKAH-LANGKAH BAGI PERLINDUNGAN DAN

PEMELIHARAAN ALAM SEKITAR LAUT

Kewajipan pemunya, nakhoda dan ejen vesel untuk mengambil langkah-langkah mitigasi

Jika pegawai berkuasa mempunyai alasan yang munasabah untuk mempercayai bahawa kemudaratan yang serius kepada alam sekitar laut sedang berlaku atau berkemungkinan akan berlaku dalam mana-mana kawasan dalam zon ekonomi eksklusif atau pelantar benua berikutan daripada apa-apa aktiviti perkapalan,

pegawai berkuasa boleh, secara bertulis atau melalui komunikasi radio, mengarahkan pemunya, nakhoda atau ejen vesel itu untuk mengambil apa-apa langkah-langkah mengikut amalan perkapalan selamat untuk mencegah atau mengurangkan kesan kemudaratan itu kepada alam sekitar laut.

Mana-mana pemunya, nakhoda atau ejen vesel yang tidak mematuhi arahan pegawai berkuasa di bawah subperaturan (1) melakukan suatu kesalahan.

Seksyen 7

Pemindahan kargo

(1)

Tiada pemindahan kargo dibenarkan dalam zon ekonomi eksklusif atau pelantar benua melainkan jika kebenaran secara bertulis diperoleh daripada Kerajaan.

Subperaturan (1) tidak terpakai bagi pemindahan kargo—

(a)

ke atau dari kapal perang atau vesel tentera laut bantuan;

(b)

ke atau dari mana-mana vesel lain yang dimiliki, dikendalikan atau dilesenkan untuk menjalankan aktiviti yang diberi kuasa oleh Kerajaan di bawah Akta atau mana-mana undang-undang bertulis yang terpakai;

(c)

ke atau dari mana-mana vesel lain yang dimiliki atau dikendalikan oleh

Kerajaan dan digunakan semata-mata, pada masa itu, bagi perkhidmatan bukan komersial kerajaan; dan

Suggest a correction

(d)

bagi maksud menjaga keselamatan vesel, menyelamatkan nyawa di laut atau memerangi pencemaran laut.

Mana-mana orang hendaklah membuat permohonan kepada Kerajaan bagi memperoleh kebenaran secara bertulis bagi pemindahan kargo dalam zon ekonomi eksklusif atau pelantar benua dalam masa tidak kurang daripada empat puluh lapan jam sebelum pemindahan kargo yang telah dirancang.

Permohonan di bawah subperaturan (3) hendaklah disertakan dengan dokumen yang berikut—

(b)

suatu penyataan alam sekitar yang mengandungi maklumat mengenai potensi kesan kepada alam sekitar, sama ada secara langsung atau secara tidak langsung, kepada alam sekitar akibat daripada cadangan pemindahan kargo dan langkah-langkah pencegahan pencemaran yang perlu dijalankan; dan

(i)

nama, bendera, pengenal, nombor

Pertubuhan

Maritim

Antarabangsa dan anggaran masa ketibaan vesel yang akan terlibat dalam pemindahan kargo;

(ii)

tarikh, masa dan lokasi operasi pemindahan kargo yang telah dirancang;

jenis dan cara pemindahan kargo yang akan dijalankan dan sama ada pemindahan kargo akan dijalankan semasa berlabuh atau lepas;

(iv)

perihalan pemindahan kargo termasuk jenis bahan yang akan dipindahkan, kuantiti, kekerapan pemindahan dan tempoh pemindahan kargo;

(v)

langkah-langkah keselamatan yang perlu dijalankan bagi pemindahan kargo; dan

(vi)

apa-apa maklumat lanjut yang difikirkan perlu oleh Kerajaan bagi mempertimbangkan permohonan pemindahan kargo itu.

