Kaedah-Kaedah Juruukur Bahan 1973 [P.U. (A) 366/1973], yang disebut
“Kaedah-Kaedah ibu” dalam Kaedah-Kaedah ini, dipinda dengan menggantikan perkataan “Juruukur Bahan berdaftar, siswazah berdaftar atau berdaftar sementara” di mana-mana jua terdapat dengan perkataan “Juruukur Bahan Perunding, Juruukur
Bahan Profesional, Juruukur Bahan Sementara dan Juruteknologi Ukur Bahan”.
Pindaan kaedah 2
Kaedah 2 Kaedah-Kaedah ibu dipinda dalam takrif “poin kredit” dan “program-program CPD” dengan menggantikan perkataan “program-program CPD” dengan perkataan “Program CPD”.
Pindaan kaedah 4
Kaedah-Kaedah ibu dipinda dengan memasukkan selepas subkaedah (1) subkaedah yang berikut:
“(1A) Walau apa pun subkaedah (1), dalam keadaan luar biasa, Yang
Dipertua boleh meminta Pendaftar untuk memberikan notis bertulis tidak kurang daripada tiga hari untuk memanggil suatu mesyuarat.”.

Penggantian kaedah 17 8.
Kaedah-Kaedah ibu dipinda dengan menggantikan kaedah 17 dengan kaedah yang berikut:
“Permohonan bagi pendaftaran.
Seseorang yang berhasrat untuk didaftarkan sebagai—
Juruteknologi Ukur Bahan di bawah seksyen 10A Akta, boleh membuat pemohonan kepada Lembaga mengikut
Kaedah-Kaedah ini.”.

Kaedah baharu 17A dan 17B
Kaedah-Kaedah ibu dipinda dengan memasukkan selepas kaedah 17 kaedah yang berikut:
“Kehadiran fizikal dalam Malaysia.
Alamat tetap.
Seseorang pemohon bagi pendaftaran di bawah kaedah 17
hendaklah hadir secara fizikal dalam Malaysia tidak kurang daripada satu ratus lapan puluh tiga hari dalam tempoh dua belas bulan sebelum permohonan.
Seseorang pemohon bagi pendaftaran di bawah kaedah 17 dan seseorang orang berdaftar di bawah subseksyen 10(1),
10(2), 10(3) atau seksyen 10A Akta hendaklah mempunyai alamat tetap di Malaysia.”.

Kaedah 23A Kaedah-Kaedah ibu dipinda dengan menggantikan perkataan “Borang C atau D atau D1, mengikut mana-mana yang berkenaan” dengan perkataan “borang sebagaimana yang ditentukan oleh Lembaga”.
Penggantian kaedah 23C
Kaedah-Kaedah ibu dipinda dengan menggantikan kaedah 23C dengan kaedah yang berikut:
“Perakuan pemasukan semula.
Jika Lembaga memasukkan semula seseorang sebagai
Juruukur Bahan Perunding, Juruukur Bahan Profesional,
Juruukur Bahan Sementara atau Juruteknologi Ukur Bahan,
Pendaftar hendaklah mengeluarkan perakuan pemasukan semula dalam borang sebagaimana yang ditentukan oleh
Lembaga.”.
Penggantian kaedah 24 16.

“Kehendak bagi pendaftaran sebagai
Juruukur Bahan
Profesional,

Jawatankuasa Tatatertib hendaklah mengemukakan laporan itu kepada Lembaga berserta dengan rekod prosiding tatatertib dalam tempoh dua bulan dari tarikh tamat prosiding tatatertib itu.

boleh, atas permohonan secara bertulis oleh Pengerusi

Apabila menerima sesuatu aduan, jika Panel
Penyelesaian Pertikaian memutuskan untuk mengadakan pendengaran,

Pertikaian hendaklah mengemukakan notis pendengaran yang menyatakan tarikh, masa dan tempat pendengaran itu kepada pengadu dan
Juruukur Bahan Perunding, Juruukur Bahan Profesional,
Juruukur Bahan Sementara, Juruteknologi Ukur Bahan atau
Firma Juruukur Bahan Perunding, mengikut mana-mana yang berkenaan, melalui pos berdaftar atau pos prabayar ke alamatnya yang akhir diketahui.
Panel Penyelesaian Pertikaian boleh menangguhkan pendengaran dari semasa ke semasa, dan tiada notis bertulis mengenai penangguhan dikehendaki untuk disampaikan kepada mana-mana pihak jika penangguhan itu dibuat semasa kehadiran pihak itu.
Tertakluk kepada peruntukan Akta dan Kaedah-Kaedah ini, Panel Penyelesaian Pertikaian boleh mengawal selia tatacaranya sendiri bagi pendengaran sesuatu aduan mengikut apa-apa cara yang difikirkan patut.
Panel Penyelesaian Pertikaian hendaklah membuat suatu laporan yang menyatakan fakta dan penentuan sesuatu aduan dan laporan itu hendaklah ditandatangani oleh

Pertikaian hendaklah mengemukakan laporan kepada Lembaga berserta dengan rekod prosiding penyelesaian pertikaian dalam tempoh dua bulan dari tarikh tamat prosiding penyelesaian pertikaian itu.

