Jadual IV, telah dilesenkan di bawah Undang-Undang Kecil ibu, anjing itu hendaklah, pada permulaan kuat kuasa Undang-Undang Kecil ini, disifatkan telah dilesenkan di bawah Undang-Undang Kecil ini dan pemunya anjing itu hendaklah, dalam masa enam bulan dari tarikh permulaan kuat kuasa Undang-Undang Kecil ini atau apa-apa tempoh lanjutan yang dibenarkan oleh Datuk Bandar, menyebabkan anjing itu diimplankan dengan mikrocip menurut undang-undang kecil 3B dan Sijil Mikrocip yang dikeluarkan kepadanya hendaklah dikemukakan kepada Datuk Bandar.
(2)
Jika pemunya anjing di bawah perenggan (1) gagal mematuhi perenggan (1), anjing itu hendaklah terhenti daripada disifatkan telah dilesenkan di bawah perenggan (1) dan Datuk Bandar hendaklah menyita dan melupuskan anjing itu.
(3)
Jika seekor anjing yang dinyatakan dalam Jadual IV telah dilesenkan di bawah Undang-Undang Kecil ibu, anjing itu hendaklah, pada permulaan kuat kuasa
Undang-Undang Kecil ini, disifatkan telah dilesenkan di bawah Undang-Undang Kecil ini dan pemunya anjing itu hendaklah, dalam tempoh enam bulan dari tarikh permulaan kuat kuasa Undang-Undang Kecil ini atau apa-apa tempoh lanjutan yang dibenarkan oleh Datuk Bandar—
(a)
mengikuti dan lulus kursus pengendalian anjing yang dianjurkan oleh mana-mana badan yang diluluskan oleh Datuk Bandar;

(b)
membawa anjing itu mengikuti dan lulus kursus “Canine Good
Citizen” yang dianjurkan oleh mana-mana badan yang diluluskan oleh Datuk Bandar;
(c)
menyebabkan anjing itu diimplankan dengan mikrocip menurut undang-undang kecil 3A; dan
(d)
mengemukakan perakuan kursus pengendalian anjing, perakuan kursus “Canine Good Citizen” dan Sijil Mikrocip yang dikeluarkan kepadanya kepada Datuk Bandar.
(4)
Jika pemunya anjing di bawah perenggan (3) gagal mematuhi perenggan (3), anjing itu hendaklah terhenti daripada disifatkan telah dilesenkan di bawah perenggan (3) dan Datuk Bandar hendaklah menyita dan melupuskan anjing itu.
(5)
Semua anjing yang dinyatakan dalam Jadual III yang telah dilesenkan di bawah Undang-Undang Kecil ibu hendaklah, pada permulaan kuat kuasa Undang-Undang Kecil ini, terhenti dilesenkan dan pemunya anjing itu hendaklah, mengikut apa-apa cara, melupuskan anjing itu.
(6)
Jika pemunya anjing di bawah perenggan (5) gagal melupuskan anjing itu,
Datuk Bandar hendaklah menyita dan melupuskan anjing itu.
(7)
Tiada pampasan boleh kena dibayar oleh Datuk Bandar bagi pelupusan mana-mana anjing di bawah Undang-Undang Kecil ini.
(8)
Apa-apa permohonan bagi pelesenan anjing atau pembaharuan lesen yang belum selesai hendaklah, pada permulaan kuat kuasa Undang-Undang Kecil ini, diuruskan menurut peruntukan Undang-Undang Kecil ini.

Semua daftar yang disimpan dan disenggarakan di bawah Undang-Undang Kecil ibu hendaklah terus berkuat kuasa dan mempunyai kesan seolah-olah daftar itu disimpan dan disenggarakan di bawah Undang-Undang Kecil ini.

LICENSING OF DOGS AND KENNEL ESTABLISHMENTS (FEDERAL TERRITORY
OF KUALA LUMPUR) (AMENDMENT) BY-LAWS 2011
IN exercise of the powers conferred by section 73 of the Local Government Act 1976
[Act 171], the Commissioner of the City of Kuala Lumpur makes, and pursuant to section 103 of the said Act, the Minister confirms, the following by-laws:
Citation, application and commencement 1.
(1)
These by-laws may be cited as the Licensing Of Dogs and Kennel
Establishments (Federal Territory of Kuala Lumpur) (Amendment) By-Laws 2011.
(2)
These By-Laws apply only to the Federal Territory of Kuala Lumpur.
(3)
These By-Laws shall come into operation on 1 October 2011.
Amendment of by-law 2 2.
The Licensing Of Dogs and Kennel Establishments (Federal Territory of Kuala
Lumpur) By-Laws 1991 [P.U. (A) 470/1991], which are referred to as the “principal By-Laws” in these By-Laws, are amended in by-law 2—
(a)
by substituting for the definition of “licensed dog” the following definition:
‘
“licensed dog” means a dog which has been implanted with a microchip and licensed under by-law 3;’;
(b)
by inserting before the definition of “veterinary surgeon” the following definition:

