"Kuasa untuk membuat penamaan
Seksyen 6A
(2)
Tiap-tiap penamaan itu hendaklah dibuat dalam borang yang kandungannya akan ditentukan oleh Perbadanan dan tidak akan berkuat kuasa melainkan jika penamaan itu dibuat semasa hayat pendeposit.
(3)
Pendeposit hendaklah memaklumkan kepada Perbadanan tentang apa-apa pertukaran penama atau alamat penama.

(a)
atas kematian penama itu, atau jika terdapat lebih daripada seorang penama, atas kematian semua penama itu, semasa hayat pendeposit;
(b)
melalui suatu notis pembatalan secara bertulis yang diberikan oleh pendeposit dan diterima oleh Perbadanan semasa hayat pendeposit; atau

(a)
jika pendeposit telah membuat penamaan dan penamaan itu tidak dibatalkan di bawah Peraturan-Peraturan ini, kepada penama mengikut terma penamaan itu; atau
(b)
jika pendeposit tidak membuat penamaan, kepada mana-mana pemohon yang mengemukakan Pemberian
Probet atau Surat Kuasa Mentadbir atau Perintah
Pembahagian, mengikut mana-mana yang berkenaan, mengikut cara yang boleh ditentukan oleh Perbadanan.

Walau apa pun perenggan (1)(a), jika penama itu belum mencapai umur lapan belas tahun, pembayaran itu hendaklah dibuat kepada orang yang disebut dalam perenggan (1)(b).
(3)
Walau apa pun perenggan (1)(b), Perbadanan boleh membayar semua atau mana-mana bahagian daripada amaun yang ada pada kredit pendeposit yang telah mati itu kepada pemohon tanpa memerlukan Pemberian
Probet atau Surat Kuasa Mentadbir atau Perintah Pembahagian jika—
(a)
amaun yang ada pada kredit pendeposit yang telah mati itu tidak melebihi tiga ribu ringgit; dan
(b)
permohonan itu telah dibuat oleh pemohon dalam tempoh dua bulan dari tarikh kematian pendeposit.
(4)
Jika pendeposit yang beragama Islam mati setelah penamaan dibuat mengikut Peraturan-Peraturan ini, orang yang dinamakan hendaklah menerima amaun yang ada pada kredit pendeposit yang telah mati itu sebagai wasi dan bukan semata-mata sebagai benefisiari dan hendaklah membahagi-bahagikan amaun itu mengikut Undang-Undang Islam.

Walau apa pun mana-mana undang-undang bertulis yang berlawanan, apa-apa pembayaran yang dibuat oleh Perbadanan kepada mana-mana orang yang telah mencapai umur lapan belas tahun di bawah
Peraturan-Peraturan ini hendaklah disifatkan sebagai pelepasan yang sah oleh
Perbadanan.

SKIM SIMPANAN PENDIDIKAN NASIONAL (AMENDMENT) REGULATIONS 2014
Opening note
Preamble
- IN exercise of the powers conferred by section 12 of the Perbadanan Tabung Pendidikan Tinggi Nasional Act 1997 [Act 566], the Perbadanan, with the approval of the Minister of Finance makes the following regulations: Citation 1. These regulations may be cited as the Skim Simpanan Pendidikan Nasional (Amendment) Regulations 2014. Amendment of regulation 2 2. The Skim Simpanan Pendidikan Nasional Regulations 2004 [P.U. (A) 268/2004], which are referred to as the “principal Regulations” in these Regulations, are amended in regulation 2 by deleting the definition of “personal representative”. Amendment of regulation 6 3. Regulation 6 of the principal Regulations is amended by substituting for the words “his personal representative” wherever appearing the words “the persons referred to in subregulation 6C(1)”. New regulations 6A, 6B and 6C
Seksyen 4
The principal Regulations are amended by inserting after regulation 6 the following regulations:
"Power to make nomination
Seksyen 6A
(2)
Every such nomination shall be made in a form which the contents will be determined by the Perbadanan and shall have no effect unless it is made during the lifetime of the depositor.
(3)
The depositor shall inform the Perbadanan of any change of nominee or address of the nominee.
Revocation of nomination 6B.
A nomination shall be revoked—
(a)
upon the death of the nominee, or where there is more than one nominee, upon the death of all the nominees, during the lifetime of the depositor;
(b)
by a notice of revocation in writing given by the depositor and received by the Perbadanan during the lifetime of the depositor; or
(1)
Upon the death of a depositor, the amount standing to his credit shall be payable to any of the following persons:
(a)
where the depositor has made a nomination and such nomination is not revoked under these Regulations, to the nominee in accordance with the terms of such nomination;
or
(b)
where the depositor has not made a nomination, to any applicant who produces the Grant of Probate or Letters of

Administration or Distribution Order, as the case may be, in the manner as may be determined by the Perbadanan.
(2)
Notwithstanding paragraph (1)(a), if the nominee has not attained the age of eighteen years old, the payment shall be made to the person mentioned in paragraph (1)(b).
(3)
Notwithstanding paragraph (1)(b), the Perbadanan may pay all or any part of the amount standing to the credit of the deceased depositor to the applicant without requiring the Grant of Probate or Letter of Administration or
Distribution Order if—
(a)
the amount standing to the credit of the deceased depositor does not exceed three thousand ringgit; and
(b)
the application is made by the applicant within the period of two months from the date of death of the depositor.
(4)
Where a Muslim depositor dies having made a nomination in accordance with these Regulations, the person nominated shall receive the amount standing to the credit of such deceased depositor as an executor and not solely as a beneficiary and shall distribute such amount in accordance with the Islamic Law.
(5)
Notwithstanding any written law to the contrary, any payment made by the Perbadanan to any person who has attained the age of eighteen years old under these Regulations shall be deemed to be a valid discharge by the Perbadanan.
