Preamble

PADA menjalankan kuasa yang diberikan oleh subseksyen 8(3) Akta Universiti dan Kolej Universiti 1971 [Akta 30], Yang di-Pertuan Agong membuat perintah yang berikut: Nama

Seksyen 1

Perintah ini bolehlah dinamakan Perintah Universiti dan Kolej Universiti

(Perlembagaan Universiti Sultan Zainal Abidin) (Pindaan) 2012.

Seksyen 2

Pindaan seksyen 4

dalam Perintah ini, dipinda dalam seksyen 4 dengan menggantikan subseksyen (3)

dengan subseksyen yang berikut:

“(3)

Bagi mengelakkan keraguan, kuasa di bawah subseksyen (1) boleh dijalankan oleh Lembaga, kecuali kuasa di bawah perenggan (1)(a), (b), (c), (d),

(e)

, (g), (k) dan (o) yang hendaklah dijalankan oleh Senat.”.

Pindaan seksyen 14

Seksyen 3

Seksyen 14 Perlembagaan dipinda—

(a)

dengan menggantikan subseksyen (4) dengan subseksyen yang berikut:

“(4)

Tertakluk kepada peruntukan Perlembagaan ini, syarat pelantikan Pendaftar, Bursar, Ketua Pustakawan dan Penasihat

Undang-Undang hendaklah ditentukan oleh Lembaga.”; dan

(b)

dengan memasukkan selepas subseksyen (4) subseksyen yang berikut:

“(5)

Seseorang yang dilantik sebagai Pendaftar, Bursar dan

Penasihat Undang-Undang hendaklah, melainkan jika dia meletakkan

jawatan atau mengosongkan jawatannya atau pelantikannya dibatalkan, memegang jawatan selama tempoh yang tidak melebihi tiga tahun dan apabila tempoh itu habis, Pendaftar, Bursar dan

Penasihat Undang-Undang itu adalah layak untuk dilantik semula.

Seseorang yang dilantik sebagai Ketua

Pustakawan hendaklah memegang jawatan selama tempoh yang ditetapkan oleh

Lembaga.

(7)

Pelantikan Pendaftar, Bursar, Ketua Pustakawan dan

Penasihat Undang-Undang boleh, pada bila-bila masa, dibatalkan oleh

Lembaga dengan menyatakan sebab bagi pembatalan itu.”.

Pindaan seksyen 16

Seksyen 4

Seksyen 16 Perlembagaan dipinda dengan menggantikan subseksyen (1) dengan subseksyen yang berikut:

“(1)

Pihak Berkuasa Universiti ialah Lembaga, Senat, Jawatankuasa

Pengurusan Universiti atau dengan apa-apa jua nama ia disebut, Fakulti,

Sekolah, Pusat, Akademi, Institut, Jawatankuasa Pengajian, Jawatankuasa

Pemilih, Jawatankuasa Kebajikan Pelajar, Jawatankuasa Aduan Pelajar dan badan yang lain sebagaimana yang ditetapkan oleh statut sebagai Pihak Berkuasa

Universiti.”.

Seksyen 5

Pindaan seksyen 22

Seksyen 22 Perlembagaan dipinda dengan menggantikan subseksyen (8) dengan subseksyen yang berikut:

“(8)

Senat hendaklah mempertimbangkan apa-apa perkara yang dihantar kepadanya oleh Lembaga di bawah subseksyen 20(2).”.

Pemotongan seksyen 27

Perlembagaan dipinda dengan memotong seksyen 27.

Seksyen 7

Seksyen baru 28A

Perlembagaan dipinda dengan memasukkan selepas seksyen 28 seksyen yang berikut:

“Jawatankuasa Aduan Pelajar

Seksyen 28A

(a)

Naib Canselor yang hendaklah menjadi pengerusi;

(b)

dua orang ahli yang dipilih oleh Majlis Perwakilan Pelajar-Pelajar;

(c)

dua orang ahli yang dipilih oleh Persatuan Siswazah atau

Alumni Universiti; dan

(d)

dua orang pegawai lain Universiti yang dilantik oleh

Lembaga selepas mengambil kira dengan sewajarnya kepentingan untuk menjamin suatu Jawatankuasa Aduan

Pelajar yang mendapat keyakinan pelajar.

