“Menteri” ertinya Menteri yang dipertanggungkan dengan tanggungjawab bagi tanah di Wilayah Persekutuan Kuala Lumpur;

Tiap-tiap permohonan, selain permohonan yang borangnya telah ditetapkan dalam Jadual Pertama Akta, hendaklah dibuat secara bertulis dalam borang yang ditetapkan dalam Jadual II.

permohonan oleh mana-mana pihak berkuasa awam untuk memecah bahagi bangunan kos rendah; atau

permohonan oleh mana-mana pihak berkuasa awam untuk mengklasifikasikan bangunan bertingkat sebagai suatu bangunan kos rendah dan pengeluaran perakuan dalam Jadual V; dan

Menteri boleh, dalam mana-mana kes tertentu atau berkenaan dengan mana-mana kawasan tertentu, memberi pengecualian sebahagian atau keseluruhan bayaran fi yang ditetapkan.

Permohonan di bawah seksyen 9B Akta untuk mengklasifikasikan mana-mana bangunan sebagai bangunan kos rendah hendaklah dibuat oleh pemilik tanah beri hakmilik kepada Menteri dengan menggunakan Borang A Jadual II.

Jika Menteri berpuas hati dengan permohonan di bawah subkaedah (1)

dan meluluskan permohonan itu, Menteri hendaklah mengeluarkan suatu perakuan kepada pemilik tanah beri hakmilik itu sebagaimana yang dinyatakan dalam Jadual V.

Bangunan yang diklasifikasikan sebagai bangunan khas

Menteri boleh mengklasifikasikan mana-mana bangunan sebagai bangunan khas berdasarkan jenis atau hal keadaan bangunan itu dalam meluluskan suatu permohonan hakmilik strata.

Menteri boleh memberikan apa-apa pengecualian atau menetapkan apa-apa syarat yang difikirkan perlu dalam mengklasifikasikan mana-mana bangunan sebagai bangunan khas.

Pemilik asal hendaklah mencadangkan unit syer yang saksama sebagaimana yang dinyatakan dalam perenggan 10(1)(h) Akta.

Pemilik asal hendaklah membuat suatu permohonan kepada Pengarah

Tanah dan Galian untuk mendapatkan Sijil Formula Unit Syer dengan menggunakan

Borang B Jadual II.

Permohonan yang disebut dalam subkaedah (2) hendaklah mematuhi apa-apa syarat sebagaimana yang ditentukan oleh Pengarah Tanah dan Galian.

Sekiranya Pengarah Tanah dan Galian berpuas hati dengan permohonan di bawah subkaedah (2) dan meluluskan permohonan itu, Pengarah Tanah dan Galian hendaklah mengeluarkan sijil sebagaimana yang dinyatakan dalam Jadual III.

Sekiranya terdapat perubahan pada pelan bangunan yang telah diluluskan oleh pihak berkuasa tempatan atau perubahan pada unit syer atau kedua-duanya yang sijil telah dikeluarkan di bawah subkaedah (4), pemilik asal itu hendaklah membuat suatu permohonan yang baharu kepada Pengarah Tanah dan Galian untuk kelulusan dan sijil baharu akan dikeluarkan.

Walau apa pun subkaedah (2), Pengarah Tanah dan Galian boleh memberikan pengecualian kepada mana-mana pemilik asal daripada kehendak untuk memohon Sijil Formula Unit Syer dalam hal keadaan yang difikirkannya perlu.

Notis memohon deposit sebagaimana yang dikehendaki di bawah perenggan 10(2)(c) Akta hendaklah dibuat dengan menggunakan Borang C Jadual II.

Tiap-tiap pembayaran deposit hendaklah disertakan dengan surat sebagaimana yang dinyatakan dalam Borang D Jadual II.

Daftarai strata 10.

Daftarai strata hendaklah mengandungi suatu daftar untuk merekodkan butir-butir yang berhubungan dengan petak individu dan blok sementara

(jika berkaitan) dan daftarai strata itu hendaklah dibuat dengan menggunakan

Permohonan untuk semakan daftarai strata, oleh perbadanan pengurusan yang ditubuhkan di bawah seksyen 39 Akta, hanya boleh dibuat satu kali dalam setahun.

Pembatalan dan kecualian 11.

Kaedah-Kaedah Hakmilik Strata (Wilayah Persekutuan Kuala Lumpur)

1988 [P.U. (A) 164/1988], yang disebut “Kaedah-Kaedah yang dibatalkan” dalam kaedah ini, dibatalkan.

Apa-apa permohonan atau perkara lain yang sedang dalam tindakan untuk diluluskan atau yang telah diluluskan tetapi tiada hakmilik strata dikeluarkan lagi, sebaik sebelum tarikh permulaan kuat kuasa Kaedah-Kaedah ini, hendaklah selepas

permulaan kuat kuasa Kaedah-Kaedah ini diteruskan atau diselesaikan di bawah dan mengikut peruntukan Kaedah-Kaedah yang dibatalkan.

FORMULA UNIT SYER

Unit syer bagi petak adalah keluasan petak didarabkan dengan faktor pemberat bagi jenis petak dan faktor pemberat bagi keseluruhan petak lantai. Sekiranya terdapat mana-mana petak aksesori, keluasan petak aksesori didarabkan dengan faktor pemberat bagi petak aksesori itu.

Sekiranya terdapat lebih daripada satu petak aksesori, pengiraan formula hendaklah terpakai bagi setiap petak aksesori dan kemudiannya hendaklah ditambahkan. Kedua-dua nilai bagi petak dan petak aksesori hendaklah ditambahkan bagi mendapatkan jumlah unit syer.

