Preamble

PADA menjalankan kuasa yang diberikan oleh subseksyen 134(3) Akta Undang-Undang Keluarga Islam (Wilayah-Wilayah Persekutuan) 1984 [Akta 303], Yang di-Pertuan Agong, atas nasihat Majlis, membuat kaedah-kaedah yang berikut:

PERMULAAN

Nama dan permulaan kuat kuasa

Seksyen 1

(1)

Kaedah-kaedah ini bolehlah dinamakan Kaedah-Kaedah Undang-Undang

Keluarga Islam (Wilayah-Wilayah Persekutuan) (Perkahwinan, Perceraian dan

Ruju’) 2024.

(2)

Kaedah-Kaedah ini mula berkuat kuasa pada 1 Jun 2024.

Bahagian II

BAHAGIAN II

Permohonan kebenaran berkahwin

Seksyen 2

(1)

Permohonan kebenaran berkahwin di bawah subseksyen 16(1) Akta hendaklah dibuat dalam Borang 1A Jadual Kedua oleh pemohon lelaki atau Borang 1B

Jadual

Jadual Kedua oleh pemohon perempuan dan disertakan dengan bayaran fi yang ditetapkan dalam Jadual Pertama.

(2)

Tiap-tiap permohonan hendaklah disertakan dengan dokumen yang berikut:

(a)

suatu salinan kad pengenalan pemohon dan bakal suami atau bakal isteri, mengikut mana-mana yang berkenaan, atau jika tiada

kad pengenalan, apa-apa dokumen pengenalan diri pemohon, bakal suami atau bakal isteri sebagaimana yang ditentukan oleh Pendaftar;

(b)

dalam hal pemohon yang belum pernah berkahwin, suatu sijil kursus praperkahwinan Islam yang dikeluarkan di bawah kaedah 16 atau apa-apa bentuk perakuan berkenaan dengan kehadiran pemohon dalam kursus praperkahwinan

Islam melainkan jika dia mendapat pengecualian daripada menghadiri kursus praperkahwinan Islam daripada Ketua Pendaftar;

(c)

suatu surat pengesahan pemastautinan jika alamat yang dinyatakan dalam kad pengenalan itu bukan alamat di Wilayah Persekutuan;

(d)

dalam hal pemohon ialah seorang balu atau duda—

(i)

suatu Perakuan Kematian pasangannya yang dikeluarkan di bawah Akta Pendaftaran Kelahiran dan Kematian 1957

[Akta 299]; atau

(ii)

jika tiada

Perakuan

Kematian yang disebut dalam subperenggan (i)—

(A)

suatu cabutan maklumat yang diperakukan daripada rekod kematian rasmi yang terkandung dalam daftar di bawah seksyen 33 Akta Pendaftaran Kelahiran dan

Kematian 1957 yang menunjukkan nama dan tarikh kematian pasangan itu; atau

(B)

apa-apa dokumen lain yang berkaitan yang membuktikan kematian pasangan itu yang dikeluarkan oleh pihak berkuasa yang berkaitan bagi negara di mana pasangan itu mati;

(e)

dalam hal perempuan yang suaminya hilang atau dipercayai telah mati—

(i)

suatu perakuan menganggap kematian suami itu yang dikeluarkan di bawah seksyen 53 Akta atau di bawah undang-undang keluarga

Islam mana-mana Negeri; atau

(ii)

apa-apa dokumen lain yang berkaitan yang menunjukkan suaminya telah dianggap mati yang dikeluarkan oleh pihak berkuasa yang berkaitan bagi negara di mana suaminya dipercayai hilang;

(f)

dalam hal pemohon yang asalnya bukan beragama Islam—

(i)

suatu

Perakuan

Masuk

Islam yang dikeluarkan oleh

Pendaftar Muallaf di bawah seksyen 90 Akta Pentadbiran

Undang-Undang Islam (Wilayah-Wilayah Persekutuan) 1993

[Akta 505] atau pihak berkuasa agama di bawah undang-undang pentadbiran Islam mana-mana Negeri; atau

(ii)

jika tiada

Perakuan

Masuk

Islam yang disebut dalam subperenggan (i), apa-apa dokumen lain yang berkaitan yang membuktikan pemohon itu telah masuk Islam.