Kerajaan boleh mengeluarkan kebenaran bagi pemindahan kargo itu jika

Kerajaan berpuas hati bahawa—

(a)

pemohon telah memenuhi kehendak dalam subperaturan (3); dan

(b)

operasi pemindahan kargo itu selaras dengan peraturan-peraturan dan standard bagi pemindahan kargo di bawah Pertubuhan Maritim

Antarabangsa.

Walau apa pun kebenaran yang dikeluarkan oleh Kerajaan di bawah subperaturan (5), pemunya, nakhoda atau ejen vesel hendaklah berkewajipan untuk memberi kepada Kerajaan apa-apa maklumat yang disemak yang berhubungan dengan pemindahan kargo sehingga pemindahan kargo itu selesai.

Kerajaan boleh mengenakan apa-apa terma dan syarat mengenai kebenaran yang diberikan dan pemunya, nakhoda atau ejen vesel hendaklah mematuhi terma dan syarat itu.

Mana-mana orang yang—

(a)

dengan sengaja memberi apa-apa maklumat palsu kepada Kerajaan berhubung dengan permohonan di bawah subperaturan (3);

(b)

dengan sengaja membuat apa-apa representasi palsu bagi maksud memperoleh kebenaran daripada Kerajaan di bawah peraturan ini;

Suggest a correction

(c)

tidak memastikan bahawa pelan operasi vesel ke vesel berada atas vesel;

atau

Suggest a correction

(d)

tidak memastikan bahawa pemindahan kargo dijalankan dengan mematuhi pelan operasi vesel ke vesel, melakukan suatu kesalahan.

Larangan operasi mengisi bunker

Seksyen 8

Tiada operasi mengisi bunker dibenarkan dalam zon ekonomi eksklusif atau pelantar benua.

Subperaturan (1) tidak terpakai bagi operasi mengisi bunker—

(b)

ke atau dari kapal perang atau vesel tentera laut bantuan;

(c)

ke atau dari mana-mana vesel lain yang dimiliki, dikendalikan atau dilesenkan untuk menjalankan aktiviti yang diberi kuasa oleh Kerajaan di bawah Akta atau undang-undang bertulis yang terpakai; dan

ke atau dari mana-mana vesel yang dimiliki atau dikendalikan oleh

Kerajaan dan digunakan semata-mata, pada masa itu, bagi perkhidmatan bukan komersial kerajaan.

Walau apa pun subperaturan (1), seorang pemunya, nakhoda dan ejen vesel tidaklah melakukan kesalahan di bawah subperaturan (1) jika operasi mengisi bunker itu adalah perlu dan perbuatan yang munasabah dikehendaki untuk diambil oleh pemunya, nakhoda dan ejen vesel bagi maksud yang berikut:

Mana-mana pemunya, nakhoda atau ejen vesel yang melanggar subperaturan (1) melakukan suatu kesalahan.

Melaporkan kejadian

Jika suatu vesel terjejas oleh kebakaran, letupan, pelanggaran, kandas atau apa-apa kecemasan lain yang menyebabkan atau yang boleh menyebabkan ancaman kepada alam sekitar laut dalam zon ekonomi eksklusif atau pelantar benua, mana-mana pemunya, nakhoda atau ejen vesel hendaklah, tidak lebih dari enam jam, melaporkan kejadian itu kepada Kerajaan melalui apa-apa saluran komunikasi.

Mana-mana pemunya, nakhoda atau ejen vesel yang melanggar subperaturan (1) melakukan suatu kesalahan.

Bahagian IV

BAHAGIAN IV

PENGUATKUASAAN

Seksyen 10

Penguatkuasaan terhadap vesel

Jika pegawai berkuasa mempunyai alasan yang munasabah untuk mempercayai bahawa vesel yang berlayar dalam zon ekonomi eksklusif atau pelantar benua telah melakukan pelanggaran mana-mana peruntukan Peraturan-Peraturan ini atau mana-mana standard antarabangsa di bawah triti antarabangsa yang Malaysia merupakan sebuah Negara Pihak yang berhubungan dengan pencegahan, pengurangan dan kawalan pencemaran daripada vesel, pegawai berkuasa boleh menghendaki mana-mana pemunya, nakhoda atau ejen vesel untuk memberikan maklumat mengenai yang berikut:

(a)

identiti vesel itu dan pelabuhan pendaftaran vesel itu;

pelabuhan singgahan terakhir dan berikutnya vesel itu; dan

Suggest a correction

(c)

apa-apa maklumat lain yang berkaitan yang difikirkan perlu oleh pegawai berkuasa.

