Seorang pekerja sepenuh masa yang diambil kerja sebagai pengawal keselamatan oleh suatu agensi persendirian yang dilesenkan di bawah seksyen 3 Akta
Agensi Persendirian 1971 [Akta 27] bagi maksud menyediakan perkhidmatan kawalan keselamatan di dalam kawasan yang dinyatakan dalam ruang (1) Jadual adalah berhak untuk mendapat saraan minimum berkanun yang dinyatakan dalam ruang (2) Jadual.
Walau apa pun subperenggan (1), agensi persendirian dan pekerja yang disebut dalam subperenggan itu boleh bersetuju dengan saraan yang lebih baik dalam kontrak perkhidmatan antara agensi persendirian dan pekerja itu.

Faedah lain
Sebagai tambahan kepada saraan minimum berkanun yang pekerja itu berhak untuk mendapat di bawah subperenggan 2(1), pekerja itu hendaklah dibayar apa-apa faedah lain yang diperuntukkan dalam kontrak perkhidmatan antara agensi persendirian dan pekerja itu yang ditakrifkan dalam Ordinan Buruh Sarawak [Sarawak Bab 76] dan
Ordinan Buruh Sabah [Sabah Bab 67], mengikut mana-mana yang berkenaan.
Penghitungan saraan minimum berkanun
Majikan hendaklah membayar saraan minimum berkanun berdasarkan penghitungan yang diperuntukkan dalam seksyen 15 Akta Majlis Penetapan Gaji 1947.

WAGES COUNCILS (WAGES REGULATION ORDER)
(STATUTORY MINIMUM REMUNERATION OF PRIVATE SECURITY GUARD IN SARAWAK
AND SABAH) ORDER 2011
WHEREAS by P.U. (B) 385/2007 and P.U. (B) 53/2008 published in the Gazette on 11 October 2007 and 4 February 2008 respectively, notice was given of the intention to make a wages regulation order under subsection 12(3) of the Wages Councils
Act 1947 [Act 195]:
AND WHEREAS written representations with respect to the wages regulation proposal have been received and considered:
NOW THEREFORE, in exercise of the powers conferred by subsection 12(3) of the Act, the Minister makes the following order:
Citation and commencement 1.
(1)
This order may be cited as the Wages Councils (Wages Regulation
Order) (Statutory Minimum Remuneration of Private Security Guard in Sarawak and Sabah) Order 2011.
(2)
This Order comes into operation on 1 August 2011.
Statutory minimum remuneration 2.
(1)
A full time worker employed as a security guard by a private agency licensed under section 3 of the Private Agencies Act 1971 [Act 27] for the purpose of providing security services in the area specified in column (1) of the Schedule shall be entitled to the statutory minimum remuneration specified in column (2) of the Schedule.
(2)
Notwithstanding subparagraph (1), the private agency and the worker referred to in that subparagraph may agree to a more favourable remuneration in the contract of service between such private agency and worker.

Other benefits 3.
In addition to the statutory minimum remuneration to which a worker is entitled under subparagraph 2(1), such worker shall be paid any other benefits as provided in the contract of service between the private agency and the worker as defined in the
Labour Ordinance of Sarawak [Sarawak Cap. 76] and Labour Ordinance of Sabah
[Sabah Cap. 67], as the case maybe.
Computation of statutory minimum remuneration 4.
The employer shall pay the statutory minimum remuneration based on the computation provided in section 15 Wages Council Act 1947.
