Section 26

Section 26

Any person who:

(a)

in contravention of the provisions of this Enactment engages in, carries out, or undertakes any access activity without having an access licence;

(b)

fails to provide or wilfully withholds any information required under the provisions of this Enactment;

(c)

removes any biological resources or traditional knowledge associated with biological resources out of the State without the prior written authorisation of the Director; and

(d)

publish or advertise any biological resources or traditional knowledge associated with biological resources without prior written authorisation of the

Director.

shall be guilty of an offence and shall, upon conviction, be liable to a fine not less than thirty thousand ringgit and not more than one hundred thousand ringgit or to imprisonment for a term not less than six months and not more than five years or to both.
