“Peraturan-Peraturan ibu” dalam Peraturan-Peraturan ini, dipinda—
dengan memasukkan selepas perkataan “Permohonan” perkataan
“di bawah subperaturan (1)”; dan
dengan memotong perkataan “, dan satu salinan kepada Ketua
Eksekutif Lembaga Akreditasi Negara,”;
dalam subperaturan (3), dengan menggantikan perkataan “Permohonan bagi setiap kursus pengajian” dengan perkataan “Permohonan di bawah subperaturan (1) bagi setiap kursus pengajian”; dan

dengan menggantikan subperaturan (4) dengan subperaturan yang berikut:
“(4)
Permohonan di bawah subperaturan
hendaklah disertakan dengan—
perakuan akreditasi sementara yang dikeluarkan oleh
Agensi Kelayakan Malaysia di bawah Bahagian VII Akta
Agensi Kelayakan Malaysia 2007 [Akta 679] dan apa-apa syarat yang dikenakan oleh Agensi Kelayakan Malaysia yang berhubungan dengan perakuan akreditasi sementara itu;
dan
apa-apa dokumen lain yang ditentukan oleh
Ketua Pendaftar.”.
Pindaan peraturan 4
Peraturan 4 Peraturan-Peraturan ibu dipinda—
dalam perenggan (a), dengan menggantikan perkataan “diajar” dengan perkataan “dijalankan”;
dalam perenggan (b), dengan menggantikan perkataan “pengajaran dan pembelajaran” dengan perkataan “penjalanan”; dan
dalam perenggan (d), dengan menggantikan perkataan “Menteri” dengan perkataan “Ketua Pendaftar”.
Pindaan peraturan 5
Peraturan 5 Peraturan-Peraturan ibu dipinda—
dengan menggantikan subperaturan (1) dengan subperaturan yang berikut:

“(1) Jika Ketua Pendaftar berpuas hati dengan permohonan untuk mengendalikan kursus pengajian atau kursus pengajian tambahan di bawah peraturan 3, Ketua Pendaftar bolehlah meluluskan permohonan itu.”;
dengan memasukkan selepas subperaturan (1) subperaturan yang berikut:
“(1A)
Apabila permohonan diluluskan di bawah subperaturan (1), pemohon itu hendaklah membayar fi kelulusan kepada Ketua Pendaftar sebagaimana yang dinyatakan dalam Jadual Kedua.”; dan
dengan menggantikan perenggan (a) dengan perenggan yang berikut:
“(a) lima tahun jika tempoh kursus pengajian atau kursus pengajian tambahan itu tiga tahun atau ke bawah; dan”; dan
dengan menggantikan perenggan (b) dengan perenggan yang berikut:
“(b) tujuh tahun jika tempoh kursus pengajian atau kursus pengajian tambahan itu melebihi tiga tahun.”.
Pindaan peraturan 6
Peraturan-Peraturan ibu dipinda dengan menggantikan peraturan 6 dengan peraturan yang berikut:
“Pembaharuan kelulusan.
Permohonan bagi pembaharuan kelulusan untuk mengendalikan kursus pengajian atau kursus pengajian tambahan hendaklah dibuat dalam Borang ‘C’ dalam Jadual Pertama.
Permohonan di bawah subperaturan (1) hendaklah dikemukakan kepada Ketua Pendaftar tidak lewat daripada enam bulan sebelum habis tempoh kelulusan untuk mengendalikan

kursus pengajian atau kursus pengajian tambahan itu.
Permohonan di bawah subperaturan (1) bagi setiap kursus pengajian atau kursus pengajian tambahan hendaklah dibuat dalam borang permohonan yang berasingan.
Permohonan di bawah subperaturan (1) hendaklah disertakan dengan—
perakuan akreditasi yang dikeluarkan oleh Agensi Kelayakan Malaysia di bawah
Bahagian
VIII
Akta
Agensi
Kelayakan
Malaysia 2007
dan apa-apa syarat yang dikenakan oleh Agensi Kelayakan Malaysia atau badan profesional yang berkenaan yang berhubungan dengan perakuan akreditasi itu;
dan
Jika Ketua Pendaftar berpuas hati dengan permohonan di bawah subperaturan (1), Ketua Pendaftar bolehlah meluluskan permohonan itu.
Apabila permohonan diluluskan di bawah subperaturan (5), pemohon itu hendaklah membayar fi kelulusan kepada Ketua Pendaftar sebagaimana yang dinyatakan dalam
Jadual Kedua.”.

