Tafsiran
“adjudikator PCA” ertinya mana-mana penimbang tara, pengantara, pendamai atau ahli kepada suruhanjaya siasatan yang mengambil bahagian dalam perbicaraan, mesyuarat atau aktiviti lain yang berhubung dengan prosiding PCA;
“Biro Antarabangsa” ertinya Biro Antarabangsa untuk Permanent Court of
Arbitration;
"Kerajaan” ertinya Kerajaan Malaysia;
“pegawai-pegawai PCA” ertinya Setiausaha Agung PCA dan semua anggota kakitangan Biro Antarabangsa;
“pegawai tinggi” ertinya Setiausaha Agung PCA atau mana-mana pegawai yang dilantik sebagai pegawai tinggi oleh Setiausaha Agung PCA;

“Permanent Court of Arbitration” atau “PCA” ertinya Permanent Court of
Arbitration, yang berpangkalan di The Hague;
“peserta prosiding PCA” ertinya mana-mana peguam, pihak, agen atau wakil pihak, saksi, pakar, serta jurubahasa, penterjemah atau wartawan mahkamah yang mengambil bahagian di dalam perbicaraan, mesyuarat atau aktiviti lain yang berkaitan dengan prosiding PCA;
“prosiding PCA” ertinya sebarang prosiding penyelesaian pertikaian ditadbir oleh atau di bawah naungan PCA, sama ada menurut konvensyen 1899 atau 1907 atau mana-mana kaedah prosedur pilihan PCA;
“Setiausaha Agung” ertinya ketua kepada Biro Antarabangsa.

Permanent Court of Arbitration diisytiharkan menjadi suatu organisasi antarabangsa yang baginya seksyen 4 Akta terpakai.
Keperibadian juridikal
Permanent Court of Arbitration hendaklah mempunyai keperibadian juridikal dan keupayaan di sisi undang-undang yang diperlukan untuk memenuhi tujuan dan objektifnya di Malaysia.
Keistimewaan dan kekebalan Permanent Court of Arbitration
Permanent Court of Arbitration hendaklah mempunyai semua atau mana-mana keistimewaan dan kekebalan yang dinyatakan dalam Jadual Pertama kepada Akta.
Keistimewaan dan kekebalan pegawai tinggi
Seseorang pegawai tinggi hendaklah mempunyai semua atau mana-mana keistimewaan dan kekebalan yang dinyatakan dalam Bahagian I Jadual Kedua kepada
Akta.

Seseorang bekas pegawai tinggi hendaklah mempunyai kekebalan yang dinyatakan dalam Bahagian II Jadual Kedua kepada Akta.
Keistimewaan dan kekebalan adjudikator PCA
Seseorang adjudikator
PCA hendaklah mempunyai semua atau mana-mana keistimewaan dan kekebalan yang dinyatakan dalam Bahagian I
Jadual Ketiga kepada Akta.
(2)
Seseorang bekas adjudikator PCA hendaklah mempunyai kekebalan yang dinyatakan dalam Bahagian II Jadual Ketiga kepada Akta.
Keistimewaan dan kekebalan pegawai-pegawai

(selain daripada pegawai tinggi)

(1)
Seseorang pegawai PCA (selain daripada pegawai tinggi) hendaklah mempunyai semua atau mana-mana keistimewaan dan kekebalan yang dinyatakan dalam Bahagian I Jadual Keempat kepada Akta.
(2)
Seseorang bekas pegawai PCA (selain daripada pegawai tinggi) hendaklah mempunyai kekebalan yang dinyatakan dalam Bahagian II Jadual Keempat kepada Akta.
Keistimewaan dan kekebalan peserta prosiding PCA
9.
(1)
Seseorang peserta prosiding PCA hendaklah mempunyai semua atau mana-mana keistimewaan dan kekebalan yang dinyatakan dalam Bahagian I
Jadual Kelima kepada Akta.
(2)
Pensijilan status peserta prosiding PCA hendaklah dikemukakan kepada
Kerajaan dengan ditandatangani oleh seorang pegawai PCA dan dihadkan kepada suatu tempoh masa yang munasabah yang diperlukan bagi sesuatu prosiding.
(3)
Seseorang yang telah mengambil bahagian di dalam prosiding PCA hendaklah mempunyai kekebalan yang dinyatakan dalam Bahagian II Jadual Kelima kepada Akta.

Penepian 10.
(1)
Pihak berkuasa berwibawa hendaklah mempunyai kuasa untuk mengetepikan kekebalan yang diberikan yang tersebut di atas jika, pada pendapat pihak berkuasa itu kekebalan itu akan menghalang proses keadilan dan boleh diketepikan tanpa menjejaskan pentadbiran keadilan dan, di mana bersesuaian, kepentingan
Malaysia dan Permanent Court of Arbitration.
(2)
Bagi maksud subseksyen (1), pihak berkuasa berwibawa ialah—
(a)
dalam hal adjudikator PCA dan pegawai PCA (selain daripada
Setiausaha Agung), Setiausaha Agung;
(b)
dalam hal Setiausaha Agung, Majlis Pentadbiran PCA;
(c)
dalam hal peserta prosiding PCA yang mewakili atau ditetapkan oleh sesebuah Negara yang merupakan pihak kepada prosiding
PCA yang berkenaan, Negara tersebut;
(d)
dalam hal individu-individu lain yang hadir atas permintaan sesebuah Negara yang merupakan pihak kepada prosiding PCA,
Setiausaha Agung; dan
(e)
dalam hal pegawai Kerajaan, Setiausaha Agung, setelah berunding dengan Kerajaan.

