- PADA menjalankan kuasa yang diberikan oleh seksyen 98 Akta Keselamatan Sosial Pekerja 1969 [Akta 4], Menteri membuat pemberitahuan yang berikut: Nama dan permulaan kuat kuasa

(1)
Menteri mengecualikan daripada kuat kuasa Akta mana-mana pekerja asing yang—
(a)
bekerja di Malaysia pada atau selepas tarikh permulaan kuat kuasa
Pemberitahuan ini; atau
(b)
telah bekerja di Malaysia sebaik sebelum tarikh permulaan kuat kuasa
Pemberitahuan ini, tanpa suatu pas atau permit yang sah yang dikeluarkan oleh Ketua Pengarah Imigresen bagi maksud bekerja di Malaysia tetapi kemudiannya, selepas tarikh permulaan kuat kuasa Pemberitahuan ini, suatu pas atau permit yang sah dikeluarkan oleh
Ketua Pengarah Imigresen kepada pekerja asing itu bagi maksud bekerja di Malaysia.

Pengecualian di bawah subperenggan (1) hendaklah terpakai bagi pekerja asing itu bagi apa-apa tempoh sebelum tarikh pengeluaran pas atau permit yang sah itu.

EMPLOYEES’ SOCIAL SECURITY (EXEMPTION) NOTIFICATION 2018
Opening note
Preamble
- IN exercise of the powers conferred by section 98 of the Employees’ Social Security Act 1969 [Act 4], the Minister makes the following notification: Citation and commencement 1.
(1)
This notification may be cited as the Employees’ Social Security
(Exemption) Notification 2018.
(1)
The Minister exempts from the operation of the Act any foreign worker who—
(a)
works in Malaysia on or after the date of coming into operation of this
Notification; or
(b)
has worked in Malaysia immediately before the date of coming into operation of this Notification, without a valid pass or permit issued by the Director General of Immigration for the purpose of working in Malaysia but subsequently, after the date of coming into operation of this Notification, a valid pass or permit is issued by the Director General of
Immigration to such foreign worker for the purpose of working in Malaysia.
(2)
The exemption under subparagraph (1) shall apply to such foreign worker for any period before the date of issuance of the valid pass or permit.
