Section 12F

(a)

without the approval under subsection 12C(1);

(b)

who has failed to comply with any terms and conditions of the agreement of the environmental conditions or the mitigation declaration;

(c)

if it is found that the environmental impact assessment report or the proposal for mitigation measures has been approved as a result of a fraud, mistake or misrepresentation in any material particular; or

(d)

who has contravened any of the provisions of this Enactment.

(2)

The stop work order may be issued for the purpose of preventing the prescribed activities from continuing –

(a)

either absolutely or conditionally;

(b)

for such period as the Director may determine; or

(c)

until requirements to remedy as the Director may direct have been complied with.

(3)

Any person who contravenes this section shall, -

(a)

in relation to environmental impact assessment report, commits an offence and shall, on conviction, be liable to a fine not exceeding one

hundred thousand ringgit or to imprisonment for a term not exceeding five years or to both; and

(b)

in relation to proposal for mitigation measures, commits an offence and shall, on conviction, be liable to a fine not exceeding fifty thousand ringgit or to imprisonment for a term not exceeding two years or to both.