Peraturan baharu 6A
6.
Peraturan-Peraturan ibu dipinda dengan memasukkan selepas peraturan 6
peraturan yang berikut:
“Permohonan bagi pindaan atau pengubahan syarat.
6A. (1)
Permohonan bagi pindaan atau pengubahan mana-mana syarat yang dikenakan oleh Ketua Pendaftar di bawah subseksyen 40(1) atau 40A(4) Akta hendaklah dibuat dalam Borang ‘D’ dalam Jadual Pertama.
(2)
Permohonan di bawah subperaturan (1) hendaklah dikemukakan kepada Ketua Pendaftar.
(3)
Permohonan di bawah subperaturan (1) bagi setiap kursus pengajian atau kursus pengajian tambahan hendaklah dibuat dalam borang permohonan yang berasingan.
(4)
Permohonan di bawah subperaturan (1) hendaklah disertakan dengan—
(a)
apa-apa syarat yang dikenakan oleh Agensi
Kelayakan Malaysia atau badan profesional yang berkenaan di bawah Bahagian VIII
Akta Agensi Kelayakan Malaysia 2007; dan
(b)
apa-apa dokumen lain yang ditentukan oleh
Ketua Pendaftar.

Jika Ketua Pendaftar berpuas hati dengan permohonan di bawah subperaturan (1), Ketua Pendaftar bolehlah meluluskan permohonan itu.”.

Peraturan 7 Peraturan-Peraturan ibu dipinda dengan menggantikan perkataan
“keputusan Menteri” dengan perkataan “keputusannya”.

Peraturan-Peraturan ibu dipinda dengan menggantikan peraturan 8 dengan peraturan yang berikut:
“Pindaan perakuan pendaftaran.

(1)
Institusi pengajian tinggi swasta hendaklah mengemukakan kepada Ketua Pendaftar perakuan pendaftaran yang dikeluarkan di bawah subseksyen 24(9) Akta dalam tempoh enam bulan selepas Ketua Pendaftar—
(a)
meluluskan permohonan untuk mengendalikan kursus pengajian tambahan di bawah subperaturan 5(1);
(b)
meluluskan permohonan bagi pembaharuan kelulusan untuk mengendalikan kursus pengajian atau kursus pengajian tambahan di bawah subperaturan 6(5);
(c)
meluluskan permohonan bagi pindaan atau pengubahan syarat yang dikenakan oleh Ketua
Pendaftar di bawah subperaturan 6A(5);
(d)
membuat di bawah subseksyen 40(1F) Akta apa-apa pindaan, pembatalan atau pengubahan, atau penambahan kepada, mana-mana syarat yang disebut dalam subseksyen 40(1) Akta; atau
(e)
mengenakan di bawah subseksyen 40A(4) Akta syarat-syarat baharu atau membuat apa-apa

pindaan, pembatalan atau pengubahan, atau penambahan kepada, mana-mana syarat yang disebut dalam subseksyen 40(1) Akta.”.

PRIVATE HIGHER EDUCATIONAL INSTITUTIONS (CONDUCTING COURSES OF STUDY)
(AMENDMENT) REGULATIONS 2017
IN exercise of the powers conferred by section 88
of the
Private Higher Educational Institutions Act 1996 [Act 555], the Minister makes the following regulations:
Citation and commencement 1.
(1)
These regulations may be cited as the Private Higher Educational
Institutions (Conducting Courses of Study) (Amendment) Regulations 2017.
(2)
These Regulations come into operation on 28 November 2017.
Amendment of regulation 3 2.
Regulation 3 of the Private Higher Educational Institutions (Conducting Courses of Study) Regulations 1997 [P.U. (A) 546/1997], which are referred to as the
“principal Regulations” in these Regulations, is amended—
(a)
in subregulation (2)—
(i)
by inserting after the word “application” the words “under subregulation (1)”; and
(ii)
by deleting the words “, and one copy to the Chief Executive of
Lembaga Akreditasi Negara,”;
(b)
in subregulation (3), by substituting for the words “The application for each of study” the words “The application under subregulation (1) for each course of study”; and

(c)
by substituting for subregulation (4) the following subregulation:
“(4) The application under subregulation (1) shall be accompanied by—
(a)
a certificate of provisional accreditation issued by the
Malaysian Qualifications Agency under Part VII of the
Malaysian Qualifications Agency Act 2007 [Act 679] and any conditions imposed by the Malaysian Qualifications Agency relating to the certificate of provisional accreditation; and
any other documents as determined by the Registrar General.”.
Amendment of regulation 4 3.
Regulation 4 of the principal Regulations is amended—
(a)
in paragraph (a), by substituting for the word “taught” the word
“conducted”;
(b)
in paragraph (b), by substituting for the words “teaching and learning” the word “conducting”; and
(c)
in paragraph (d), by substituting for the word “Minister” the words
“Registrar General”.
Amendment of regulation 5 4.
Regulation 5 of the principal Regulations is amended—
(a)
by substituting for subregulation (1) the following subregulation:
“(1) Where the Registrar General is satisfied with the application for conducting courses of study or additional courses of study under regulation 3, the Registrar General may approve the application.”;

