Peraturan-peraturan ini bolehlah dinamakan Peraturan-Peraturan Pilihan

Raya (Penjalanan Pilihan Raya) (Pindaan) 2011.

[P.U. (A) 386/1981], yang disebut “Peraturan-Peraturan ibu” dalam Peraturan-Peraturan ini, dipinda dalam peraturan 2 dengan memasukkan selepas takrif “menandatangani”

takrif yang berikut:

‘ “parti politik” ertinya mana-mana pertubuhan, yang didaftarkan di bawah Akta

Pertubuhan 1966 [Akta 335], yang Suruhanjaya Pilihan Raya berpuas hati ialah parti politik mengikut pengertian Akta itu;’.

Peraturan 4 Peraturan-Peraturan ibu dipinda dengan memasukkan selepas subperaturan 4(7) subperaturan yang berikut:

“(7A)

Tiap-tiap akuan yang disebut dalam subperaturan (7) hendaklah dikecualikan daripada duti setem.”.

“(5A) Melainkan jika Suruhanjaya Pilihan Raya, melalui notis mengikut apa-apa cara yang ditentukan oleh Suruhanjaya Pilihan Raya, menetapkan apa-apa waktu lain berkenaan dengan mana-mana bahagian pilihan raya atau sebahagian daripadanya, pengundian dalam mana-mana bahagian pilihan raya itu hendaklah dibuka selama dua belas jam antara waktu yang ditentukan oleh Suruhanjaya Pilihan Raya.”;

(d)

dengan memasukkan selepas subperaturan (5A) subperaturan yang berikut:

“(5B) Notis yang disebut dalam subperaturan (5) dan (5A) hendaklah disiarkan dalam Warta secepat yang dapat dilaksanakan.”;

(e)

dalam subperaturan (7), dengan menggantikan perkataan “dalam tempoh tiga hari dari hari penamaan, calon itu hendaklah memberikan notis bertulis sendiri mengenai penarikan balik pencalonan itu” dengan perkataan

“sebelum pukul dua belas tengah hari sehari selepas hari penamaan, calon itu hendaklah memberi sendiri notis yang bermaksud demikian dalam Borang 6

atau 6A, mengikut mana-mana yang berkenaan, dalam Jadual Pertama”; dan

(f)

dalam subperaturan (8), dengan menggantikan perkataan “Notis bertulis”

dengan perkataan “Borang 6 atau 6A”.

ELECTIONS ACT 1958

ELECTIONS (CONDUCT OF ELECTIONS) (AMENDMENT)

REGULATIONS 2011

IN exercise of the powers conferred by section 16 of the Elections Act 1958 [Act 19], the

Election Commission, with the approval of the Yang di-Pertuan Agong, makes the following regulations:

Citation and commencement 1.

(1)

These regulations may be cited as the Elections (Conduct of Elections)

(Amendment) Regulations 2011.

(2)

These Regulations come into operation on 15 June 2011.

Amendment of regulation 2 2.

The Elections (Conduct of Elections) Regulations 1981 [P.U. (A) 386/1981], which are referred to as the “principal Regulations” in these Regulations, are amended in regulation 2 by inserting after the definition of “general election” the following definition:

‘ “political party” means any society, registered under the Societies Act 1966

[Act 335], which the Election Commission is satisfied is a political party within the meaning of that Act;’.

Amendment of regulation 4 3.

Regulation 4 of the principal Regulations is amended by inserting after subregulation 4(7) the following subregulation:

“(7A)

Every declaration mentioned in subregulation (7) shall be exempt from stamp duty.”.

Amendment of regulation 11 4.

Regulation 11 of the principal Regulations is amended

(a)

in paragraph (2)(c), by deleting the words “In this paragraph “political party”

means any society, registered under the Societies Act 1966 [Act 335], which the Election Commission is satisfied is organized for political purposes.”;

(b)

in paragraph (5)(d)

(i)

by substituting for the word “station”, wherever appearing, the word “centre”; and

(ii)

by substituting for the word “stations” the word “centres”.

(c)

by substituting for subregulation (5A) the following subregulation:

“(5A) Unless the Election Commission, by notice in such manner as may be determined by the Election Commission, appoints any other hours in respect of any constituency or part thereof, the poll in any constituency shall be open for twelve hours between such hours as the

Election Commission shall specify.”;

(d)

by inserting after subregulation (5A) the following subregulation:

“(5B) The notices referred to in subregulations (5) and (5A) shall as soon as practicable be published in the Gazette.”;

(e)

in subregulation (7), by substituting for the words “within three days of the day of nomination, the candidate shall give in person a written notice to that effect” the words “before twelve noon a day after the day of nomination, the

candidate shall give in person a notice to that effect in Form 6 or 6A, as the case may be, in the First Schedule”; and

(f)

in subregulation (8), by substituting for the words “The written notice” the words “The Form 6 or 6A”.

Amendment of regulation 13 5.

Regulation 13 of the principal Regulations is amended

(a)

in the shoulder note, by substituting for the words “polling station” the words “polling centre and station”; and

(b)

in subregulation (1)

(i)

in the national language text

(A)

by inserting after the word “oleh” the words “mana-mana”; and

(B)

by substituting for the words “setiap tempat mengundi” the words “setiap pusat mengundi”; and

(ii)

in the English language text, by substituting for subregulation (1) the following subregulation:

“(1) A notice as set out in Form 8 in the First Schedule shall be affixed by any presiding officer outside each polling centre in a conspicuous place before the commencement of the poll.”.

Amendment of regulation 15 6.

Regulation 15

of the principal

Regulations is amended by deleting subregulations (2) and (2A).

Amendment of regulation 17 7.

Subregulation 17(1) of the principal Regulations is amended in the national language text, by substituting for the words “pembuangan undi” the words “suatu pengundian”.

Amendment of regulation 23A

8.

Subregulation 23A of the principal Regulations is amended

(a)

by substituting for subregulation (1) the following subregulation:

“(1)

Subject to this regulation and subregulation 25B(4), votes by electors at any polling station shall be counted at the polling station where the electors voted, in accordance with the procedures set out in these Regulations.”; and

(b)

in subregulation (2)

(i)

by substituting for the words “votes cast” the word “votes”; and

(ii)

by deleting the words “, under the supervision of the returning officer,”.

Amendment of regulation 24 9.

Regulation 24 of the principal Regulations is amended

(a)

in subregulation (2), by substituting for the words “votes cast” the words

“votes by electors”; and

(b)

in the proviso to subregulation (2), by substituting for the words “votes cast”

the words “votes by electors”.

Amendment of regulation 25 10.

Regulation 25 of the principal Regulations is amended

(a)

in subregulation (6), by substituting for the words “votes cast” the words

“votes by electors”; and

(b)

in subregulation (13), by substituting for the words “votes cast”, wherever appearing, the words “votes by electors”.

Amendment of regulation 25A

11.

Subregulation 25A(3) of the principal Regulations is amended by inserting after the word “deliver” the words “in such manner as may be determined by the Election

Commission”.

Amendment of regulation 30 12.

Subregulation 30(1) of the principal Regulations is amended in the national language text, by inserting after the words “kegagalan itu” the word “tidak”.

Amendment of First Schedule 13.

The First Schedule to the principal Regulations is amended

(a)

in Form 6 and Form 6A, by substituting for the words “[Regulation 9]” the words “[Regulations 9 and 11]”;