Jika pegawai berkuasa mempunyai alasan yang munasabah untuk mempercayai bahawa vesel yang berlayar dalam zon ekonomi eksklusif atau pelantar benua telah melakukan pelanggaran mana-mana peruntukan Peraturan-Peraturan ini

atau mana-mana standard antarabangsa di bawah triti antarabangsa yang Malaysia merupakan sebuah Negara Pihak yang berhubungan dengan untuk pencegahan, pengurangan dan kawalan pencemaran daripada vesel, pegawai berkuasa boleh membuat pemeriksaan fizikal vesel itu jika—

(a)

nakhoda vesel enggan memberikan maklumat atau maklumat di bawah subperaturan (1); atau

nakhoda vesel membekalkan maklumat yang secara nyata bercanggah dengan keadaan fakta yang jelas.

(3)

Pegawai berkuasa boleh menahan mana-mana vesel yang berlayar dalam zon ekonomi eksklusif atau pelantar benua yang telah melakukan pelanggaran mana-mana peruntukan

Peraturan-Peraturan ini atau mana-mana standard antarabangsa di bawah triti antarabangsa yang Malaysia merupakan sebuah

Negara Pihak yang berhubungan dengan pencegahan, pengurangan dan kawalan pencemaran daripada vesel yang mengakibatkan pelepasan, yang menyebabkan kerosakan atau ancaman kerosakan kepada zon ekonomi eksklusif atau pelantar benua.

Mana-mana pemunya, nakhoda atau ejen vesel yang melanggar subperaturan (1) melakukan suatu kesalahan.

BAHAGIAN V

KESALAHAN

Seksyen 11

Kesalahan merosakkan kawasan sensitif laut

(a)

membunuh atau mencederakan mana-mana fitur yang dilindungi dalam kawasan sensitif laut;

memetik, mengumpul, memotong, mencabut, merosakkan atau memusnahkan mana-mana fitur yang dilindungi kawasan sensitif laut itu;

atau

Suggest a correction

(c)

mengambil apa-apa dari kawasan sensitif laut yang merupakan atau membentuk sebahagian daripada, fitur yang dilindungi kawasan sensitif laut itu, melakukan suatu kesalahan.

Seksyen 12

Mana-mana orang yang—

Mana-mana orang yang dengan sengaja berlabuh sesuatu vesel dalam kawasan sensitif laut melakukan suatu kesalahan.

Walau apa pun subperaturan (1), seseorang tidaklah melakukan kesalahan di bawah subperaturan (1) jika vesel yang berlabuh dalam kawasan sensitif laut adalah perlu dan merupakan perbuatan yang munasabah yang dikehendaki untuk diambil oleh orang itu bagi maksud yang berikut:

(b)

vesel berlabuh disebabkan oleh kerosakan vesel; dan

Seksyen 13

Memecahkan atau merosakkan kabel bawah tanah atau talian paip

(1)

Mana-mana orang yang memecahkan atau merosakkan, atau menyebabkan atau membenarkan vesel untuk memecahkan atau merosakkan kabel bawah tanah atau talian paip dalam kawasan sensitif laut, mana-mana kawasan dalam zon ekonomi eksklusif atau pelantar benua, melakukan suatu kesalahan.

Walau apa pun subperaturan (1), seseorang tidaklah melakukan kesalahan di bawah subperaturan (1) jika orang itu yang memecahkan atau merosakkan, atau

menyebabkan atau membenarkan vesel untuk memecahkan atau merosakkan kabel bawah tanah atau talian paip itu bertindak dengan tujuan yang sah untuk menyelamatkan nyawa atau vesel orang itu.