(b)
by inserting after subregulation (1) the following subregulation:
“(1A) Upon approval of the application under subregulation (1), the applicant shall pay the approval fee to the Registrar General as specified in the Second Schedule.”; and
(c)
in subregulation (2)—
(i)
by substituting for paragraph (a) the following paragraph:
“(a)
five years where the duration of the courses of study or additional courses of study is three years or below; and”;
and
(ii)
by substituting for paragraph (b) the following paragraph:
“(b)
seven years where the duration of the courses of study or additional courses of study is more than three years.”.
Amendment of regulation 6 5.
The principal Regulations are amended by substituting for regulation 6 the following regulation:
“Renewal of approval.
6.
(1)
An application for renewal of the approval to conduct a course of study or an additional course of study shall be made in
Form ‘C’ in the First Schedule.
(2)
The application under subregulation (1) shall be submitted to the Registrar General not later than six months prior to the expiry of the approval to conduct the course of study or additional course of study.

(3)
The application under subregulation (1) for each course of study or additional course of study shall be made in a separate application form.
(4)
The application under subregulation (1) shall be accompanied by—
(a)
a certificate of accreditation issued by the Malaysian
Qualifications Agency under Part VIII of the
Malaysian Qualifications Agency Act 2007 and any conditions imposed by the Malaysian Qualifications
Agency or the relevant professional body relating to the certificate of accreditation; and
(b)
any other documents as determined by the
Registrar General.
(5)
Where the Registrar General is satisfied with the application under subregulation (1), the Registrar General may approve the application.
(6)
Upon approval of the application under subregulation (5), the applicant shall pay the approval fee to the Registrar General as specified in the Second Schedule.”.
New regulation 6A
6.
The principal Regulations are amended by inserting after regulation 6 the following regulation:

“Application for variation or alteration of conditions.
6A. (1)
An application for variation or alteration any of the conditions imposed by the Registrar General under subsection 40(1) or 40A(4) of the Act shall be made in Form ‘D’ in the First Schedule.
(2)
The application under subregulation (1) shall be submitted to the Registrar General.
(3)
The application under subregulation (1) for each course of study or additional course of study shall be made in a separate application form.
(4)
The application under subregulation (1) shall be accompanied by—
(a)
any conditions imposed by the
Malaysian
Qualifications Agency or the relevant professional body under
Part
VIII of the
Malaysian
Qualifications Agency Act 2007; and
(b)
any other documents as determined by the
Registrar General.
Where the Registrar General is satisfied with the application under subregulation (1), the Registrar General may approve the application.”.
Amendment of regulation 7 7.
Regulation 7 of the principal Regulations is amended by substituting for the words “the decision of the Minister” the words “his decision”.

Amendment of regulation 8 8.
The principal Regulations are amended by substituting for regulation 8 the following regulation:
“Amendment of certificate of registration.
8.
(1)
A private higher educational institution shall submit to the Registrar General the certificate of registration issued under subsection 24(9) of the Act within six months after the
Registrar General—
(a)
approves an application for conducting an additional course of study under subregulation 5(1);
(b)
approves an application for renewal of the approval to conduct a course of study or an additional course of study under subregulation 6(5);
(c)
approves an application for variation or alteration of the conditions imposed by the Registrar General under subregulation 6A(5);
(d)
makes under subsection 40(1F) of the Act any variation, cancellation or alteration of, or addition to, any of the conditions referred to in subsection 40(1) of the Act; or
(e)
imposes under subsection 40A(4) of the Act new conditions or makes any variation, cancellation or alteration of, or addition to, any of the conditions referred to in subsection 40(1) of the Act.”.

9.
Regulation 8A of the principal Regulations is amended by substituting for the word “Minister” the words “Registrar General”.

Transitional 12.
Where on the date of coming into operation of these Regulations, any application for conducting a course of study or an additional course of study, or renewal of approval to conduct a course of study or an additional course of study is pending before the
Registrar General under the principal Regulations, the principal Regulations shall apply as if the principal Regulations have not been amended by these Regulations.