(3)

Permohonan yang disebut dalam perenggan (2)(d) dan (e) hendaklah disertakan dengan—

(a)

suatu surat perakuan nikah dengan pasangan yang telah mati atau hilang itu yang telah dikeluarkan di bawah subseksyen 26(1) Akta atau di bawah undang-undang keluarga Islam mana-mana Negeri; atau

(b)

jika tiada surat perakuan nikah, apa-apa dokumen lain yang berkaitan yang membuktikan perkahwinannya dengan pasangan itu.

(4)

Sebagai tambahan kepada dokumen yang disebut dalam subkaedah (2), permohonan itu hendaklah juga disertakan dengan—

(a)

jika pemohon ialah seorang anggota polis atau tentera, suatu surat kebenaran daripada Polis Diraja Malaysia atau

Angkatan Tentera Malaysia;

(b)

dalam hal seorang pemohon perempuan—

(i)

suatu salinan kad pengenalan walinya, atau jika tiada kad pengenalan, apa-apa dokumen pengenalan diri sebagaimana yang ditentukan oleh Pendaftar; dan

(ii)

suatu salinan surat perakuan nikah atau surat perakuan cerai ibu bapa pemohon yang masing-masing dikeluarkan di bawah subseksyen 26(1) dan 54(4) Akta atau di bawah undang-undang keluarga Islam mana-mana Negeri, atau jika tiada surat perakuan nikah atau surat perakuan cerai, apa-apa dokumen lain yang membuktikan sehingga memuaskan hati Pendaftar tentang kewujudan pernikahan atau perceraian ibu bapa pemohon itu.

Dalam hal keadaan jika permohonan yang menghendaki kebenaran untuk berkahwin daripada Hakim Syarie terlebih dahulu di bawah seksyen 18 dan 23 Akta, permohonan itu hendaklah disertakan dengan perintah kebenaran untuk berkahwin yang masing-masing dikeluarkan di bawah subseksyen 18(2) dan 23(4) Akta.

Apa-apa dokumen yang dikehendaki untuk dikemukakan di bawah kaedah ini hendaklah diperaku oleh pihak berkuasa berkenaan.

(7)

Walau apa pun kaedah ini, Pendaftar boleh, atas alasan yang munasabah, mengecualikan pengemukaan apa-apa dokumen oleh pemohon.

Permohonan kebenaran berkahwin bagi bukan warganegara Malaysia 3.

(1)

Sebagai tambahan kepada dokumen yang disebut dalam kaedah 2, bagi pemohon yang bukan warganegara

Malaysia, permohonan hendaklah disertakan dengan—

(a)

suatu surat pengesahan pas bagi tujuan perkahwinan yang dikeluarkan oleh Jabatan Imigresen Malaysia;

(b)

suatu surat kebenaran berkahwin daripada Kedutaan negara pemohon dan diperaku oleh Kementerian Luar Negeri;

(c)

dalam hal pemohon yang berniat untuk berpoligami, suatu salinan surat perakuan nikah, surat perakuan cerai atau surat perakuan persekedudukan semula atau ruju’, mengikut mana-mana yang berkenaan, yang diperaku oleh Kedutaan, Suruhanjaya Tinggi atau

Pejabat Konsul di Malaysia; dan

(d)

apa-apa maklumat atau dokumen lain sebagaimana yang ditentukan oleh Pendaftar.

(2)

Kaedah ini hendaklah juga terpakai bagi penduduk tetap.

Kebenaran berkahwin 4.

Tertakluk pada peruntukan Bahagian ini dan bayaran fi yang ditetapkan dalam

Jadual

Jadual Pertama, Pendaftar hendaklah mengeluarkan kebenaran berkahwin di bawah seksyen 17 Akta dalam Borang 3 Jadual Kedua.

Permohonan kepada Hakim Syarie 5.

Permohonan kepada Hakim Syarie berhubung dengan kes yang disebut di bawah subseksyen 18(1) Akta hendaklah dibuat melalui suatu permohonan dan disokong oleh suatu afidavit mengikut seksyen 13 Akta Tatacara Mal Mahkamah Syariah

(Wilayah-Wilayah Persekutuan) 1998 [Akta 585].

Permohonan kebenaran untuk berkahwin di bawah umur 6.