Perunding boleh membuat permohonan bagi kelulusan untuk menjalankan amalan di bawah seksyen 7B Akta kepada Lembaga dalam borang sebagaimana yang ditentukan oleh Lembaga”; dan

“(b) pengarah pertubuhan perbadanan yang bertanggungjawab untuk memberikan perkhidmatan Juruukur Bahan perunding hendaklah merupakan Juruukur Bahan Perunding”.

“Pembaharuan permit untuk menjalankan amalan.
Sesuatu firma atau pertubuhan perbadanan yang menjalankan amalan sebagai suatu Amalan Juruukur Bahan
Perunding di bawah seksyen 7A Akta atau pertubuhan perbadanan yang menjalankan amalan sebagai suatu Amalan
Juruukur Bahan Perunding di bawah seksyen 7B Akta boleh membaharui permit untuk menjalankan amalan dengan membuat permohonan kepada Lembaga.”.

Perunding, Pendaftar hendaklah mengeluarkan permit kepada pertubuhan perbadanan itu dalam borang sebagaimana yang ditentukan oleh Lembaga.”;
dengan menggantikan perkataan “Juruukur Bahan perunding”
dengan perkataan “suatu Amalan Juruukur Bahan Perunding”; dan
dengan menggantikan perkataan “Borang I” dengan perkataan
“borang sebagaimana yang ditentukan oleh Lembaga”; dan
dengan menggantikan subkaedah (4) dengan subkaedah berikut:
“(4) Apabila dimasukkan semula suatu pertubuhan perbadanan yang memberikan kombinasi perkhidmatan yang terdiri daripada perkhidmatan Juruukur Bahan perunding, perkhidmatan kejuruteraan profesional atau perkhidmatan perundingan seni bina untuk menjalankan amalan sebagai suatu Amalan Juruukur Bahan Perunding, Pendaftar hendaklah mengeluarkan kepada pertubuhan perbadanan itu suatu

permit kemasukan semula untuk menjalankan amalan dalam borang sebagaimana yang ditentukan oleh Lembaga.”.

QUANTITY SURVEYORS (AMENDMENT) RULES 2016
IN exercise of the powers conferred by section 26 of the Quantity Surveyors
Act 1967 [Act 487], the Board of Quantity Surveyors, with the approval of the Minister, makes the following rules:
Citation and commencement 1.
(1)
These rules may be cited as the Quantity Surveyors (Amendment)
Rules 2016.
(2)
These Rules come into operation on 30 January 2016.
General amendments 2.
The Quantity Surveyors Rules 1973 [P.U. (A) 366/1973], which are referred to as the “principal Rules” in these Rules, are amended by substituting for the words
“registered, registered graduate or temporary registered Quantity Surveyor” wherever appearing the words “Consultant Quantity Surveyor, Professional Quantity Surveyor,
Provisional Quantity Surveyor and Quantity Surveying Technologist”.
Amendment of rule 2 3.
Rule 2 of the principal Rules is amended in the definition of “credit points” and
“CPD programmes” by substituting for the words “CPD programmes” the words “CPD
Programme”.
Amendment of rule 4 4.
Rule 4 of the principal Rules is amended by inserting after subrule (1) the following subrule:
“(1A) Notwithstanding subrule (1), in exceptional circumstances, the
President may request the Registrar to give a written notice of not less than three days to convene a meeting.”.

“Application for registration.
17. A person desirous of being registered as—
a Provisional Quantity Surveyor under subsection 10(1) of the Act;
a
Professional
Quantity
Surveyor under subsection 10(2) of the Act;
a Consultant Quantity Surveyor under subsection 10(3) of the Act; or
a Quantity Surveying Technologist under section 10A of the Act, may make an application to the Board in accordance with these Rules.”.

The principal Rules are amended by inserting after rule 17 the following rules:
“Physical presence in
Malaysia.
17A. An applicant for registration under rule 17 shall be physically present in Malaysia not less than one hundred an eighty-three days in the twelve months period prior to the application.
Permanent address.
17B. An applicant for registration under rule 17 and a person registered under subsection 10(1), 10(2) or 10(3) or section 10A of the Act shall have a permanent address in Malaysia.”.
Amendment of rule 18 10.
Rule 18 of the principal Rules is amended by substituting for the word
“four” the word “three”.
Amendment of rule 21 11.
Rule 21 of the principal Rules is amended by substituting for the words
“Form C or D or D1” the words “Form CQS-B, PQS-B, ProvQS-B or QST-B.”.
Amendment of rule 22A

Rule 22A of the principal Rules is amended by substituting for the words “CPD programmes” the words “CPD Programme”.
New rule 22B
13.
The principal Rules are amended by inserting after rule 22A the following rule:
“Removal from Register.

