Preamble

PADA menjalankan kuasa yang diberikan oleh seksyen 23 Akta Pelindungan Pengguna 1999 [Akta 599], Menteri, atas syor Pengawal, membuat perintah yang berikut: Nama dan permulaan kuat kuasa

Seksyen 1

(1)

Perintah ini bolehlah dinamakan Perintah Pelindungan Pengguna

(Larangan Terhadap Barang yang Tidak Selamat) 2011.

(2)

Perintah ini hendaklah mula berkuat kuasa pada 26 Ogos 2011.

Pengisytiharan barang larangan

Seksyen 2

Barang yang dinyatakan dalam ruang (1) Jadual dan apa-apa barang yang mempunyai ciri-ciri yang sama seperti yang dinyatakan dalam ruang (2) Jadual adalah tidak selamat dan diisytiharkan sebagai barang larangan.

Seksyen 3

Panggil balik barang larangan

Pembekal hendaklah memanggil balik semua barang yang diisytiharkan sebagai barang larangan dari pasaran dalam tempoh 1 bulan dari tarikh kuat kuasa Perintah ini.

Seksyen 4

Pembekalan dan pengiklanan barang larangan

(a)

berhenti membekalkan, atau menawarkan untuk membekalkan, barang yang diisytiharkan sebagai barang larangan itu; dan

(b)

berhenti mengiklankan barang yang diisytiharkan sebagai barang larangan itu.

CONSUMER PROTECTION ACT 1999

CONSUMER PROTECTION (PROHIBITION AGAINST UNSAFE GOODS) ORDER 2011

IN exercise with the powers conferred by section 23 of the Consumer Protection Act 1999 [Act 599], the Minister, on the recommendation of the Controller, makes the following order:

Citation and commencement 1.

(1)

This order may be cited as the Consumer Protection (Prohibition

Against Unsafe Goods) Order 2011.

(2)

This Order shall come into operation on 26 August 2011.

Declaration of prohibited goods 2.

The goods specified in column (1) of the Schedule and any other goods which has the same characteristics as described in column (2) of the Schedule is unsafe and is declared to be prohibited goods.

Recall of prohibited goods 3.

The supplier shall recall all goods which are declared to be prohibited goods from the market within a period of 1 month from the date of commencement of this

Order.

Supply and advertisement of prohibited goods 4.

The supplier shall

(a)

stop the supply of, or the offer to supply, the goods which are declared to be prohibited goods; and

(b)

stop the advertisement of the goods which are declared to be prohibited goods.

Offence 5.

Any person who fails to comply with this Order commits an offence.