(1)

Tertakluk pada kaedah 5, permohonan kepada Hakim Syarie untuk kebenaran untuk berkahwin di bawah umur di bawah perenggan 18(1)(a) Akta hendaklah dibuat oleh ibu atau bapa atau penjaga pemohon bagi pihak pemohon dan disertakan dengan—

(a)

suatu afidavit ibu atau bapa atau penjaga pemohon itu, mengikut mana-mana yang berkenaan; dan

(b)

suatu afidavit bakal suami atau bakal isteri, atau jika bakal suami atau bakal isteri itu juga merupakan seseorang bawah umur, suatu afidavit ibu atau bapa atau penjaga bakal suami atau bakal isteri yang di bawah umur itu.

(2)

Afidavit ibu atau bapa atau penjaga pemohon yang disebut dalam perenggan 1(a) hendaklah mengandungi—

(a)

nama, umur dan status perkahwinan pemohon; dan

(b)

alasan-alasan bagi perkahwinan yang dicadangkan itu.

(3)

Dalam hal pemohon lelaki, sebagai tambahan kepada maklumat yang dinyatakan dalam subkaedah (2), afidavit ibu atau bapa atau penjaga pemohon itu hendaklah turut menyatakan tentang kemampuan pemohon untuk menanggung nafkah bakal isterinya semasa perkahwinan.

(4)

Afidavit bakal suami atau bakal isteri, atau afidavit ibu atau bapa atau penjaga bakal suami atau bakal isteri, mengikut mana-mana yang berkenaan, yang disebut dalam perenggan 1(b) hendaklah mengandungi—

(a)

nama, umur dan status perkahwinan bakal suami atau bakal isteri, mengikut mana-mana yang berkenaan; dan

(b)

alasan-alasan bagi perkahwinan yang dicadangkan itu.

(5)

Dalam hal pemohon perempuan, sebagai tambahan kepada maklumat yang dinyatakan dalam subkaedah (4), afidavit bakal suami atau ibu atau bapa atau penjaga kepada bakal suami itu hendaklah turut menyatakan tentang kemampuan bakal suami untuk menanggung nafkah pemohon semasa perkahwinan.

Keterangan lanjut 7.

(1)

Sebelum mendengar permohonan untuk kebenaran berkahwin, Hakim Syarie boleh menghendaki—

(a)

pemohon dan bakal isteri atau bakal suaminya, mengikut mana-mana yang berkenaan—

(i)

untuk menjalani pemeriksaan kesihatan di mana-mana hospital, pusat kesihatan atau institusi kesihatan yang lain; atau

(ii)

untuk menghadiri suatu sesi interaktif kekeluargaan sebagaimana yang difikirkan sesuai oleh Hakim Syarie itu;

(b)

mana-mana pegawai perubatan untuk menyediakan dan mengemukakan kepada Hakim Syarie itu suatu laporan perubatan bagi pemeriksaan kesihatan yang disebut dalam subperenggan (1)(a)(i);

(c)

mana-mana Pegawai Kebajikan Masyarakat untuk menyediakan dan mengemukakan kepada Hakim Syarie itu suatu laporan sosial pemohon termasuk apa-apa perintah daripada Mahkamah bagi kanak-kanak yang dibuat di bawah subseksyen 91(1) Akta Kanak-Kanak 2001 [Akta 611], jika ada; atau

(d)

mana-mana pegawai polis untuk menyediakan dan mengemukakan kepada Hakim Syarie itu suatu laporan tentang rekod jenayah bakal suami atau bakal isteri jika bakal suami atau bakal isteri itu melebihi umur lapan belas tahun, jika ada.

(2)

Bagi maksud perenggan (1)(c), “Pegawai Kebajikan Masyarakat” mempunyai erti yang diberikan kepadanya dalam Akta Kanak-Kanak 2001.

Pendengaran permohonan 8.

(1)

Hakim Syarie boleh, setelah menerima apa-apa laporan yang dikehendakinya di bawah kaedah 7, mengarahkan—

(a)

pemohon dan bakal isteri atau bakal suaminya, mengikut mana-mana yang berkenaan; dan

(b)

ibu atau bapa atau penjaga pemohon, supaya hadir di hadapannya bagi pendengaran tentang kesediaan pihak-pihak kepada perkahwinan yang dicadangkan itu termasuk persetujuan pemohon terhadap perkahwinan itu.

(2)

Hakim Syarie boleh, pada bila-bila masa sebelum membuat keputusan, memanggil mana-mana orang lain untuk memberi keterangan sebagaimana yang difikirkan olehnya patut.