BAHAGIAN VI

PELBAGAI

Seksyen 14

Liabiliti berkenaan dengan kerosakan kabel bawah tanah atau talian paip

Jika mana-mana orang, semasa memasang atau membaiki kabel bawah tanah atau talian paip yang orang itu merupakan pemunya, menyebabkan apa-apa pecahan dalam atau kerosakan kepada kabel bawah tanah atau talian paip yang lain, orang itu hendaklah bertanggungan, sebagai tambahan kepada apa-apa liabiliti lain yang dia boleh tertakluk kepada untuk menanggung kos pembaikan pecahan atau kerosakan itu, sama ada atau tidak orang itu bersalah atas mana-mana kesalahan dan sama ada atau tidak kerosakan itu oleh sebab kecuaian orang itu.

Seksyen 15

Bon atau cagaran kewangan lain

Jika vesel ditahan sementara menunggu penyelesaian apa-apa prosiding berkenaan dengan mana-mana kesalahan di bawah Peraturan-Peraturan ini, pemunya atau nakhoda sesuatu vesel itu boleh melaksanakan bon atau memberikan bentuk cagaran kewangan lain bersama dengan seorang atau lebih penjamin yang bermastautin di Malaysia, bersyarat dalam suatu jumlah yang tidak melebihi satu juta ringgit sebagai jaminan untuk melepaskan vesel.

Kos memegang vesel, dsb., dalam jagaan 16.

Jika mana-mana vesel dipegang dalam jagaan Kerajaan sementara menunggu penyelesaian apa-apa prosiding berkenaan dengan mana-mana kesalahan di bawah Peraturan-Peraturan ini, kos memegang vesel dalam jagaan Kerajaan hendaklah dianggap sebagai suatu hutang sivil yang kena dibayar kepada Kerajaan dan boleh didapatkan melalui tindakan sivil di mahkamah.

  1. IN exercise of the powers conferred by section 41 of the Exclusive Economic Zone Act 1984 [Act 311], the Yang di-Pertuan Agong makes the following regulations:

Bahagian I

PART I

(1)

These regulations may be cited as the Exclusive Economic Zone

Regulations 2026.

These Regulations come into operation on 29 June 2026.

Interpretation 2.

In these Regulations, unless the context otherwise requires—

“flag state” in relation to a vessel, means the State under whose laws a vessel is registered and licensed and the State whose flag the vessel is entitled to fly;

“agent” means a representative authorized to act on behalf of an owner of a vessel to manage the operation and administrative needs of the vessel;

“feature” means any flora, fauna, habitat or other feature that would be a protected feature;

“protected feature” in relation to a marine sensitive area, means—

any site comprising remains of any vessel, aircraft, installation and structure of historic or archaeological interest;

“marine sensitive area” means an area designated as a marine sensitive area under regulation 3;

“underway” in relation to a vessel, means a vessel which is not at anchor, not made fast to the shore or not aground;

“bunkering operation” means the transfer of oil between vessels for consumption by the engines of the vessel receiving the oil;

“vessel-to-vessel operation plan” means a document containing information on the cargo transfer operation as approved by the government of the flag State;

“cargo transfer” means the transfer of oil, liquified gas, liquid bulk chemicals or petroleum products between two vessels which is transported by either or both of the vessels at anchor or underway, but does not include a bunkering operation;

“marine structure” includes submarine cables, pipelines, artificial islands, offshore terminals, installation, structure or devices at sea.

PART II

MARINE SENSITIVE AREA

Designation of marine sensitive area 3.

(1)

The Government shall issue a notice in writing designating any area in the exclusive economic zone or on the continental shelf as a marine sensitive area for the following purposes:

(a)

for the protection, preservation, conservation or safety of the protected feature;

for the prevention, reduction and control of pollution from marine structure;

(c)

for the protection of any installation and structure for the economic exploitation and exploration of the exclusive economic zone or the continental shelf;

Suggest a correction

(d)

for the protection of Malaysia’s coastline or any segment or element of the environment or related interests, from pollution or threat of pollution following upon a maritime casualty or acts relating to such maritime casualty which may reasonably be expected to result in major harmful consequences; and

(e)

for the restoration of the condition of any area as result of marine pollution.

