PREVENTION AND CONTROL OF INFECTIOUS DISEASES
(MEASURES WITHIN INFECTED LOCAL AREAS) (NO. 7) REGULATIONS 2020
IN exercise of the powers conferred by subsection 11(2)
of the
Prevention and Control of Infectious Diseases Act 1988 [Act 342], the Minister makes the following regulations:
Citation and commencement 1.
(1)
These regulations may be cited as the Prevention and Control of
Infectious
Diseases
(Measures within
Infected
Local
Areas)
(No.
7)
Regulations 2020.
(2)
These Regulations have effect for the period from 10 June 2020
to 31 August 2020.
Application 2.
These Regulations shall apply to infected local areas declared under the
Prevention and Control of Infectious Diseases (Declaration of Infected Local Areas)
Order 2020 [P.U. (A) 87/2020] as extended from time to time.
Prohibited activity 3.
No person shall carry out, organize, undertake or otherwise be involved in, any prohibited activity as specified in the Schedule.
Prohibition on movement to place that is subject to enhanced movement control order 4.
(1)
No person shall enter into or exit from a place that is subject to an enhanced movement control order except any person who is providing healthcare and medical services or is given permission by an authorized officer.
(2)
For the purposes of subregulation (1), “enhanced movement control order”
refers to a direction given by an authorized officer under subsection 11(3) of the Act.

Prohibition on procession 5.
No person shall in any way participate or be involved in any procession.
Control of gathering 6.
A person may gather or be involved in a gathering including congregate to perform prayers at any place of worship of his religion subject to such directions of the
Director General issued under regulation 10.
Public transport 7.
Notwithstanding the total maximum capacity of the number of passengers that may be carried on board any land, sea or air public transport, a holder of any land, sea or air public transport licence or permit to carry passengers shall ensure that the public transport relating to his licence or permit carries such number of passengers according to the direction of the Director General issued under regulation 10.
Requirement to undergo health examination upon arrival in Malaysia 8.
(1)
Any citizen, permanent resident of
Malaysia, expatriate or diplomatic corps, or any other foreigner permitted by the
Director General of Immigration, entering Malaysia from overseas shall undergo health examination upon arrival in Malaysia before proceeding for immigration clearance at any point of entry and shall comply with any direction of an authorized officer.
(2)
Where any person referred to in subregulation (1) is directed to undergo home quarantine, the person shall wear a wristband provided by the authorized officer.
Request for information 9.
An authorized officer may request for any information relating to the prevention and control of infectious disease from any person or body of persons.
Direction of Director General 10.
The Director General may issue any direction in any manner, whether generally or specifically, to any person or group of persons to take such measures for the purpose of preventing and controlling any infectious disease including any direction to

any person or group of persons carrying out, organizing, undertaking, or who is otherwise involved in, any activity other than a prohibited activity as specified in the
Schedule.
Offence 11.
(1)
Any person who contravenes any provision of these Regulations or any direction of the Director General or an authorized officer commits an offence and shall, on conviction, be liable to a fine not exceeding one thousand ringgit or to imprisonment for a term not exceeding six months or to both.
(2)
Where any person who commits an offence under these Regulations is a company, limited liability partnership, firm, society or other body of persons, a person who at the time of the commission of the offence was a director, compliance officer, partner, manager, secretary or other similar officer of the company, limited liability partnership, firm, society or other body of persons or was purporting to act in the capacity or was in any manner or to any extent responsible for the management of any of the affairs of the company, limited liability partnership, firm, society or other body of persons or was assisting in its management—
(a)
may be charged severally or jointly in the same proceedings with the company, limited liability partnership, firm, society or other body of persons; and
(b)
if the company, limited liability partnership, firm, society or other body of persons is found guilty of the offence, shall be deemed to be guilty of that offence and shall be liable to the same punishment or penalty as an individual unless, having regard to the nature of his functions in that capacity and to all circumstances, he proves—
(i)
that the offence was committed without his knowledge; and

(ii)
that the offence was committed without his consent or connivance and that he had taken all reasonable precautions and exercised due diligence to prevent the commission of the offence.
Transitional provision 12.
Any directions of the Director General issued or deemed to have been issued under the Prevention and Control of Infectious Diseases (Measures within Infected Local Areas)
(No. 6) Regulations 2020 [P. U. (A) 147/2020] shall be deemed to have been made under these Regulations and shall continue to remain in force unless revoked by the
Director General.