‘
“small dog” means any of the dogs as specified in Schedule II;’;
(c)
by inserting after the definition of “owner” the following definition:
‘
“restricted dog” means any of the dogs as specified in Schedule IV;’;
(d)
by inserting before the definition of “Commissioner” the following definition:
‘
“banned dog” means any of the dogs as specified in Schedule III;’;
(e)
by inserting after the definition of “licensed dog” the following definition:
‘
“microchip” means an encoded electronic devices implanted in a dog which contains the registration number of the dog;’; and
(f)
by inserting after the definition of “microchip” the following definition:
‘ “Microchip Certificate” means the certificate as specified in Schedule I;’.
Amendment of by-law 3 3.
The principal By-Laws are amended by substituting for by-law 3 the following by-law:
“Licensing of dogs 3.
(1)
No person shall own, keep, harbour or maintain any dog unless the dog is licensed pursuant to these By-Laws.
(2)
An application for a licence—

(a)
shall be made to the Commissioner in such form as may be determined by the Commissioner;
(b)
shall be accompanied by a fee of ten ringgit; and
(c)
in the case of restricted dog, shall be made after—
(i)
the applicant has undergone and passed the dog handling course; and
(ii) the dog has undergone and passed the “Canine Good
Citizen” course organized by anybody approved by the Commissioner.
(3)
The Commissioner may, after considering the application, approve or refuse the application.
(4)
Where an application for a licence is approved, the applicant shall cause his dog to be implanted with a microchip under by-law 3A.
(5)
A licence shall only be granted when the applicant—
(a)
produces the Microchip Certificate;
(b)
pays the annual fee as specified in Schedule V; and
(c)
in the case of restricted dog, produces a certificate showing that he has passed the dog handling course and his dog has passed the “Canine Good Citizen” course pursuant to subparagraph (2)(c).

(6)
A licence granted under this by-law shall be valid for a minimum period of one year and it may be issued for a maximum period up to three years and it shall be renewed on or before the period expired.
(7)
The fee paid under paragraph (2) is not refundable.”.
New by-laws 3A, 3B and 3C
4.
The principal By-Laws are amended by inserting after by-law 3 the following by-laws:
“Microchip implantation 3A.
(1)
The applicant under by-law 3 shall, upon receipt of approval of the application for licensing of his dog, bring his dog to a veterinary surgeon for microchip implantation.
(2)
A microchip implantation shall be performed by a veterinary surgeon approved by the Commissioner.
(3)
A microchip shall be implanted in a dog on the dorsal between midline cranial to the scapula of the dog.
(4)
The cost of microchip implantation shall be borne by the applicant.
(5)
A veterinary surgeon who has performed a microchip implantation shall issue a complete and signed Microchip Certificate to the applicant.
(6)
A veterinary surgeon shall, within one week after performing a microchip implantation on a dog, submit a copy of Microchip Certificate issued under paragraph (5) to the Commissioner.

Microchip and Microchip Certificate 3B.
(1)
For the purpose of microchip implantations, a veterinary surgeon shall use microchips and Microchip Certificates supplied by the Commissioner.
(2)
An veterinary surgeon may obtain the microchips and Microchip
Certificates from the Commissioner upon payment of a sum of money as may be determined by the Commissioner.
Renewal of licence 3C.
(1)
An application for renewal of licence—
(a)
shall be made to the Commissioner in such form as may be determined by the Commissioner and be accompanied by a fee of ten ringgit; and
(b)
shall be accompanied by the Microchip Certificate.
(2)
The Commissioner may, after considering the application, approve or refuse the application.
(3)
The fee paid under paragraph (1) is not refundable.”.
Amendment of by-law 4 5.
The principal By-Laws are amended by substituting for by-law 4 the following by-law:
“Register 4.
The Commissioner shall keep and maintain a register which contains the following particulars:
(a)
the address and particulars of the owner of the dog;

(b)
the breed , sex and age of the dog;
(c)
whether the dog has been spayed or castrated;
(d)
the place where the dog is kept;
(e)
the veterinary surgeon who has performed the microchip implantation;
(f)
the serial number of the Microchip Certificate and licence;
(g)
the validity period of licence; and
(h)
any other relevant particulars.”.
New by-laws 4A and 4B
6.
The principal By-Laws are amended by inserting after by-law 4 the following by-laws:
“Change of particulars 4A.
(1)
An owner of a dog shall, when there is any change in—
(a)
his address as stated in his licence;
(b)
the place where the dog is kept; or
(c)
any particular pertaining to his dog, immediately apply to the Commissioner to change such particulars.