(2)

The notice referred to in subregulation (1) shall contain the following particulars—

(a)

the description of the boundaries of the marine sensitive area to which it applies;

the objectives for the designation of the marine sensitive area;

(c)

the measures for the protection of the marine sensitive area; and

Suggest a correction

(d)

any other information as may be determined by the Government.

(3)

The Government may, at any time, issue a notice in writing to suspend, revoke or vary the notice issued under subregulation (1).

(4)

The notice issued under subregulation (1) and (3) shall be published in such manner as the Government thinks necessary for bringing it to the notice of any person who are likely to be affected by the making of the notice.

Interim notice 4.

Suggest a correction

(1)

Notwithstanding regulation 3, the Government may issue an interim notice in writing for the purpose of protecting any feature in the exclusive economic zone or on the continental shelf, if the Government has reason to believe that there is an urgent need to protect the feature.

(2)

The interim notice referred to in subregulation (1) shall contain the following particulars—

(a)

the description of the boundaries of the area to which it applies;

the measures for the protection of the feature; and

(d)

the duration of which the interim notice shall be in force.

(3)

The interim notice under subregulation (1) shall be published in such manner as the Government thinks necessary for bringing it to the notice of any person who are likely to be affected by the making of the interim notice.

(4)

The interim notice issued under subregulation (1) shall cease to have effect after the period specified in the interim notice.

Measures for protection of marine sensitive area and protection of feature 5.

(1)

The Government shall specify in the notice issued under regulation 3, the following measures for the protection of the marine sensitive area to be complied with by an owner, a master or an agent of a vessel:

(a)

the determination of fairways or sea lanes for vessel;

the prohibition or restriction of entry into, any movement or other activity by vessel within the marine sensitive area;

(c)

the prohibition or restriction of the use of vessels of specified descriptions within the marine sensitive area;

(d)

the regulation of the speed at which any vessel may navigate within the marine sensitive area for the purpose of preventing any adverse effect on the objectives of that marine sensitive area;

(e)

the prohibition or restriction of the killing, taking, destruction or disturbance of flora and fauna of any description in the marine sensitive area;

(f)

the prohibition or restriction of any activity which would likely to cause damage to the sea-bed or protected feature within the marine sensitive area;

(g)

the prohibition or restriction of the exploitation of fisheries resources during specified periods and any method of exploiting fisheries resources; or

(h)

any other measures which the Government considers necessary and expedient.

(2)

The Government shall specify in the interim notice issued under regulation 4, the measures for the protection of the feature as determined by the Government to be complied with by the owner, master or agent of the vessel.

Any owner, master or agent of the vessel who contravenes subregulation (1)

or (2) commits an offence.

(4)

The Government, in exercising the powers under this regulation shall have due regard to the rights and duties of all States, including freedom of navigation by foreign vessels in the exclusive economic zone or on the continental shelf.

(5)

Notwithstanding subregulation (4), the exercise of freedom of navigation by foreign vessels in the exclusive economic zone or on the continental shelf shall not prejudice the sovereign rights in, and jurisdiction of Malaysia over the exclusive economic zone or on the continental shelf.

PART III

MEASURES FOR PROTECTION AND PRESERVATION OF MARINE ENVIRONMENT

Duty of owner, master and agent of vessel to take mitigation measures 6.

(1)

Where the authorized officer has reasonable grounds to believe that serious harm to the marine environment is occurring or is likely to occur in any area in the exclusive economic zone or on the continental shelf following upon any shipping activities, the authorized officer may, in writing or through radio communications, direct the owner, master or agent of the vessel to take any measures in accordance with safe shipping practices to prevent or mitigate the effect of such harm to the marine environment.