(3)

Dalam menentukan sama ada kebenaran berkahwin itu boleh diberikan,

Hakim Syarie itu hendaklah mengambil kira perkara yang berikut:

(a)

kebajikan dan kepentingan terbaik pemohon dan bakal suami atau bakal isteri, mengikut mana-mana yang berkenaan;

(b)

kewajaran perkahwinan yang dicadangkan itu; dan

(c)

sama ada perkahwinan yang dicadangkan itu boleh menyebabkan kemudaratan kepada pihak-pihak dalam perkahwinan.

(4)

Hakim Syarie boleh, semasa memberikan kebenaran berkahwin itu—

(a)

memerintahkan pemohon lelaki atau bakal suami untuk membayar nafkah dalam tempoh perkahwinan kepada bakal isteri atau pemohon perempuan masing-masing; atau

(b)

membuat apa-apa perintah lain yang difikirkan olehnya wajar untuk menjaga kepentingan terbaik pemohon di bawah umur bagi perkahwinan yang dicadangkan itu.

(5)

Perintah bagi kebenaran untuk berkahwin itu hendaklah dibuat dalam

Borang 2 Jadual Kedua.

BAHAGIAN III

PENGURUSAN PERKAHWINAN, PERCERAIAN DAN RUJU’

Upacara akad nikah 9.

Upacara akad nikah hendaklah dijalankan mengikut tatacara yang ditentukan oleh

Jabatan Agama Islam Wilayah Persekutuan.

Surat perakuan nikah dan surat perakuan ta’liq

10. Tertakluk pada bayaran fi yang ditetapkan dalam Jadual Pertama, Pendaftar hendaklah mengeluarkan surat perakuan nikah dan surat perakuan ta’liq di bawah seksyen 26 Akta dalam Borang 4 Jadual Kedua.

Kad perakuan nikah

11. (1) Mana-mana orang yang perkahwinannya telah didaftarkan di bawah Akta boleh memohon kepada Pendaftar untuk suatu kad perakuan nikah dalam Borang 5

Jadual

Jadual Kedua dan permohonan itu hendaklah disertakan dengan bayaran fi yang ditetapkan dalam Jadual Pertama serta suatu salinan surat perakuan nikahnya.

(2)

Apabila menerima permohonan yang disebut dalam subkaedah (1),

Pendaftar hendaklah menyebabkan suatu kad perakuan nikah yang mengandungi butir-butir mengenai perkahwinan itu dikeluarkan kepada orang itu.

Pendaftaran perkahwinan luar negeri dan pendaftaran sukarela

12. (1)

Permohonan bagi pendaftaran perkahwinan luar negeri dan pendaftaran sukarela masing-masing di bawah seksyen 31 dan 33 Akta hendaklah dibuat dalam

Borang 6 Jadual Kedua.

(2)

Surat perakuan nikah atau apa-apa keterangan lain yang disebut dalam perenggan 31(2)(a) Akta hendaklah—

(a)

diperakui oleh Kedutaan, Suruhanjaya Tinggi atau Pejabat Konsulat

Malaysia di negara berkenaan, kedutaan negara berkenaan di Malaysia dan Kementerian Luar Negeri; dan

(b)

disertakan dengan terjemahan dalam bahasa kebangsaan atau bahasa Inggeris.

(3)

Setiap salinan diperakui bagi catatan dalam Daftar Perkahwinan bagi pendaftaran perkahwinan luar negeri yang disebut dalam subseksyen 31(4) Akta atau pendaftaran sukarela yang disebut dalam subseksyen 33(5) Akta hendaklah masing-masing dikeluarkan dalam Borang 7 atau 8 Jadual Kedua.

Pendaftaran perceraian dan pembatalan

13. (1)

Mana-mana pihak kepada perkahwinan boleh memohon secara bertulis kepada Ketua Pendaftar bagi pendaftaran surat perakuan cerai atau surat perakuan pembatalan.

(2)

Permohonan di bawah subkaedah (1) hendaklah disertakan dengan—

(a)

bayaran fi yang ditetapkan dalam Jadual Pertama;

(b)

suatu salinan kad pengenalan pemohon atau, jika tiada kad pengenalan, apa-apa dokumen pengenalan dirinya sebagaimana yang ditentukan oleh Ketua Pendaftar;

(c)

suatu perintah perceraian atau pembatalan yang dikeluarkan oleh Mahkamah;

(d)

suatu surat perakuan nikah atau surat persekedudukan semula atau ruju’ pemohon, mengikut mana-mana yang berkenaan; dan

(e)

apa-apa maklumat atau dokumen lain sebagaimana yang ditentukan oleh Ketua Pendaftar.