(2)
An application for change of particulars under paragraph (1) shall be made to the Commissioner in such form as may be determined by the
Commissioner and be accompanied by a fee of ten ringgit.
(3)
Upon receiving an application under paragraph (2), the
Commissioner shall amend the particulars of the licence and enter the particulars in the register accordingly.
Production of licence 4B.
(1)
An owner of the dog shall keep the licence granted to him under by-law 3 and shall produce the licence for inspection when required by the
Commissioner.
(2)
Any owner who fails to produce the licence for inspection shall be guilty of an offence.”.
Deletion of by-laws 5 and 6 7.
The principal By-Laws are amended by deleting by-laws 5 and 6.
Amendment of by-law 7 8.
The principal By-Laws are amended by substituting for by-law 7 the following by-law:
“7.
(1)
Where the ownership of a licensed dog is changed, the licensing of the dog shall continue in force but the previous owner and the new owner shall within thirty days of the change of ownership apply for change of particulars of ownership to the Commissioner.
(2)
An application under paragraph (1) shall only be approved when—

(a)
the previous owner produces the licence and Microchip
Certificate issued to him;
(b)
the new owner pays a fee of ten ringgit; and
(c)
in the case of a licensed restricted dog, the new owner produces a certificate showing that he has undergone and passed the dog handling course organized by any body approved by the Commissioner.
(3)
Where an application under paragraph (1) is approved, the
Commissioner shall enter the name and address of the new owner in the licence and Microchip Certificate and shall amend the register accordingly.”.
New by-law 7A
9.
The principal By-Laws is amended by inserting after by-law 7 the following by-law:
“Lost, etc., of licensed dog 7A.
If a licensed dog is lost, dead or shifted out of the Federal Territory of
Kuala Lumpur, the owner of the dog shall immediately notify the Commissioner in writing.”.
Amendment of by-law 8 10.
By-Law 8 of the principal By-Laws is amended—
(a)
by inserting after paragraph (1) the following paragraphs:
“(1A) Notwithstanding paragraph (1), any person who intends to keep, harbour or maintain or allow to be kept, harboured or maintained

dogs more than the permissible number in his premises shall apply for the permission to the Commissioner.
(1B)
The Commissioner may, after considering the application, approve or refuse the application.
(1C)
A permission granted under this by-law may be subject to such conditions as the Commissioner thinks fit to impose.”; and
(b)
by substituting for the subparagraph 2(b) the following subparagraph:
“(b)
in any flat; or”.
New by-laws 8A, 8B and 8C
11. The principal By-Laws are amended by inserting after by-law 8 the following by-laws:
“Small dog in flat 8A.
Subject to by-law 3 and notwithstanding paragraph 8(2)(b), the
Commissioner may allow one small dog to be kept, harboured or maintained in a flat.
Prohibition of banned dog 8B.
(1)
Notwithstanding by-law 3, no person shall own, keep, harbour or maintain any banned dog.
(2)
The Commissioner shall seize and dispose of any banned dog found in any premises or found straying in a public place.
(3)
No compensation shall be payable by the Commissioner for the disposal of the dog.

Responsibilities of licensed owner of restricted dog 8C.
A person who is granted a licence to own, keep, harbour or maintain a restricted dog shall—
(a)
keep the dog under proper surveillance at all times;
(b)
ensure that the dog is leashed and muffled and under proper control at all times whenever it is taken out of the premises;
(c)
ensure that the dog does not stray out of the place where it is kept;
(d)
ensure that his premises is safely fenced and the fence is properly maintained at all times;
(e)
display at all times a “BEWARE OF DOG” sign in a prominent and conspicuous place at the front and back of his premises.”.
Amendment of by-law 12 12.
By-law 12 of the principal By-Laws is amended—
(a)
by inserting after paragraph (1) the following paragraph:
“(1A) Where complaints of incessant barking by a dog which causes a nuisance to the neighbourhood are received by the
Commissioner, the Commissioner may require the owner of the dog to take necessary steps to prevent such nuisance or order the owner of the dog to remove his dog to another place and within the period as may be specified by the Commissioner.”; and
(b)
by inserting after paragraph (2) the following paragraph:

“(2A) Where a dog defecates in a public place or on a land or premises other than that occupied by the owner, the owner of the dog shall remove the faeces immediately and dispose of the faeces in a way that does not cause a nuisance.”.
Amendment of by-law 16 13.
The principal By-Laws are amended in by-law 16—
(a)
in paragraph (1), by substituting for the word “I” the words “VI”; and
(b)
in paragraph (2), by deleting the words “by the badge it wears”.
Amendment of by-law 16A
14.
By-law 16A of the principal By-Laws is amended by substituting for subparagraph (4)(ii) the following subparagraph:
“(ii)
upon an application for a licence pursuant to by-law 3.”.
Amendment of by-law 18 15.
Paragraph 18(1) of the principal By-Laws is amended by substituting for the words “II” the words “VII”.
Amendment of Schedules I and II
16.
The principal By-Laws are amended by substituting for Schedules I and II the following Schedules:
