PREVENTION AND CONTROL OF INFECTIOUS DISEASES
(MEASURES WITHIN INFECTED LOCAL AREAS) (NO. 6) REGULATIONS 2020
IN exercise of the powers conferred by subsection 11(2)
of the
Prevention and Control of Infectious Diseases Act 1988 [Act 342], the Minister makes the following regulations:
Citation and commencement 1.
(1)
These regulations may be cited as the Prevention and Control of
Infectious
Diseases
(Measures within
Infected
Local
Areas)
(No.
6)
Regulations 2020.
(2)
These Regulations have effect for the period from 13 May 2020
to 9 June 2020.
Interpretation 2.
In these Regulations—
“prohibited activity” means the activity specified in the Schedule;
“infected local area” means any area declared to be an infected local area under the Prevention and Control of Infectious Diseases (Declaration of Infected Local Areas)
Order 2020 [P.U. (A) 87/2020].
Prohibited activity 3.
No person shall carry out, organize, undertake or otherwise be involved in, any prohibited activity.
Control of movement within infected local area 4.
(1)
Subject to subregulation
(2) , a person may move from one place to another place within any infected local area.

(2)
No person shall enter into or exit from a place that is subject to an enhanced movement control order except any person who is providing healthcare and medical services or is given permission by an authorized officer.
(3)
For the purposes of subregulation (2), “enhanced movement control order”
refers to a direction given by an authorized officer under subsection 11(3) of the Act.
Control of movement within the State of Sarawak 5.
(1)
Notwithstanding regulation 4, no person shall move from one district to another district within the State of Sarawak.
(2)
Where due to a special and particular reason a person needs to move from one district to another district within the State of Sarawak, that person shall obtain prior written permission of the police officer in charge of the police station nearest to his residence.
Control of movement between infected local areas 6.
(1)
No person shall move from one infected local area to another infected local area except to and from work.
(2)
Where spouses are residing in different infected local areas, one spouse may move, with prior written permission of the police officer in charge of the police station nearest to his or her residence, to the residence of his or her spouse in the other infected local area.
(3)
Where due to a special and particular reason a person needs to move from one infected local area to another infected local area, that person shall obtain prior written permission of the police officer in charge of the police station nearest to his residence.

Control of gathering and procession 7.
(1)
No person shall in any way participate or be involved in any gathering or procession, whether for economic, religious, educational and learning, sports, recreational, social or cultural purposes.
(2)
Notwithstanding subregulation (1), a person may gather or be involved in a gathering—
(a)
for Hari Raya Puasa, Pesta Kaamatan and Gawai Dayak Day subject to such directions of the Director General; or
(b)
for a funeral, on the condition that the attendance at such funeral shall not exceed twenty.
State of Selangor, Federal Territories of Kuala Lumpur and Putrajaya as one infected local area 8.
For the purposes of regulations 4 and 6 and subregulation 7(2), the State of Selangor and the Federal Territories of Kuala Lumpur and Putrajaya shall be reckoned as one infected local area.
Private vehicle 9.
Any person driving a private vehicle shall not carry more than three passengers and such passengers shall be persons staying in the same house as him.
Public transport 10.
(1)
A holder of any land, sea or air public transport licence or permit to carry passengers shall ensure that the public transport relating to his licence or permit does not carry more than half of the total maximum capacity of the number of passengers that may be carried on board the public transport for each journey.
(2)
Notwithstanding subregulation (1), a driver of a hire car, a taxi cab, an airport taxi cab, a limousine taxi cab or an e-hailing vehicle shall not carry more than two passengers for each journey.

(3)
Subregulation (1) shall not apply for the purposes of regulation 11.
Air public transport to the State of Sabah or Sarawak from Peninsular Malaysia and vice versa 11.
(1)
A holder of any air public transport licence or permit to carry passengers shall ensure that the air public transport does not carry more than sixty six point six per centum of the total maximum of load factor of the air public transport that may be carried on board the air public transport for each journey of a scheduled flight from the State of Sabah or Sarawak to Peninsular Malaysia.
(2)
A holder of any air public transport licence or permit to carry passengers may carry the total maximum capacity of the number of passengers that may be carried on board the air public transport for each journey of a scheduled flight from
Peninsular Malaysia to the State of Sabah or Sarawak.
(3)
A holder of any air public transport licence or permit to carry passengers may carry the total maximum capacity of the number of passengers that may be carried on board the air public transport for each journey of a non-scheduled flight from
Peninsular Malaysia to the State of Sabah or Sarawak, where all of the passengers are students in Peninsular Malaysia returning to the State of Sabah or Sarawak.
Requirement to undergo health examination upon arrival in Malaysia 12.
A citizen, a permanent resident of Malaysia or an expatriate returning from overseas shall undergo health examination upon arrival in Malaysia before proceeding for immigration clearance at any point of entry and shall comply with any direction of an authorized officer.
Request for information 13.
An authorized officer may request for any information relating to the prevention and control of infectious disease from any person or body of persons.

Direction of Director General 14.
The Director General may issue any direction in any manner, whether generally or specifically, to any person or group of persons to take such measures for the purpose of preventing and controlling any infectious disease including any direction to any person or group of persons carrying out, organizing, undertaking, or who is otherwise involved in, any other than a prohibited activity.
Offence 15.
(1)
Any person who contravenes any provision of these Regulations or any direction of the Director General or an authorized officer commits an offence and shall, on conviction, be liable to a fine not exceeding one thousand ringgit or to imprisonment for a term not exceeding six months or to both.
(2)
Where any person who commits an offence under these Regulations is a company, limited liability partnership, firm, society or other body of persons, a person who at the time of the commission of the offence was a director, compliance officer, partner, manager, secretary or other similar officer of the company, limited liability partnership, firm, society or other body of persons or was purporting to act in the capacity or was in any manner or to any extent responsible for the management of any of the affairs of the company, limited liability partnership, firm, society or other body of persons or was assisting in its management—
(a)
may be charged severally or jointly in the same proceedings with the company, limited liability partnership, firm, society or the body of persons; and
(b)
if the company, limited liability partnership, firm, society or other body of persons is found guilty of the offence, shall be deemed to be guilty of that offence and shall be liable to the same punishment or penalty as an individual unless, having regard to the nature of his functions in that capacity and to all circumstances, he proves—

(i)
that the offence was committed without his knowledge; and
(ii)
that the offence was committed without his consent or connivance and that he had taken all reasonable precautions and exercised due diligence to prevent the commission of the offence.
Sitting of Parliament or State Assembly 16.
Notwithstanding anything to the contrary in these
Regulations, a Member of Parliament or a Member of a State Assembly may attend a sitting of Parliament or State Assembly, respectively.
Transitional provision 17.
All directions of the Director General issued under the Prevention and Control of
Infectious Diseases (Measures within Infected Local Areas) (No. 5) Regulations 2020
[P. U. (A) 136/2020] shall be deemed to have been made under these Regulations and shall continue to remain in force unless revoked by the Director General.