(3)

Apabila permohonan yang disebut di bawah subkaedah (1) diluluskan,

Ketua Pendaftar hendaklah mengeluarkan surat perakuan cerai atau surat perakuan pembatalan masing-masing dalam Borang 9 atau 10 Jadual Kedua.

Pendaftaran persekedudukan semula atau ruju’

14. (1) Mana-mana pihak kepada perkahwinan boleh memohon secara bertulis kepada Pendaftar untuk mendaftarkan persekedudukan semula atau ruju’.

(2)

Permohonan di bawah subkaedah (1) hendaklah disertakan dengan—

(a)

bayaran fi yang ditetapkan dalam Jadual Pertama;

(b)

suatu salinan kad pengenalan pemohon, atau jika tiada kad pengenalan, apa-apa dokumen pengenalan diri sebagaimana yang ditentukan oleh Pendaftar;

(c)

suatu perintah perceraian atau perintah pengesahan persekedudukan semula atau ruju’, jika berkenaan, yang dikeluarkan oleh Mahkamah atau surat perakuan cerai; dan

(d)

apa-apa maklumat atau dokumen lain sebagaimana yang ditentukan oleh Pendaftar.

(3)

Apabila permohonan yang disebut di bawah subkaedah (1) diluluskan,

Ketua Pendaftar atau Pendaftar hendaklah mendaftarkan persekedudukan semula atau ruju’ itu di bawah subseksyen 51(6) Akta dan mengeluarkan surat perakuan persekedudukan semula atau ruju’ dalam Borang 11 Jadual Kedua.

Daftar

15. Pendaftar hendaklah menyimpan dan menyenggara daftar yang berikut:

(a)

Daftar Perkahwinan dalam Borang 12 Jadual Kedua;

(b)

Daftar Perkahwinan Luar Negeri dalam Borang 13 Jadual Kedua;

(c)

Daftar Perceraian dan Pembatalan dalam Borang 14 Jadual Kedua; dan

(d)

Daftar Persekedudukan Semula atau Ruju’ dalam Borang 15 Jadual Kedua.

BAHAGIAN IV

PELBAGAI

Kursus praperkahwinan Islam

16. Mana-mana orang yang berniat untuk berkahwin hendaklah menghadiri dan memperoleh sijil kursus praperkahwinan Islam yang diiktiraf oleh Jabatan Agama Islam

Wilayah Persekutuan melainkan jika orang itu dikecualikan oleh Ketua Pendaftar.

Pemeriksaan daftar

17. Ketua Pendaftar atau Pendaftar boleh menghendaki mana-mana orang yang berhasrat untuk memeriksa Daftar Perkahwinan untuk mengemukakan suatu salinan kad pengenalan atau, jika tiada kad pengenalan, apa-apa dokumen pengenalan diri sebagaimana yang ditentukan oleh Ketua Pendaftar atau Pendaftar.

Pembatalan

18. Kaedah-Kaedah Undang-Undang Keluarga Islam (Borang dan Fi) 1987

[P.U. (A) 142/1987] dibatalkan.

Kecualian

19. Semua permohonan atau perkara lain yang dibuat di bawah Kaedah-Kaedah

Undang-Undang Keluarga Islam (Borang dan Fi) 1987, yang disebut sebagai

“Kaedah-Kaedah yang dibatalkan” di bawah kaedah ini, yang belum selesai sebaik sebelum tarikh permulaan kuat kuasa Kaedah-Kaedah ini hendaklah, pada tarikh permulaan kuat kuasa Kaedah-Kaedah ini, diuruskan di bawah Kaedah-Kaedah yang dibatalkan seolah-olah Kaedah-Kaedah ini tidak dibuat.

IN exercise of the powers conferred by subsection 134(3) of the Islamic Family Law

(Federal Territories) Act 1984 [Act 303], the Yang di-Pertuan Agong, on the advice of the

Majlis, makes the following rules:

PART I

COMMENCEMENT

Citation and commencement 1.

(1)

These rules may be cited as the Islamic Family Law (Federal Territories)

(Marriage, Divorce and Ruju’) Rules 2024.

