- PADA menjalankan kuasa yang diberikan oleh seksyen 73 Akta Kumpulan Wang Simpanan Pekerja 1991 [Akta 452], Lembaga membuat kaedah-kaedah yang berikut: Nama dan permulaan kuat kuasa

dengan memasukkan selepas subkaedah
(10E)
subkaedah yang berikut:
“(10F) (a) Jika notis pengeluaran dibuat di bawah perenggan 54(6)(k) Akta atas alasan bahawa ahli Kumpulan Wang memerlukan pembiayaan kelestarian hidup, Lembaga boleh membenarkan pembayaran dari
Akaun II ahli Kumpulan Wang itu sekiranya—
(i)
notis pengeluaran diterima daripada ahli Kumpulan Wang itu pada bila-bila masa antara 1 April 2020 hingga 31 Mac 2021;
(ii)
amaun pembayaran adalah tidak kurang daripada lima puluh ringgit dan tidak melebihi lima ratus ringgit sebulan;
(iii)
jumlah bilangan pembayaran kepada ahli Kumpulan Wang itu tidak melebihi dua belas kali dari tarikh notis pengeluaran diterima; dan

(b)
ahli Kumpulan Wang yang telah membuat notis pengeluaran di bawah perenggan (a) boleh memohon kepada Lembaga untuk membatalkan notis pengeluaran itu atau mengubah amaun pengeluaran pada bila-bila masa sebelum 31 Mac 2021; dan
(c)
setelah notis pengeluaran yang terdahulu dibatalkan, ahli Kumpulan Wang boleh memberi notis pengeluaran yang baharu di bawah perenggan (a) pada bila-bila masa sebelum 31 Mac 2021.”.

EMPLOYEES PROVIDENT FUND (AMENDMENT) RULES 2020
Opening note
Preamble
- IN exercise of the powers conferred by section 73 of the Employees Provident Fund Act 1991 [Act 452], the Board makes the following rules: Citation and commencement 1.
(1)
These rules may be cited as the Employees Provident Fund
(Amendment) Rules 2020.
(2)
These Rules are deemed to have come into operation on 1 April 2020.
Amendment of rule 41 2.
The Employees Provident Fund Rules 1991 [P.U. (A) 493/1991] are amended in rule 41 by inserting after subrule (10E) the following subrule:
“(10F) (a) Where a notice of withdrawal is made under paragraph 54(6)(k) of the Act on the ground that the member of the Fund requires financing for the purpose of sustainable living, the Board may allow payment from Account II of the member of the Fund if—
(i)
the notice of withdrawal is received from the member of the
Fund at any time between 1 April 2020 to 31 March 2021;
(ii)
the amount of payment is not less than fifty ringgit and not exceeding five hundred ringgit per month;
(iii)
the total number of payments to the member of the Fund shall not exceed twelve times from the date of the notice of withdrawal is received; and
(iv)
the payment is only for the months after the notice of withdrawal is received;

(b)
the member of the Fund that has made a notice of withdrawal under paragraph (a) may request to the Board to revoke the notice of withdrawal or to vary the withdrawal amount at any time before 31 March 2021; and
(c)
after the former notice of withdrawal has been revoked, the member of the Fund may make a new notice of withdrawal under paragraph (a) at any time before 31 March 2021.”.
