Section 60

Section 60

(1)

It shall be the duty of the owner, or the person in charge or who manages or in control of the deleterious substance that is accidentally or inadvertently discharged or placed

in riverine waters, to immediately take all appropriate measures to safeguard and conserve fish and fish habitat and to prevent further occurrence or to counteract, mitigate or remedy any adverse effect that will result or may reasonably be expected to result therefrom.

(2)

Any person who contravenes subsection (1) shall be guilty of an offence and shall be liable on conviction –

(a)

if a corporate body to a fine not exceeding one hundred thousand ringgit;

and

(b)

if not a corporate body to a fine not exceeding fifty thousand ringgit, or to imprisonment for a term not exceeding two years or to both.