(2)

These Rules come into operation on 1 June 2024.

PART II

Application for permission to marry 2.

(1)

The application for the permission to marry under subsection 16(1) of the Act shall be made by a male applicant in Form 1A of the Second Schedule or by a female applicant in Form 1B of the Second Schedule and be accompanied by a payment of the prescribed fee in the First Schedule.

(2)

Every such application shall be accompanied by the following documents:

(a)

a copy of identity card of the applicant and the man or woman to be wedded, as the case may be, or where there is no identity card, any identity identification of the applicant, the man or the woman to be wedded as determined by the Registrar;

(b)

in the case of the applicant who has not been married, a certificate of

Islamic pre-marriage course issued under rule 16 or any certification in respect of the attendance of the applicant in Islamic pre-marriage course unless he has obtained an exemption from attending the

Islamic pre-marriage course from the Chief Registrar;

(c)

a confirmation letter of residence if the address stated in the identity card is not the address in the Federal Territories;

(d)

in the case of the applicant is a widow or widower—

(i)

a Certificate of Death of the spouse issued under the Births and

Deaths Registration Act 1957 [Act 299]; or

(ii)

where there is no Certificate of Death referred to in subparagraph (i)—

(A)

a certified extract of information from an official record of death contained in the register under section 33 of the

Births and Deaths Registration Act 1957 showing the name and date of the death of the spouse; or

(B)

any other relevant documents proving the death of the spouse issued by the relevant authority of the country where the spouse died.

(e)

in the case of a woman whose husband has gone missing or is believed to have died—

(i)

a certificate of presumption of death of the husband issued under section 53 of the Act or under the Islamic family law of any State; or

(ii)

any other relavant documents showing her husband has been presumed to be dead issued by the relevant authority of the country where his husband is believed to have gone missing;

(f)

in the case of the applicant who is not originally a Muslim—

(i)

a Certificate of Conversion issued by the Registrar of Muallafs under section 90 of the Administration of Islamic Law

(Federal Territories) Act 1993 [Act 505] or religious authority under the administration of Islamic law of any State; or

(ii)

where there is no Certificate of Conversion referred to in subparagraph (i), any other relevant documents proving that the applicant has converted to Islam.

(3)

The application referred to in paragraphs (2)(d) and (e) shall be accompanied by—

(a)

a marriage certificate with the spouse who has died or or has gone missing issued under subsection 26(1) of the Act or under Islamic family law of any State; or

(b)

where there is no marriage certificate, any other relevant documents proving his marriage with the spouse.

(4)

In addition to the documents referred to in subrule (2), the application shall also be accompanied by—

(a)

where the applicant is a police or army, a permission letter from the

Royal Malaysia Police or Malaysian Armed Forces of Malaysia;

(b)

in the case of a female applicant—

(i)

a copy of identity card of her wali, or where there is no identity card, any identification document as determined by the Registrar; and

(ii)

a copy of marriage certificate or certificate of divorce of the applicant’s parent issued under subsections 26(1) and 54(4) of the

Act, respectively, or under the Islamic family law of any State, or where there is no marriage certificate or certificate of divorce, any other documents proving to the satisfaction of the Registar the subsistence of the marriage or divorce of the applicant’s parent.

(5)

In the case where the application requires prior permission to marry by the Syariah Judge under sections 18 and 23 of the Act, the application shall be accompanied by an order of permission to marry issued under subsections 18(2)

and 23(4) of the Act respectively.

(6)

Any document required to be submitted under this rule shall be certified by the relevant authority.

(7)

Notwithstanding this rule, the Registrar may, on a reasonable ground, exempt the submission of any document by the applicant.

Application for permission to marry by non-Malaysian citizen 3.

(1)

In addition to the documents referred to in rule 2, for an applicant who is not a Malaysian citizen, the application shall be accompanied by—

(a)

a pass confirmation letter for the purpose of marriage issued by the

Immigration Department of Malaysia;

(b)

a letter of permission to marry from the Embassy of applicant’s country and certified by the Ministry of Foreign Affairs;

(c)

in the case of the applicant who intends to practice polygamy, a copy of marriage certificate, a certificate of divorce or a certificate of recohabitation or ruju’, as the case may be, certified by the Embassy,

High Commissioner or Consulate in Malaysia; and

(d)

such other information or documents as determined by the Registrar.

