Menteri mengecualikan daripada kuat kuasa Akta mana-mana pekerja domestik yang diinsuranskan oleh majikannya di bawah suatu polisi insurans berhubung dengan bencana kerja atau keilatan, yang masih sah tempoh polisi insurans itu, sebaik sebelum tarikh permulaan kuat kuasa Pemberitahuan ini.
Pengecualian di bawah subperenggan (1) hendaklah terpakai bagi pekerja domestik itu sehingga habis tempoh polisi insurans itu.
Walau apa pun subperenggan (2), jika polisi insurans yang disebut dalam subperenggan (1) habis tempoh selepas 31 Mei 2022, pengecualian di bawah subperenggan (1) hendaklah terpakai bagi pekerja domestik itu sehingga 31 Mei 2022.
Bagi maksud perenggan ini, “pekerja domestik” ertinya seseorang yang diambil kerja semata-mata dalam kerja atau yang berkaitan dengan kerja bagi suatu rumah kediaman persendirian dan bukan bagi apa-apa perdagangan, perniagaan atau profesion yang dijalankan oleh majikan dalam rumah kediaman itu dan termasuklah seorang tukang masak, pekhidmat rumah (termasuk pekhidmat bilik tidur dan dapur), pelayan, butler, orang yang menjaga kanak-kanak atau bayi, valet, kundang,

tukang kebun, lelaki pencuci kain atau perempuan pencuci kain, jaga, sais dan pemandu atau pencuci apa-apa kenderaan berlesen untuk kegunaan persendirian.

EMPLOYEES’ SOCIAL SECURITY (EXEMPTION) (NO. 2) NOTIFICATION 2021
Opening note
This notification may be cited as the Employees’ Social Security
(Exemption) (No. 2) Notification 2021.
The Minister exempts from the operation of the Act any domestic employee who is insured by his employer under an insurance policy in relation to employment injury or invalidity, which such insurance policy period is still valid, immediately before the date of coming into operation of this Notification.
The exemption under subparagraph (1) shall apply to such domestic employee until the expiry of such insurance policy.
Notwithstanding subparagraph (2), where the insurance policy referred to in subparagraph (1) expires after 31 May 2022, the exemption under subparagraph (1)
shall apply to such domestic employee until 31 May 2022.
For the purposes of this paragraph, “domestic employee” means a person employed exclusively in the work or in connection with work of a private dwelling house and not of any trade, business or profession carried on by the employer in such dwelling house and includes a cook, house servant (including bedroom and kitchen servants), waiter, butler, child’s or baby’s nurse, valet, footman, gardener, washerman or washerwoman, watchman, groom and driver or cleaner of any vehicle licensed for private use.
