PADA menjalankan kuasa yang diberikan di bawah subperenggan 142A(2)(a)(ii) dan perenggan 209(1)(a) Akta Perbadanan Insurans Deposit Malaysia 2011 [Akta 720], Perbadanan, dengan kelulusan Menteri, membuat perintah yang berikut: Nama dan permulaan kuat kuasa

Seksyen 1

(1)

Perintah ini bolehlah dinamakan Perintah Perbadanan Insurans Deposit

Malaysia (Penggunaan Lebihan Aset Kumpulan Wang Takaful) 2019.

(2)

Perintah ini mula berkuat kuasa pada 27 Disember 2019.

Keutamaan penggunaan lebihan aset kumpulan wang takaful dalam penggulungan pengendali takaful 2.

Untuk tujuan subperenggan 142A(2)(a)(ii) Akta, dalam penggulungan suatu pengendali takaful, jika aset suatu kumpulan wang takaful yang diuruskan oleh pengendali takaful itu berlebihan, selepas pembayaran telah dibuat untuk menunaikan liabilitinya di bawah subseksyen 142A(1) dan aset tersebut telah digunakan sebagaimana yang dinyatakan di bawah subprenggan 142A(2)(a)(i) Akta, lebihan aset kumpulan wang takaful itu hendaklah digunakan bagi maksud dan dalam turutan yang berikut:

(a)

pertama, jika aset kumpulan wang pemegang syer tidak mencukupi setelah aset kumpulan wang pemegang syer itu digunakan untuk menunaikan liabilitinya, untuk menunaikan liabiliti kumpulan wang pemegang syer menurut keutamaan pembayaran seperti yang dinyatakan dalam subseksyen 142A(3) Akta; dan

(b)

kedua, untuk pertubuhan atau badan kebajikan sebagaimana yang ditentukan oleh Perbadanan bagi tujuan kebajikan.

(APPLICATION OF SURPLUS ASSETS OF TAKAFUL FUND) ORDER 2019

Opening note

Preamble

IN exercise of the powers conferred by subparagraph 142A(2)(a)(ii) and paragraph 209(1)(a) of the Malaysia Deposit Insurance Corporation Act 2011 [Act 720], the Corporation, with the approval of the Minister, makes the following order: Citation and commencement 1.

(1)

This order may be cited as the Malaysia Deposit Insurance Corporation

(Application of Surplus Assets of Takaful Fund) Order 2019.

(2)

This Order shall come into operation on 27 December 2019.

Priority of application of surplus assets of takaful fund in winding up of takaful operator 2.

For the purpose of subparagraph 142A(2)(a)(ii) of the Act, in the winding up of a takaful operator, where the assets of a takaful fund managed by the takaful operator are in surplus, after payment has been made to meet its liabilities under subsection 142A(1)

and the assets have been applied as specified under subparagraph 142A(2)(a)(i) of the

Act, such surplus assets of the takaful fund shall be applied for the purposes and in the following order:

(a)

first, where the assets of the shareholders’ fund are in deficit after the assets of the shareholders’ fund are applied to meet its liabilities, to meet the liabilities of the shareholders’ fund pursuant to the priority of payment set out in subsection 142A(3) of the Act; and

(b)

second, for charitable organizations or bodies as may be determined by the

Corporation for charitable purpose.