The Board may remove from the Register any
Consultant Quantity Surveyor, Professional Quantity

Surveying Technologist whose application for renewal of registration is rejected by the Board under subrule 22(2).”.

Rule 23A of the principal Rules is amended by substituting for the words “Form C or D or D1, as the case may be” the words “the form as may be determined by the Board”.
Substitution of rule 23C
15.
The principal Rules are amended by substituting for rule 23C the following rule:
“Certificate of reinstatement.
23C. If the Board reinstates a person as a Consultant Quantity
Surveyor, Professional Quantity Surveyor, Provisional Quantity
Surveyor or Quantity Surveying Technologist, the Registrar shall issue a certificate of reinstatement in the form as may be determined by the Board.”.
Substitution of rule 24 16.
The principal Rules are amended by substituting for rule 24 the following rule:

24. (1) An applicant for registration as a Professional
Quantity Surveyor or Consultant Quantity Surveyor under subsections 10(2) or (3) of the Act respectively shall—
(a)
obtain the practical experience referred to in paragraphs 10(1)(b) and 10(3)(c) of the Act in accordance with the Guidelines to
Registration of Quantity Surveyors and
Consulting Quantity Surveying Practice; and

(b)
pass the test of professional competence or other tests or professional assessment conducted or sanctioned by the Board.
An application for registration under subsections 10(2) and (3) of the Act shall be submitted together with documentary proof that the requirements of paragraphs
(a) and (b) have been complied with.
An applicant for registration as a Quantity
Surveying Technologist under subsection 10A(2) of the Act shall comply with the requirements specified in the
Guideline to the Registration of Quantity Surveyors and
Consulting Quantity Surveying Practice.”.
Amendment of rule 24A
17.
Rule 24A of the principal Rules is amended—
(a)
in subrule (1), by inserting after the word “qualifications” the words
“offered by the institutions of higher learning or other relevant institutions”; and
(b)
in subrule (2)—
(i)
by substituting for the words “registered Quantity Surveyor”
wherever appearing the words
“Professional
Quantity
Surveyor or Consultant Quantity Surveyor”;
(ii)
in the English language text, by substituting for the words

The principal Rules are amended by inserting after rule 24A the following rule:

The Board may appoint a Quantity Surveying
Examination Council for the purpose of conducting examinations as may be determined by the Board.
The Quantity Surveying Examination Council shall comprise the following members:
(a)
a Chairman who shall be a Professional Quantity
Surveyor or Consultant Quantity Surveyor and who is a member of the Board;
(b)
four Professional Quantity Surveyors or Consultant
Quantity
Surveyors from the public services department;
“Quantity
Surveying
Examination
Council.

The Disciplinary Committee shall submit the report to the Board together with the record of the disciplinary proceedings within two months from the date of conclusion of the disciplinary proceedings.
The period prescribed in subrule (1B) may, upon an application in writing made by the Chairman of the

Hearing before

Panel.
35I. (1) The Dispute Resolution Panel appointed under section 14B of the Act shall meet at the premises of the Board or at such other place on such date and time as the Chairman of the Dispute Resolution Panel may determine.
Upon receiving a complaint, if the Dispute
Resolution Panel decides to hold a hearing, the Dispute
Resolution Panel shall send a notice of hearing specifying the date, time and place of the hearing to the complainant and

The Dispute Resolution Panel may adjourn the hearing from time to time, and no written notice of an adjournment is required to be given to any party when the adjournment is made in the presence of the party.
(4)
Subject to the provisions of the Act and these
Rules, the Dispute Resolution Panel may regulate its own procedures for the hearing of a complaint in such manner as it deems fit.
The Dispute Resolution Panel shall keep record of all of its proceedings.
The Dispute Resolution Panel shall make a report stating the facts and its determination of a complaint and the report shall be signed by the Chairman of the Dispute
Resolution Panel and the members of the Dispute Resolution
Panel.

Surveying Practice must possess the necessary expertise and shall be physically present in Malaysia for a period of not less than one hundred and eighty-three days in any one calendar year.”;

PENALTY

Any person, firm or body corporate who procures or attempts to procure registration or approval or a certificate of registration or a permit to practise under this Act by knowingly making or producing or causing to be made or produced any false or fraudulent declaration, certificate, permit, application or representation whether in writing or otherwise shall be guilty of an offence under this Act and shall be liable on conviction to a fine not exceeding fifty thousand ringgit or to imprisonment for a term not exceeding three years or to both, and, in the case of a continuing offence, to a further fine of five hundred ringgit for each day during which the offence continues after conviction; and
