Dalam Peraturan-Peraturan ini—

“Jadual” ertinya Jadual Kedua kepada Perintah Perdagangan Strategik

(Pengguna Akhir Terhad dan Pengguna Akhir Terlarang] 2010 [P.U. (A) 484/2010];

“Jawatankuasa Majlis Keselamatan” ertinya jawatankuasa yang ditubuhkan menurut suatu resolusi Majlis Keselamatan Pertubuhan Bangsa-Bangsa Bersatu;

“keputusan Majlis Keselamatan Pertubuhan Bangsa-Bangsa Bersatu” ertinya keputusan Majlis Keselamatan Pertubuhan Bangsa-Bangsa Bersatu dalam resolusi yang dibuat di bawah Bab VII Piagam Pertubuhan Bangsa-Bangsa Bersatu yang ditandatangani di San Francisco pada 26 Jun 1945;

“orang yang ditetapkan” ertinya mana-mana individu atau entiti yang ditetapkan sebagai pengguna akhir terlarang di bawah seksyen 8 Akta dan disenaraikan dalam

Petisyen penyahsenaraian 3.

(1)

Seseorang yang ditetapkan yang berada di Malaysia boleh meminta supaya namanya dinyah senarai daripada Jadual sebagai pengguna akhir terlarang dengan mengemukakan petisyen kepada Menteri.

Petisyen di bawah subperaturan (1) hendaklah—

(b)

mengandungi butiran mengenai pempetisyen dan sebab bagi penyahsenaraian; dan

disokong dengan dokumen yang berkaitan sebagaimana yang difikirkan perlu oleh Menteri.

Menteri boleh, pada bila-bila masa selepas menerima petisyen di bawah subperaturan (1), menghendaki pempetisyen untuk menyediakan apa-apa dokumen atau maklumat tambahan dalam tempoh yang dinyatakan oleh

Menteri.

Jika dokumen atau maklumat tambahan yang dikehendaki di bawah subperaturan (3) tidak disediakan oleh pempetisyen dalam tempoh yang dinyatakan atau apa-apa tempoh lanjutan yang diberikan oleh Menteri, petisyen itu hendaklah disifatkan telah ditarik balik dan hendaklah tidak boleh lagi diteruskan, tanpa menjejaskan petisyen baru yang dikemukakan oleh pempetisyen.

Menteri hendaklah, setelah menimbangkan petisyen di bawah subperaturan (1) dan apa-apa dokumen atau maklumat tambahan di bawah subperaturan (3), jika ada, memutuskan sama ada pempetisyen tidak lagi memenuhi kriteria bagi penyenaraian dalam apa-apa sanksi yang berkaitan dengan percambahan

senjata pemusnah besar-besaran yang dikenakan menurut keputusan Majlis

Keselamatan Pertubuhan Bangsa-Bangsa Bersatu.

Jika Menteri memutuskan bahawa pempetisyen tidak lagi memenuhi kriteria bagi penyenaraian dalam apa-apa sanksi yang berkaitan dengan percambahan senjata pemusnah besar-besaran yang dikenakan menurut keputusan Majlis

Keselamatan Pertubuhan Bangsa-Bangsa Bersatu, Menteri hendaklah mengemukakan petisyen itu kepada Jawatankuasa Majlis Keselamatan bagi keputusan Jawatankuasa

Majlis Keselamatan mengikut cara yang ditentukan oleh Jawatankuasa Majlis

Keselamatan.

Keputusan

Menteri untuk mengemukakan atau enggan untuk mengemukakan petisyen kepada Jawatankuasa Majlis Keselamatan di bawah subperaturan (6) hendaklah disampaikan kepada pempetisyen.

Menteri untuk mengemukakan petisyen kepada

Jawatankuasa Majlis Keselamatan di bawah Peraturan-Peraturan ini tidak menghalang pempetisyen menggunakan apa-apa cara lain bagi maksud penyahsenaraian namanya daripada Jadual, sebagaimana yang ditentukan oleh Jawatankuasa Majlis Keselamatan.