INTERNATIONAL ORGANIZATIONS (PRIVILEGES AND IMMUNITIES) ACT 1992
INTERNATIONAL ORGANIZATIONS (PRIVILEGES AND IMMUNITIES)
(PERMANENT COURT OF ARBITRATION) REGULATIONS 2017
IN exercise of the powers conferred by subsections 3(1) and 4(1) and section 11 of the
International Organizations (Privileges and Immunities) Act 1992 [Act 485], the
Minister, with the concurrence of the Minister of Finance, makes the following regulations:
Citation 1.
These regulations may be cited as the International Organizations
(Privileges and Immunities) (Permanent Court of Arbitration) Regulations 2017.
Interpretation 2.
In these Regulations, unless the context otherwise requires—
“PCA adjudicator” means any arbitrator, mediator, conciliator or member of a commission of inquiry taking part in a hearing, meeting or other activity in relation to
PCA proceedings;
“International Bureau” means the International Bureau of the Permanent Court of Arbitration;
“Government” means the Government of Malaysia;
“officials of the PCA” means the Secretary-General of the PCA and all members of the staff of the International Bureau;
“high officer” means the Secretary-General of the PCA or any officer designated as a High Officer by the Secretary-General of the PCA;
“Permanent Court of Arbitration” or “PCA” means the Permanent Court of
Arbitration, based in The Hague;

“participant in PCA proceedings” means any counsel, party, agent or other party representative, witness, expert, as well as any interpreters, translators or court reporters taking part in a hearing, meeting or other activity in relation to
PCA Proceedings;
“PCA proceedings” means any dispute resolution proceedings administered by or under the auspices of the PCA, whether or not pursuant to the 1899 or 1907 Convention or any of the PCA’s optional rules of procedure; and
“Secretary-General” means the head of the International Bureau.
Declaration of Permanent Court of Arbitration to be an international organization 3.
Permanent Court of Arbitration is declared to be an international organization to which section 4 of the Act applies.
Juridical personality 4.
Permanent Court of Arbitration shall have juridical personality and such legal capacities as are necessary to fulfil its purposes and objectives in Malaysia.
Privileges and immunities of Permanent Court of Arbitration
5.
Permanent Court of Arbitration shall have all or any of the privileges and immunities specified in the First Schedule to the Act.
Privileges and immunities of high officer 6.
(1)
A high officer shall have all or any of the privileges and immunities specified in Part I of the Second Schedule to the Act.
(2)
A former high officer shall have the immunities specified in Part II of the
Second Schedule to the Act.

7.
(1)
A PCA adjudicator shall have all or any of the privileges and immunities specified in Part I of the Third Schedule to the Act.
(2)
A former PCA adjudicator shall have the immunities specified in Part II of the Third Schedule to the Act.
Privileges and immunities of officials of the PCA (not being a high officer)
8.
(1)
An official of the PCA (not being a high officer) shall have all or any of the privileges and immunities specified in Part I of the Fourth Schedule to the Act.
(2)
A former official of the PCA (not being a high officer) shall have the immunities specified in Part II of the Fourth Schedule to the Act.
Privileges and immunities of participant in PCA proceedings
9.
(1)
A participant in PCA proceedings shall have all or any of the privileges and immunities specified in Part I of the Fifth Schedule to the Act.
(2)
Certification of the status of participants in PCA proceedings shall be provided to the Government under the signature of an official of the PCA and limited to a period reasonably required for the proceedings.
(3)
A person who has participated in PCA proceedings shall have the immunities specified in Part II of the Fifth Schedule to the Act.
Waiver 10.
(1)
The competent authority shall have the right to waive the immunities conferred on the above mentioned where, in the opinion of such authority, the immunity would impede the course of justice and can be waived without prejudice to the administration of justice and, where appropriate, the interests of Malaysia and the
Permanent Court of Arbitration.
(2)
For the purposes of subregulation (1), the competent authority shall be—

(a)
in the case of PCA adjudicators and officials of the PCA (other than the Secretary-General), the Secretary-General;
(b)
in the case of the Secretary-General, the Administrative Council of the PCA;
(c)
in the case of participants in PCA proceedings representing or designated by a State which is a party to the relevant
PCA Proceedings, that State;
(d)
in the case of other individuals appearing at the instance by a State of a party to PCA proceedings, the Secretary-General; and
(e)
in the case of personnel of the Government, the Secretary-General, after consultation with the Government.
