Opening note

Preamble

IN exercise of the powers conferred by subsection 118(1) of the Banking and Financial Institutions Act 1989 [Act 372], the Minister, on the recommendation of the Bank, makes the following order: Citation and commencement 1.

This order may be cited as the Banking and Financial Institutions

(Prokhas Sdn. Bhd.) (Exemption) Order 2012.

Order is deemed to have come into operation on 22 December 2011.

Exemption from subsection 74(1)

Seksyen 2

The Minister exempts Prokhas Sdn. Bhd. from the provision of subsection 74(1)

of the Act in so far as that subsection restricts the extension of the period of Prokhas

Sdn. Bhd.’s appointment to assume control of the whole of the property, business and affairs, and carry on the whole of business and affairs, of Abrar Discounts Berhad on behalf of the Bank under the Banking and Financial Institutions (Abrar Discounts

Berhad) (Assumption of Control) Order 2006 [P.U. (A) 432/2006] provided that the period of reappointment of Prokhas Sdn. Bhd. commenced on 22 December 2011 and expires on 31 December 2012.