(2)

Any owner, master or agent of the vessel who fails to comply with the direction by the authorized officer under subregulation (1) commits an offence.

Cargo transfer 7.

(1)

No cargo transfer shall be allowed in the exclusive economic zone or on the continental shelf unless a permission in writing is obtained from the Government.

(2)

Subregulation (1) shall not apply to a cargo transfer—

(a)

to or from a warship or naval auxiliary vessel;

(b)

to or from any other vessel owned, operated or licensed to carry out activities authorized by the Government under the Act or any applicable written law;

(c)

to or from any other vessel owned or operated by the Government and used solely, for the time being, on government non-commercial service;

and

(d)

for the purpose of securing the safety of a vessel, saving life at sea or combating marine pollution.

(3)

Any person shall make an application to the Government to obtain a permission in writing for cargo transfer in the exclusive economic zone or on the continental shelf in not less than forty-eight hours before the planned cargo transfer.

(4)

The application under subregulation (3) shall be accompanied by the following documents—

(b)

an environmental statement which contains information on the potential environmental impact, either direct or indirectly, to the environment resulting from the proposed cargo transfer and pollution prevention measures to be undertaken; and

(i)

the name, flag, call sign, International Maritime Organization number and estimated time of arrival of the vessel which will be involved in the cargo transfer;

(ii)

the date, time and location of the planned cargo transfer operation;

the nature and manner the cargo transfer are to be carried out and whether cargo transfer is to be conducted at anchor or underway;

(iv)

the description of the cargo transfer including the types of substances to be transferred, quantity, frequency of transfers and duration of the cargo transfer;

(v)

the safety measures to be undertaken for cargo transfer; and

(vi)

any further information which the Government thinks is necessary for the consideration of the application for cargo transfer.

(5)

The Government may issue a permission for the cargo transfer if the Government is satisfied that—

(a)

the applicant has fulfilled the requirements in subregulation (3); and

(b)

the cargo transfer operation is consistent with the regulations and standards for cargo transfers under the International Maritime

Organization.

(6)

Notwithstanding the permission issued by the Government under subregulation (5), the owner, master or agent of vessel shall be obliged to provide the Government with any revised information relating the cargo transfer until the cargo transfer is completed.

(7)

The Government may impose such terms and conditions on the permission and the owner, master or agent of the vessel shall comply with such terms and conditions.

(8)

Any person who—

(a)

intentionally provide false information to the Government in relation to the application under subregulation (3);

(b)

intentionally make any false representation for the purpose of obtaining the permission from the Government under this regulation;

(c)

fails to ensure that the vessel-to-vessel operation plan is on board the vessel; or

Suggest a correction

(d)

fails to ensure that the cargo transfer is carried out in compliance with the vessel-to-vessel operation plan, commits an offence.

Prohibition of bunkering operation 8.

(1)

No bunkering operation shall be permitted in the exclusive economic zone or on the continental shelf.

(2)

Subregulation (1) shall not apply to a bunkering operation—

(b)

to or from a warship or naval auxiliary vessel;

to or from any other vessel owned, operated or licensed to carry out activities authorized by the Government under the Act or any applicable written law; and

(d)

to or from any other vessel owned or operated by the Government and used solely, for the time being, on government non-commercial service.

(3)

Notwithstanding subregulation (1), an owner, master and agent of the vessel shall not be guilty of an offence under subregulation (1) if the bunkering operation is necessary and a reasonable action is required to be taken by the owner, master and agent of the vessel for any of the following purposes:

for combating any specific pollution incidents.

(4)

Any owner, master or agent of the vessel who contravenes subregulation (1)

commits an offence.

Incident reporting 9.

(1)

Where a vessel is affected by fire, explosion, collision, grounding or any other emergency that causes or may cause threat to the marine environment in the exclusive economic zone or on the continental shelf, any owner, master or agent of the vessel shall, not later than six hours, report the incident to the Government through any official communication channels.

Any owner, master or agent of the vessel who contravenes subregulation (1)

commits an offence.

