BAHAWASANYA menurut Fasal (1) Perkara 112D Perlembagaan Persekutuan, pemberian khas yang dibuat kepada Negeri Sabah yang dinyatakan dalam perenggan (a) Fasal (1) Perkara 112C Perlembagaan Persekutuan hendaklah dikaji semula oleh Kerajaan Persekutuan dan Kerajaan Negeri Sabah; DAN BAHAWASANYA suatu kajian semula telah dilakukan oleh Kerajaan Persekutuan dan Kerajaan Negeri Sabah pada 12 September 2024; DAN BAHAWASANYA hasil kajian semula tersebut Kerajaan Persekutuan dan Kerajaan Negeri Sabah bersetuju bahawa selama tempoh lapan tahun mulai 2022 hingga 2029 di bawah Fasal (3) Perkara 112D Perlembagaan Persekutuan, Kerajaan Persekutuan hendaklah membuat pemberian khas kepada Kerajaan Negeri Sabah, berkenaan dengan setiap tahun kewangan tersebut; MAKA, OLEH YANG DEMIKIAN, pada menjalankan kuasa yang diberikan oleh Fasal (1) Perkara 112D Perlembagaan Persekutuan, Yang di-Pertuan Agong membuat perintah yang berikut: Nama

Perintah ini bolehlah dinamakan Perintah Perlembagaan Persekutuan

(Kajian Semula Pemberian Khas di bawah Perkara 112D) (Negeri Sabah) 2025.

Seksyen 2

Pemberian khas

(1)

Bagi tempoh lapan tahun berkuat kuasa mulai 1 Januari 2022,

Kerajaan Persekutuan hendaklah membuat kepada Negeri Sabah, berkenaan dengan tahun kewangan 2022, 2023, 2024, 2025, 2026, 2027, 2028 dan 2029, pemberian masing-masing berjumlah RM125.6 juta, RM300 juta, RM306 juta,

RM600 juta, RM600 juta, RM600 juta, RM600 juta dan RM600 juta.

Berkenaan dengan tahun kewangan 2022, pemberian berjumlah

RM125.6 juta telah dibayar oleh Kerajaan Persekutuan kepada Negeri Sabah pada 16 Jun 2022.

Berkenaan dengan tahun kewangan 2023, pemberian berjumlah

RM300 juta telah dibayar oleh Kerajaan Persekutuan kepada Negeri Sabah pada 16 Jun 2023 (RM129.7 juta) dan 28 November 2023 (RM170.3 juta).

Berkenaan dengan tahun kewangan 2024, pemberian berjumlah

RM306 juta telah dibayar oleh Kerajaan Persekutuan kepada Negeri Sabah pada 11 Jun 2024 (RM300 juta) dan 19 Ogos 2024 (RM6 juta).

FEDERAL CONSTITUTION (REVIEW OF SPECIAL GRANT UNDER ARTICLE 112D)

(STATE OF SABAH) ORDER 2025

Opening note

Preamble

WHEREAS by virtue of Clause (1) of Article 112D of the Federal Constitution, the special grants made to the State of Sabah as specified in paragraph (a) Clause (1) of Article 112C of the Federal Constitution shall be reviewed by the Governments of the Federation and the State of Sabah; AND WHEREAS a review was held by the Governments of the Federation and the State of Sabah on 12 September 2024; AND WHEREAS the said review has resulted in the Governments of the Federation and the State of Sabah agreeing that for the period of eight years from 2022 to 2029 made under Clause (3) of Article 112D of the Federal Constitution, the Government of the Federation shall make special grants to the Government of the State of Sabah, in respect of each financial year; NOW, THEREFORE, in exercise of the powers conferred by Clause (1) of Article 112D of the Federal Constitution, the Yang di-Pertuan Agong makes the following order: Citation 1. This order may be cited as the Federal Constitution (Review of Special Grant under Article 112D) (State of Sabah) Order 2025. Special grant 2.

(1)

For the period of eight years with effect from 1 January 2022, the Government of the Federation shall make to the State of Sabah, in respect of the financial years 2022, 2023, 2024, 2025, 2026, 2027, 2028 and 2029, grants in the amount of RM125.6 million, RM300 million, RM306 million, RM600 million,

RM600 million, RM600 million, RM600 million and RM600 million respectively.

(2)

In respect of the financial year 2022, the grant of RM125.6 million was paid by the Government of the Federation to the State of Sabah on 16 June 2022.

In respect of the financial year 2023, the grant of RM300 million was paid by the Government of the Federation to the State of Sabah on 16 June 2023

(RM129.7 million) and 28 November 2023 (RM170.3 million).

In respect of the financial year 2024, the grant of RM306 million was paid by the Government of the Federation to the State of Sabah on 11 June 2024

(RM300 million) and 19 August 2024 (RM6 million).

Revocation 3.

The Federal Constitution (Review of Special Grant under Article 112D)

(State of Sabah) Order 2023 [P.U. (A) 364/2023] is revoked.