(2)

This rule shall also apply to a permanent resident.

Permission to marry 4.

Subject to the provisions of this Part and the payment of the prescribed fee in the

First Schedule, the Registrar shall issue a permission to marry under section 17 of the Act in Form 3 of the Second Schedule.

Application to Syariah Judge 5.

The application to the Syariah Judge in relation to cases referred to in subsection 18(1) of the Act shall be made by an application and supported by an affidavit in accordance with section 13 of the Syariah Court Civil Procedure

(Federal Territories) Act 1998 [Act 585].

Application for permission to marry below the age 6.

(1)

Subject to rule 5, the application to the Syariah Judge for the permission to marry below the age under paragraph 18(1)(a) of the Act shall be made by the mother or father or guardian of the applicant on behalf of the applicant and be accompanied by—

(a)

an affidavit of the mother or father or guardian of the applicant, as the case may be; and

(b)

an affidavit of the man or woman to be wedded, or where the man or woman to be wedded is below the age, an affidavit of the mother or father or guardian of the man or woman to be wedded who is below the age.

(2)

The affidavit of the mother or father or guardian of the applicant referred to in paragraph 1(a) shall contain—

(a)

the name, age and marital status of the applicant; and

(b)

the grounds for the proposed marriage.

(3)

In the case of a male applicant, in addition to the information specified in subrule (2), the affidavit of the mother or father or guardian of the applicant shall also state on the capability of the applicant to maintain the woman to be wedded during the subsistence of the marriage.

(4)

The affidavit of the man or woman to be wedded, or the affidavit of the mother or father or guardian of the man or woman to be wedded, as the case may be, referred to in paragraph 1(b) shall contain—

(a)

the name, age and marital status of the man or woman to be wedded, as the case may be; and

(b)

the grounds for the proposed marriage.

(5)

In the case of a female applicant, in addition to the information specified in subrule (4), the affidavit of the man to be wedded or the mother or father or guardian of the man to be wedded shall also state on the capability of the man to be wedded to maintain the applicant during the subsistence of marriage.

Further evidence 7.

(1)

Before hearing the application for the permission to marry, the Syariah Judge may require—

(a)

the applicant and the woman or the man to be wedded, as the case may be—

(i)

to undergo health examination in any hospital, health centre or other health institution; or

(ii)

to attend a family interactive session as the Syariah Judge thinks fit;

(b)

any medical officer to prepare and submit to the Syariah Judge a medical report of the health examination referred to in subparagraph (1)(a)(i);

(c)

any Social Welfare Officer to prepare and submit to the Syariah Judge a social report of the applicant including any order from the Court for children made under subsection 91(1) of the Child Act 2001 [Act 611], if any; or

(d)

any police officer to prepare and submit to the Syariah Judge a report on criminal record of the man or the woman to be wedded if the man or the woman to be wedded over the age of eighteen, if any.

(2)

For the purposes of paragraph (1)(c), “Social Welfare Officer” has the meaning as assigned to it in the Child Act 2001.

Hearing of application 8.

(1)

The Syariah Judge may, upon receiving any report he requires under rule 7, direct—

(a)

the applicant and the woman or the man to be wedded, as the case may be; and

(b)

the mother or father or guardian of the applicant, to appear before him for hearing on the readiness of the parties to the proposed marriage including the consent of the applicant towards the marriage.

(2)

The Syariah Judge may, at any time before making a decision, summon any other person to give evidence as he thinks fit.

(3)

In determining whether the permission to marry may be given, the

Syariah Judge shall take into consideration the following matters:

(a)

the welfare and the best interest of the applicant and the man or woman to be wedded, as the case may be;

(b)

the soundness of the proposed marriage; and

(c)

whether the proposed marriage may cause harm to the parties of the marriage.

(4)

The Syariah Judge may, upon giving the permission to marry—

(a)

order the male applicant or the man to be wedded to pay the maintenance during the subsistence of the marriage to the woman to be wedded or the female applicant respectively; or

(b)

make any other order as he thinks proper to protect the best interest of the applicant below the age of the proposed marriage.

(5)

The order for the permission to marry shall be made in Form 2 of the

Second Schedule.

PART III

MANAGEMENT OF MARRIAGE, DIVORCE AND RUJU’

Solemnization ceremony 9.

The solemnization ceremony shall be conducted in accordance with the procedures as determined by the Federal Territories Islamic Religious Department.