(2)

Jawatankuasa Aduan Pelajar hendaklah mempunyai apa-apa kuasa dalam menjalankan siasatan atau inkuiri ke atas apa-apa aduan yang dibuat oleh pelajar mengikut cara yang ditetapkan oleh statut.”.

Pindaan Jadual 8.

Jadual kepada Perlembagaan dipinda dengan menggantikan perenggan 4 dengan perenggan yang berikut:

“4.

Jika mana-mana orang terhenti menjadi ahli Pihak Berkuasa oleh sebab peruntukan Perlembagaan ini, seorang lain boleh dilantik untuk mengisi kekosongan itu bagi tempoh selebihnya yang baginya ahli itu dilantik.”.

UNIVERSITIES AND UNIVERSITY COLLEGES (CONSTITUTION OF THE UNIVERSITI

SULTAN ZAINAL ABIDIN) (AMENDMENT) ORDER 2012

Opening note

Preamble

IN exercise of the powers conferred by subsection 8(3) of the Universities and University Colleges Act 1971 [Act 30], the Yang di-Pertuan Agong makes the following order: Citation 1. This order may be cited as the Universities and University Colleges (Constitution of the Universiti Sultan Zainal Abidin) (Amendment) Order 2012. Amendment of section 4 2. The Constitution of the Universiti Sultan Zainal Abidin, which is referred to as “the Constitution” in this Order, is amended in section 4 by substituting for subsection

(3)

the following subsection:

“(3)

For the avoidance of doubt, the powers under subsection (1) may be exercised by the Board, except the powers under paragraphs (1)(a), (b), (c), (d),

(e)

, (g), (k) and (o) which shall be exercised by the Senate.”.

Amendment of section 14 3.

Section 14 of the Constitution is amended—

(a)

by substituting for subsection (4) the following subsection:

“(4)

Subject to the provisions of this Constitution, the conditions of appointment of the Registrar, the Bursar, the Chief Librarian and the Legal Adviser shall be determined by the Board.”; and

(b)

by inserting after subsection (4) the following subsections:

“(5)

A person appointed as the Registrar, the Bursar and the

Legal Adviser shall, unless he resigns or vacates his office or his appointment is revoked, hold office for a period of not more than three years and upon expiry of such period, the Registrar, the Bursar and the Legal Adviser shall be eligible for reappointment.

(6)

A person appointed as the Chief Librarian shall hold office for a period as determined by the Board.

(7)

The appointment of the Registrar, the Bursar, the Chief

Librarian and the Legal Adviser may, at any time, be revoked by the

Board stating the reason for such revocation.”.

Amendment of section 16 4.

Section 16 of the Constitution is amended by substituting for subsection (1) the following subsection:

“(1)

The Authorities of the University shall be the Board, the Senate, the

Management Committee of the University or by whatever name it may be referred to, the Faculties, the Schools, the Centres, the Academies, the Institutes, the Studies Committee, the Selection Committees, the Student Welfare

Committee, the Students’ Complaints Committee and such other bodies as may be prescribed by statute as Authorities of the University.”.

Amendment of section 22 5.

Section 22 of the Constitution is amended by substituting for subsection (8) the following subsection:

“(8)

The Senate shall consider any matter transmitted to it by the Board under subsection 20(2).”.

Deletion of section 27 6.

The Constitution is amended by deleting section 27.

New section 28A

Seksyen 7

The Constitution is amended by inserting after section 28 the following section:

“Students’ Complaints Committee

Seksyen 28A

(1)

There is established a Students’ Complaints Committee which shall consist of—

(a)

the Vice-Chancellor who shall be the chairman;

(b)

two members elected by the Students’ Representative

Council;

(c)

two members elected by the Guild of Graduates or the

Alumni of the University; and

(d)

two other officers of the University appointed by the Board after due regards to the importance of securing a Students’

Complaints Committee which enjoys student confidence.

(2)

The Students’ Complaints Committee shall have such powers in conducting investigations or inquiries as to any complaint made by a student in the manner as may be prescribed by statute.”.

Amendment of Schedule 8.

The Schedule to the Constitution is amended by substituting for paragraph 4 the following paragraph:

“4.

Where any person ceases to be a member of an Authority by reason of the provisions of this Constitution, another person may be appointed to fill the vacancy for the remainder of the term for which the member was appointed.”.