Formula pengiraan adalah seperti yang berikut:

Unit syer bagi petak = (A x F1 x F2) + (B x F3)

Unit syer bagi petak tanah = (A x 0.8) + (B x F3)

iaitu,

(a)

A adalah keluasan petak;

(b)

B adalah keluasan petak aksesori;

(c)

F1 adalah pemberat bagi jenis petak seperti yang dinyatakan dalam

Jadual A;

(d)

F2 adalah pemberat bagi keseluruhan petak lantai seperti yang dinyatakan dalam Jadual B; dan

STRATA TITLES

(FEDERAL TERRITORY OF KUALA LUMPUR) RULES 2015

IN exercise of the powers conferred by section 81 of the Strata Titles Act 1985

[Act 318], the Minister makes the following rules:

Citation and commencement 1.

(1)

These rules may be cited as the Strata Titles (Federal Territory of Kuala

Lumpur) Rules 2015.

(2)

These Rules come into operation on 18 June 2015.

Interpretation 2.

In these Rules—

“share unit formula” means the formula used to calculate a share unit as specified in Schedule IV.

“Minister” means the Minister charged with the responsibility for land in the

Federal Territory of Kuala Lumpur;

Application 3.

Every application, other than an application for which a form has been prescribed in the First Schedule to the Act, shall be made in writing in the forms prescribed in

Schedule II.

Fees 4.

(1)

The fees payable for various applications and actions under the Act and these Rules shall be as specified in Schedule I.

(2)

Where the fees payable for the application and action specified in subrule (1) has been prescribed under the Federal Territory of Kuala Lumpur Land

P.U. (A) 127 30

Rules 1995, the fees prescribed under the Federal Territory of Kuala Lumpur Land Rules 1995 shall be applicable and payable as if they are prescribed under these Rules.

(3)

Notwithstanding subrules (1) and (2)—

(a)

no fees shall be payable in respect of—

(i)

application by any public authority to subdivide a low-cost building; or

(ii)

application by any public authority to classify multi-storey building as a low-cost building and the issuance of such certificate in Schedule V; and

(b)

The Minister may, in any particular case or in respect of any particular area, grant partial or total exemption from the payment of the prescribed fees.

(4)

For the purpose of these Rules, “public authority” means the Federal

Government or local authorities.

Buildings classified as low-cost buildings 5.

(1)

An application under section 9B of the Act to classify any building as a low-cost building shall be made by the proprietor of the alienated land to the Minister by using Form A of Schedule II.

(2)

If the Minister is satisfied with the application under subrule (1) and approves such application, the Minister shall issue a certificate to the proprietor of the alienated land as specified in Schedule V.

Buildings classified as special buildings 6.

(1)

The Minister may classify any building as a special building based on the type or the condition of such building in approving the application for strata title.

(2)

The Minister may grant any exemption or to impose any conditions as he deems fit in classifying any building as a special building.

Application for the Certificate of Share Unit Formula 7.

(1)

The original proprietor shall propose an equitable share units as specified in paragraph 10(1)(h) of the Act.

(2)

The original proprietor shall make an application to the Director of Lands and Mines to obtain a Certificate of Share Unit Formula by using Form B of Schedule II.

(3)

The application mentioned in subrule (2) shall comply with the conditions as determined by the Director of Lands and Mines.

(4)

If the Director of Lands and Mines is satisfied with the application under subrule (2) and approves such application, the Director of Lands and Mines shall issue a certificate as specified in Schedule III.

(5)

If there are changes to the building plan that has been approved by the local authority or there are changes to the share units or to both whereby a certificate has been issued under subrule (4), the original proprietor shall make a new application to the Director of Lands and Mines for approval and a new certificate will be issued.

(6)

Notwithstanding subrule (2), the Director of Lands and Mines may grant an exemption to any original proprietor from the requirement of applying for the

Certificate of Share Unit Formula in circumstances he thinks necessary.

Share unit formula 8.

(1)

All applications for subdivision of building or land shall apply the calculation for share unit formula specified in Schedule IV.

(2)

Notwithstanding subrule (1), the Director of Lands and Mines may grant an exemption for calculation for share unit formula as specified in Schedule IV.

Deposit 9.

(1)

The notice to demand for a deposit as required under paragraph 10(2)(c)

of the Act shall be made using Form C of Schedule II.

(2)

Every payment of deposit shall be accompanied with a letter as specified in Form D of Schedule II.

Strata roll 10.

(1)

Strata roll shall contain a register to record particulars relating to individual parcels and temporary block (where applicable) and shall be made using

Form E of Schedule II.

(2)

Strata roll application for review, by the management corporation established under section 39 of the Act, may only be made once a year.

Revocation and savings 11.

(1)

Strata Titles (Federal Territory of Kuala Lumpur) Rules 1988

[P.U. (A) 164/1988], which is referred to as “the revoked Rules” in this rule is revoked.

(2)

Any application or other matters that were in a course of being approved or had been approved but no strata titles had been issued, immediately before the commencement of these Rules, shall after the commencement of these Rules be continued or concluded under and in accordance with the provisions of the revoked

Rules.

SHARE UNIT FORMULA

The share units of a parcel are the area of that parcel multiplied by the weightage factor for that type of parcel and the weightage factor for the entire floor parcel. If there is any accessory parcel, the area of the accessory parcel is multiplied by a weightage factor for that accessory parcel.

If there is more than one accessory parcels, the formula for calculation shall be applicable to each accessory parcel and it shall then be added accordingly. Both the value of the parcel and the accessory parcel shall be added to determine the total share units.

The calculation formula is as follows:

Share units of parcel = (A x F1 x F2) + (B x F3)

Share units of land parcel = (A x 0.8) + (B x F3)
