PENANG PORT COMMISSION (PENANG PORT) (SCALE OF RATES)
(AMENDMENT) BY-LAWS 2025
IN exercise of the powers conferred by sections 32, 33, 34, 66 and 67
of the Penang Port Commission Act 1955 [Act 140], the Penang Port Commission, with the approval of the Minister, makes the following by-laws:
Citation and commencement 1.
(1)
These by-laws may be cited as the Penang Port Commission
(Penang Port) (Scale of Rates) (Amendment) By-Laws 2025.
(2)
These By-Laws come into operation on 29 October 2025.
Amendment of by-law 2 2.
The Penang Port Commission (Penang Port) (Scale of Rates) By-Laws 2021
[P.U. (A) 356/2021], which are referred to as the “principal By-laws” in these By-laws, are amended by substituting for by-law 2 the following by-law:
“Interpretation 2.
In these By-Laws, unless the context otherwise requires—
“dangerous goods” means dangerous goods whether in packaged form, containerized or carried in bulk, and includes the goods classified by the Commission into groups as specified in Schedule C to the Penang Port
Commission By-Laws 1957 [L.N. (N.S.) 93/1957] and in conformity with the IMDG Code and other relevant IMO publications as amended from time to time and as adopted by the Commission;
“package” includes any box, basket, barrel, case, receptacle, sack, bag, wrapper, envelope or other covering or thing in which any cargo is placed for the purpose of carriage, consignment, freight, importation or exportation;

“Commission’s wharf” means a berth, wharf, dock, pier or landing place operated or controlled by the Commission;
“day” in relation to a transaction, means the period of twenty-four hours from the time of the commencement of the transaction with the Commission;
“berth” means a dock, pier, jetty, quay, landing place or wharf, which is connected to the shore side;
“transhipment cargo” means the cargo which landed from a vessel and placed in the custody of the Commission for the purpose of shipment on another vessel through bill of lading dated at the port of loading of such cargo and showing that the destination is via the Port of Penang, and the ultimate port of destination which shall be a port other than the Port of Penang is marked on each package or unit containing such cargo and declared to the Commission prior to or at the time such cargo is placed in its custody;
“palletized cargo” means the cargo in small packages or units which have been wrapped, strapped, or wrapped and strapped together and placed on a pallet;
“unitized cargo” means the cargo in small packages or units which have been wrapped, strapped or wrapped and strapped together as a single unit;
“LCL” means Less Container Load as declared by the shipping line or its agent in the manifest, container discharge list, load list or export pre-advice, submitted to the Commission prior to the discharge or loading of a cargo onto a vessel;
“FCL” means Full Container Load as declared by the shipping line or its agent in the manifest, container discharge list, load list or export pre-advice, submitted to the Commission prior to the discharge or loading of a cargo onto a vessel;

“IMDG Code” means the International Maritime Dangerous Goods Code published by the IMO;
“CEA” means the Custom’s Examination Area within the Commission’s premises;
“marine craft” includes tugboat, pilot boat or any other craft, used or intended to be used within and outside the port for marine operations, services or activities;
“Manager” means any officer in charge of the respective port operations or any other officer acting under or with the authority of the officer in charge;
“LOA” means the length overall of a vessel measured from the extreme point forward of the vessel to the extreme point aft of the vessel;
“IMO” means the International Maritime Organization;
“Commission’s premises” includes any place owned or occupied by the Commission and appropriated by the Commission for the landing and shipping of any cargo, including any portion of the bank of the river so owned or occupied which has been improved to facilitate such landing and shipping and any foreshore so owned or occupied and used for such purpose;
“CFS” means the Container Freight Station within the Commission’s premises;
“free storage” means the specified period during which a cargo or container occupies a space assigned to it in the Commission’s premises free of storage charge;

“shift” means three recurring working periods in a day as follows:
(a) first shift: from 0730 hours to 1530 hours of the same day;
(b) second shift: from 1530 hours to 2330 hours of the same day;
and
(c) third shift: from 2330 hours to 0730 hours of the next day;
“tonne” means one metric tonne which is equivalent to one thousand kilograms or one cubic metre;
“cruise vessel terminal” means Swettenham Pier Cruise Terminal, including the inner berth, the outer berth and the floating berth;
“GT” means the gross registered tonnage of a vessel measured in accordance with the International Convention of Tonnage Measurement of Ships 1969;
“cruise vessel” means any vessel used for transportation of passenger for the purpose of travel, leisure or recreation, which may involve stops at multiple destinations or ports of call, and usually provides onboard amenities and services.”.
Amendment of by-law 3 3.
The principal By-laws are amended in by-law 3—
(a)
in subparagraph (i), by deleting the word “and” at the end of the subparagraph;
(b)
in subparagraph (j), by substituting for the full stop at the end of the subparagraph a semicolon; and

(c)
by inserting after subparagraph (j) the following subparagraphs:
“(k) marine craft rental charge;
(m) temporary anchorage charge;
(n) electric supply charge;
(q) tender landing area charge;
(t) wharf cleaning charge; and
(u) terminal equipment charge.”.
Amendment of by-law 4 4.
The principal By-laws are amended in by-law 4 by substituting for the words
“Port of Penang” wherever appearing the word “port”.
Amendment of by-law 5 5.
The principal By-laws are amended in paragraph 5(1) by substituting for the words “Port of Penang” the word “port”.
Amendment of by-law 6 6.
The principal By-laws are amended in the English text, in by-law 6—
(a)
in paragraph (3), by substituting for the word “GRT” the word “GT”; and
(b)
in paragraph (4), by substituting for the word “GRT” the word “GT”.
New by-laws 13A, 13B, 13C, 13D, 13E, 13F, 13G, 13H, 13I, 13J and 13K

The principal By-laws are amended by inserting after by-law 13 the following by-laws:

“Marine craft rental charge 13A. A port user shall pay the marine craft rental charge to the Commission at the rate specified in Part 11 of the First Schedule if any marine craft is deployed by the port, within and outside the port, for the purposes of—
(a)
rescue operations;
(b)
responding to emergency incidents;
(c)
performing fire fighting operations;
(d)
undertaking anti-pollution or spill control measures; or
(e)
carrying out training or simulation exercises relating to any of the purposes specified in subparagraphs (a) to (d).
Lay-up charge 13B. A port user shall pay the lay-up charge to the Commission if a vessel is anchored within the port upon request by the vessel’s agent at the rate specified in Part 12 of the First Schedule.
Temporary anchorage charge 13C. (1)
A port user shall pay the temporary anchorage charge to the
Commission if a vessel intended to berth or depart from the Commission’s wharf but instead anchored within the port after forty-eight hours of anchoring, upon arrival to and departure from that Commission’s wharf.
(2)
A port user shall pay the temporary anchorage charge to the
Commission immediately upon the arrival and departure, if a vessel—
(a)
does intend to berth at a wharf other than the Commission’s wharf;

(b)
does not intend to berth; or
(c)
does not request for a lay-up service.
(3)
A port user shall pay the temporary anchorage charge under paragraphs (1) and (2) at the rate specified in Part 13 of the First Schedule.
Electric supply charge 13D. (1)
A port user shall pay the electric supply charge to the Commission for the provision of electrical power to any vessel berthed at the Commission’s wharf at the rate specified in Part 14 of the First Schedule.
(2)
The electric supply charge under paragraph (1) shall include an electricity consumption calculated based on the tariffs and charges determined by the Energy Commission in accordance with subsection 26(1) of the Electricity Supply Act 1990 [Act 447].
Conservancy charge 13E. A port user, in relation to an international cruise vessel arriving at and departing from the cruise vessel terminal, shall pay the conservancy charge to the Commission at the rate as specified in Part 15 of the First Schedule.
Dockage charge 13F.
A port user, in relation to any cruise vessel arriving at and departing from the cruise vessel terminal, shall pay the dockage charge to the Commission at the rate as specified in Part 16 of the First Schedule.
Tender landing area charge 13G. A port user, in relation to any cruise vessel, who requests the use of a designated area allocated by the Commission for tender landing at the cruise vessel terminal shall pay the tender landing area charge to the Commission for the use of the designated area at the rate as specified in Part 17 of the
First Schedule.

Gangway charge 13H. A port user shall pay the gangway charge to the Commission for the use of a gangway provided by the Commission for the embarking or disembarking of passengers or crews at the rate as specified in Part 18 of the First Schedule.
Water supply charge 13I. A port user shall pay the water supply charge to the Commission for the supply of water to the port user’s vessel while berthed at the Commission’s wharf at the rate as specified in Part 19 of the First Schedule.
Wharf cleaning charge 13J. A port user shall pay the wharf cleaning charge to the Commission for the cleaning services provided by the Commission at the Commission’s wharf at the rate as specified in Part 20 of the First Schedule.
Terminal equipment charge 13K. A port user shall pay the terminal equipment charge to the Commission for the use of forklifts or cranes provided by the Commission to handle goods, supplies, equipment, baggage or similar items at the rates specified in
Part 21 of the First Schedule.”.
Amendment of by-law 14 8.
The principal By-laws are amended in by-law 14—
(a)
in subparagraph (i), by deleting the word “and” at the end of the subparagraph;
(b)
in subparagraph (j), by substituting for the full stop at the end of the subparagraph a semicolon; and
(c)
by inserting after subparagraph (j) the following subparagraphs:

The principal By-laws are amended in paragraph 16(1) by substituting for the words “port limit of the Port of Penang” the word “port”.
Amendment of by-law 18 11.
The principal By-laws are amended by substituting for by-law 18
the following by-law:
“Storage charge
18.
A port user shall pay the storage charge to the Commission for storing—
(a)
an import cargo in the warehouse or open yard at the rate as specified in Part 6 of the Second Schedule;
(b)
an export cargo in the warehouse or open yard at the rate as specified in Part 7 of the Second Schedule;

a cargo in the bonded warehouse at the rate as specified in Part 8 of the Second Schedule and such cargo shall not be given any free storage period; and
(d)
a motor vehicle at the rate as specified in Part 6 and Part 7 of the Second Schedule.”.

A port user shall pay the higher and over height container handling charge to the Commission for containers exceeding height at the rate specified in Part 19 of the Second Schedule.
Crane hire charge 24B.
A port user shall pay the crane hire charge to the Commission if any crane is hired for the purpose of container handling operations within the
Commission’s premises at the rate as specified in Part 20 of the Second Schedule.
Container stuffing or unstuffing charge 24c.

A port user shall pay the container stuffing or unstuffing charge to the Commission at the rate specified in Part 21 of the Second Schedule if a release request is made—
(a)
outside the port’s normal operating hours; or
(b)
not in accordance with the CFS schedule.
(2)
The port user shall deliver a container intended for loading to the Commission, together with all relevant documents, at least thirty-six hours prior to the scheduled berthing time of the loading vessel.
(3)
Failure of the port user to comply with the requirement under paragraph (1), the port user shall pay an additional late submission charge to the Commission at the rate specified in Part 21 of the Second Schedule.

Container detention charge 24D.
A port user shall pay the container detention charge to the
Commission if a container is directed to be detained, opened or inspected at the CEA by the Royal Malaysian Customs Department or any other relevant authority at the rate as specified in Part 22 of the Second Schedule.
Container cargo examination charge 24E.
A port user shall pay the container cargo examination charge to the Commission where the stuffing or unstuffing of a cargo from a container for the purpose of examination is carried out at the CEA pursuant to a direction issued by the Royal Malaysian Customs Department or any other relevant authority at the rate as specified in Part 23 of the Second Schedule.
Weighing charge 24F.
A port user shall pay the weighing charge to the Commission at the rate as specified in Part 24 of the Second Schedule if the weighing facilities provided at the Commission’s premises are used to measure the weight of any vehicle, container or cargo for any of the following purposes:
(a)
safety verification;
(b)
compliance with road transport laws and regulations;
(c)
customs declaration; or
(d)
port operational requirements.
Container reweighing charge 24G.
A port user shall pay the container reweighing charge to the Commission at the rate as specified in Part 25 of the Second Schedule for each request to reweigh a container to determine its actual weight, including the net cargo weight and gross overall weight, where such activity

is carried out pursuant to—
(a)
a request by the port user;
(b)
a direction from any relevant authority;
(c)
an order issued by the Commission for the purposes of safety verification, regulatory compliance or port operations; or
(d)
the requirement under the International Convention For
Safety Of Life At Sea (SOLAS) for the verified gross mass purposes.
Store rent for transhipment cargo charge 24H.
A port user shall pay the store rent for transhipment cargo charge to the Commission for cargo stored within the Commission’s premises or warehouse and subsequently transferred to another vessel at the rate as specified in Part 26 of the Second Schedule.
Store rent for shut out cargo charge 24I.
A port user shall pay the store rent for shut out cargo charge to the Commission from the date of a cargo is shut out, in respect of any export or transhipment cargo that has been placed in the Commission’s premises or warehouse but is either rejected for loading or fails to be loaded onto a scheduled vessel for shipment at the rate as specified in Part 27
of the Second Schedule.
Additional equipment usage charge 24J.
A port user shall pay the additional equipment usage charge to the Commission for the use of any additional equipment provided by the Commission at the rate as specified in Part 28 of the Second Schedule.

Crane usage charge 24K.
A port user shall pay the crane usage charge to the Commission for the use of any port’s crane, ship’s crane or specialized equipment at the rate as specified in Part 29 of the Second Schedule.
Vehicle booking system charge 24L.
(1)
A port user shall pay the vehicle booking system charge to the Commission for the use of vehicle booking system for the purposes of delivery and collection of containers at the rate specified in Part 30
of the Second Schedule.
(2)
Any cancellation of a booking in the vehicle booking system shall be made at least thirty minutes prior to the scheduled start time of the booked slot.
(3)
If a booking has been made through the vehicle booking system and the vehicle fails to arrive by the end of the booking slot, the port user shall pay a charge for failure to comply with the booking to the
Commission at the rate specified in Part 30 of the Second Schedule.
(4)
The charge specified in Part 30 of the Second Schedule shall be waived in the event the turnaround time is not adhered to.
(5)
For the purpose of paragraph (4), the turnaround time in respect of a single movement does not exceed forty-five minutes, and for a double movement, does not exceed ninety minutes.”.
Amendment of by-law 31 19.
The principal By-laws are amended in subparagraph 31(1)(a) by substituting for the words “Port of Penang” the word “port”.

Fire officer service charge 37.
A port user shall pay the fire officer service charge for the provision of deployment of fire officer to the Commission for fire and emergency responses within the port and the Commission’s premise at the rate specified in Part 4 of the Third Schedule.
Security personnel service charge 38.
A port user shall pay for the security personnel service charge to the Commission to ensure regulatory compliance and security control at the Commission’s premises, including monitoring compliance with the International Ship and Port Facility Security Code and responding to non-routine activities, at the rate specified in Part 5 of the Third Schedule.