Jika Jawatankuasa Majlis Keselamatan memutuskan bahawa pempetisyen tidak lagi memenuhi kriteria bagi penyenaraian dalam apa-apa sanksi yang berkaitan dengan percambahan senjata pemusnah besar-besaran yang dikenakan menurut keputusan Majlis Keselamatan Pertubuhan Bangsa-Bangsa Bersatu, Menteri hendaklah melaksanakan keputusan Jawatankuasa Majlis Keselamatan itu dan menyah senarai pempetisyen daripada Jadual.

Menteri hendaklah menyampaikan kepada pempetisyen apa-apa keputusan Jawatankuasa Majlis Keselamatan berkenaan dengan petisyen itu.

STRATEGIC TRADE (DELISTING OF PROHIBITED END-USERS) REGULATIONS 2014

  1. IN exercise of the powers conferred by section 8 and subsection 55(1) of the Strategic Trade Act 2010 [Act 708], the Minister makes the following regulations: Citation and commencement 1.

(1)

These regulations may be cited as the Strategic Trade (Delisting of

Prohibited End-Users) Regulations 2014.

These Regulations come into operation on 5 November 2014.

Interpretation 2.

In these Regulations—

“Schedule” means the Second Schedule to the Strategic Trade (Restricted

End-Users and Prohibited End-Users] Order 2010 [P.U. (A) 484/2010];

“Security Council Committee” means a committee established pursuant to a resolution of the United Nations Security Council;

“decision of the United Nations Security Council” means a decision of the United

Nations Security Council in resolutions made under Chapter VII of the Charter of the

United Nations signed at San Francisco on 26 June 1945;

“designated person" means any individual or entity designated as a prohibited end-user under section 8 of the Act and listed in the Schedule;

“petitioner” means a designated person who submits a petition under regulation 3.

Delisting petition 3.

A designated person who is in Malaysia may request to have his name be delisted from the Schedule as a prohibited end-user by submitting a petition to the

Minister.

A petition under subregulation (1) shall—

(b)

contain particulars of the petitioner and reasons for the delisting;

and

supported by relevant documents as the Minister considers necessary.

The Minister may, at any time after the receipt of a petition under subregulation (1), require the petitioner to provide any additional documents or information within the period specified by the Minister.

If the additional document or information required under subregulation

is not provided by the petitioner within the period specified or any extended period granted by the Minister, the petition shall be deemed to be withdrawn and shall not be further proceeded with, without prejudice to a fresh petition being submitted by the petitioner.

The Minister shall, after considering the petition under subregulation (1)

and any additional document or information under subregulation (3), if any, decide whether the petitioner no longer meets the criteria for listing in any sanction in connection with the proliferation of weapons of mass destructions imposed pursuant to a decision of the United Nations Security Council.

If the Minister decides that the petitioner no longer meets the criteria for listing in any sanction in connection with the proliferation of weapons of mass

destructions imposed pursuant to a decision of the United Nations Security Council, the Minister shall submit the petition to the Security Council Committee for a decision of the Security Council Commitee in a manner determined by the Security Council

Committee.

The decision of the Minister to submit or refuse to submit the petition to the Security Council Committee under subregulation (6) shall be communicated to the petitioner.

The refusal of the Minister to submit the petition to the Security Council

Committee under these Regulations shall not prevent the petitioner from using any other means for the purposes of the delisting of his name from the Schedule, as determined by the Security Council Committee.

If the Security Council Committee decides that the petitioner no longer meets the criteria for listing in any sanction in connection with the proliferation of weapons of mass destructions imposed pursuant to a decision of the United Nations

Security Council, the Minister shall give effect to the decision of the Security Council

Commitee and delist the petitioner from the Schedule.

The Minister shall communicate to the petitioner any decision of the

Security Council Committee with respect to the petition.

For the purposes of these Regulations, the Minister may consult or co-operate with any Ministry or government agency, as the Minister deems appropriate.