Marriage certificate and ta’liq certificate

10. Subject to the payment of the prescribed fee in the First Schedule, the Registrar shall issue a marriage certificate and ta’liq certificate under section 26 of the Act in

Form 4 of the Second Schedule.

Marriage certificate card

11. (1) Any person whose marriage has been registered under the Act may apply to the Registrar for a marriage certificate card in Form 5 of the Second Schedule and such application shall be accompanied by the payment of the prescribed fee in the

First Schedule and a copy of his marriage certificate.

(2)

Upon receiving an application referred to in subrule (1), the Registrar shall cause a marriage certificate card containing details of the marriage to be issued to that person.

Registration of foreign marriage and voluntary registration

12. (1)

The application for the registration of foreign marriage and the voluntary registration under sections 31 and 33 of the Act respectively shall be made in Form 6

of the Second Schedule.

(2)

The marriage certificate or any other evidence referred to in paragraph 31(2)(a) of the Act shall—

(a)

be certified by the Embassy, High Commissioner or Malaysia’s Consulate of the related country, the related embassy of such country in Malaysia and the Ministry of Foreign Affairs; and

(b)

be accompanied by a translation in national language or

English language.

(3)

Each certified copy of the entry in the Marriage Register for the registration of foreign marriage referred to in subsection 31(4) of the Act or the voluntary registration referred to in subsection 33(5) of the Act shall be issued in Form 7 or 8 of the

Second Schedule respectively.

Registration of divorce and annulment

13. (1)

Any party to a marriage may apply in writting to the Chief Registrar for the registration of a certificate of divorce or certificate of annulment.

(2)

The application under subrule (1) shall be accompanied by—

(a)

the payment of the prescribed fee in the First Schedule;

(b)

a copy of identity card of the applicant or, where there is no identity card, any identification document as determined by the Chief Registrar;

(c)

an order of divorce or annulment issued by the Court;

(d)

a marriage certificate or certificate of recohibitation or ruju’ of the applicant, as the case may be; and

(e)

any other information or documents as determined by the

Chief Registrar.

(3)

Upon the approval of the application referred to in subrule (1), the

Chief Registrar shall issue a certificate of divorce or certificate of annulment in Form 9 or 10 of the Second Schedule respectively.

Registration of recohabitation or ruju’

14. (1) Any party to a marriage may apply in writing to the Registrar to register a recohabitation or ruju’.

(2)

The application under subrule (1) shall be accompanied by—

(a)

the payment of the prescribed fee in the First Schedule;

(b)

a copy of identity card of the applicant, or where there is no identity card, any identification document as determined by the Registrar;

(c)

an order of divorce or order of verification of recohabitation or ruju’, if applicable, issued by the Court or a certificate of divorce; and

(d)

any other information or documents as determined by the Registrar.

(3)

Upon the approval of the application referred to in subrule (1), the

Chief Registrar or Registrar shall register the recohabitation or ruju’ under subsection 51(6) of the Act and issue a certificate of recohabitation or ruju’ in Form 11

of the Second Schedule.

15. The Registrar shall keep and maintain the following registers:

(a)

the Marriage Register in Form 12 of the Second Schedule;

(b)

the Foreign Marriage Register in Form 13 of the Second Schedule;

(c)

the Register of Divorces and Annulments in Form 14 of the Second Schedule;

and

(d)

the Register of Recohabitation or Ruju’ in Form 15 of the Second Schedule.

PART IV

MISCELLANEOUS

Islamic pre-marriage course

16. Any person who intends to marry shall attend and acquire a certificate of Islamic pre-marriage course recognized by the Federal Territories Islamic Religious Department unless the person is exempted by the Chief Registrar.

Inspection of register

17. The Chief Registrar or Registrar may require any person who intends to inspect the

Marriage Register to submit a copy of identity card or, where there is no identity card, any identification document as determined by the Chief Registrar or Registrar.

Revocation 18.

The Islamic Family Law (Forms and Fees) Rules 1987 [P.U. (A) 142/1987]

is revoked.

Saving

19. All applications or other matters made under the Islamic Family Law (Forms and

Fees) Rules 1987, which are referred to as “the revoked Rules” in this rule, which are pending immediately before the date of coming into operation of these Rules shall, on the date of coming into operation of these Rules, be dealt with under the revoked Rules as if these Rules have not been made.
