Section 153

Any person who wins minerals by fossicking, panning, exploration or mining without a licence or lease issued or granted under this Enactment shall be guilty of an offence and shall, on conviction, in addition to any other fine or term of imprisonment imposed under this Chapter, be ordered to pay to the State Government –

(a)

a sum not exceeding five times the royalty payable in respect of any mineral unlawfully taken; and

(b)

a sum not exceeding three times the value of such mineral, and any sum ordered to be paid shall be recoverable as a debt due to the State

Government.