PART IV

ENFORCEMENT

Seksyen 10

Enforcement against vessel

(1)

Where an authorized officer has reasonable grounds to believe that a vessel navigating in the exclusive economic zone or on the continental shelf has committed a violation of any provision of these Regulations or any international standards under international treaties to which Malaysia is a State Party relating to the prevention, reduction and control of pollution from vessels, the authorized officer may require any owner, master or agent of the vessel to give information on the following:

(a)

the identity and port of registry of the vessel;

the last and next port of call of the vessel; and

(c)

any other relevant information which the authorized officers deems necessary.

(2)

Where an authorized officer has reasonable grounds to believe that a vessel navigating in the exclusive economic zone or on the continental shelf has committed a violation of any provision of these Regulations or any international standards under international treaties to which Malaysia is a State Party relating to the prevention, reduction and control of pollution from vessels, the authorized officer may make physical inspection of the vessel if—

(a)

the master of the vessel refuses to give information or the information under subregulation (1); or

the master of the vessel supplied the information which is manifestly at variance with the evident factual situation.

(3)

The authorized officer may detain any vessel navigating in the exclusive economic zone or on the continental shelf has committed a violation of any provision of these Regulations or any international standards under international treaties to which

Malaysia is a State Party relating to the prevention, reduction and control of pollution from vessels resulting in a discharge, which causes damage or threat of damage to the exclusive economic zone or the continental shelf.

OFFENCES

Seksyen 11

Offence of damaging marine sensitive area

kills or injures any protected feature in a marine sensitive area;

picks, collects, cuts, uproots, damages or destroys any protected feature of that marine sensitive area; or

(c)

takes anything from a marine sensitive area which is or forms part of, a protected feature of that marine sensitive area, commits an offence.

Any person who intentionally anchors a vessel in a marine sensitive area commits an offence.

Notwithstanding subregulation (1), a person shall not be guilty of an offence under subregulation (1) if the anchoring of the vessel in a marine sensitive area is necessary and a reasonable action is required to be taken by the person for the following purposes:

the anchoring of a vessel is due to damage of the vessel; and

Seksyen 13

Breaking or injuring submarine cables or pipelines

(1)

Any person who breaks or injures, or causes or permits a vessel to break or injure a submarine cable or pipeline in a marine sensitive area, any area in the exclusive economic zone or on the continental shelf, commits an offence.

(2)

Notwithstanding subregulation (1), a person shall not be guilty of an offence under subregulation (1) if the person who breaks or injures, or causes or permits a vessel to break or injure a submarine cable or pipeline acted with the legitimate objective of saving lives or his vessel.

PART VI

MISCELLANEOUS

Seksyen 14

Liability in respect of damage to submarine cables or pipelines

If any person, in the course of laying or repairing a submarine cable or pipeline of which he is the owner, causes any break in or injury to another submarine cable or pipeline, he shall be liable, in addition to any other liability to which he may be subject to bear the cost of repairing the break or injury, whether or not he has been guilty of any offence and whether or not the damage was caused through his negligence.

Bond or other financial security

If a vessel is detained pending completion of any proceedings in respect of any offence under these Regulations, the owner or master of a vessel may execute bonds or give other forms of financial security together with one or more sureties who are resident in Malaysia, conditioned in a sum not exceeding one million ringgit as security for the release of the vessel.

Cost of holding vessel, etc., in custody

(1)

Where any vessel is held in the custody of the Government pending completion of any proceedings in respect of any offence under these Regulations, the cost of holding the vessel in custody of the Government shall be treated as a civil debt due to the Government and shall be recoverable by civil action in Court.

Any owner, master or agent of vessel shall ensure that the vessel, while in custody of the Government, has sufficient number of personnel on board of the vessel to adequately respond to any situation which may affect the safety of the vessel, personnel or marine environment.

The Government shall not be responsible for any damage to the vessel held in the custody of the Government pending completion of any proceedings in respect of any offence under these Regulations.
