hendaklah dihantar oleh perayu kepada Pejabat Pendaftaran

Mahkamah Tinggi. Rayuan itu hendaklah disifatkan telah ditarik balik dan hendaklah dipotong daripada senarai rayuan oleh Pendaftar dan apa-apa jumlah wang yang diserahsimpan dalam Mahkamah sebagai jaminan kos rayuan itu hendaklah dibayar kepada perayu.”;

RULES OF THE COURT OF APPEAL (AMENDMENT) 2026

  1. IN exercise of the powers conferred by section 17 of the Courts of Judicature Act 1964 [Act 91] and with the consent of the Chief Justice, the Rules Committee makes the following rules: Citation 1. These rules may be cited as the Rules of the Court of Appeal (Amendment) 2026. Amendment of rule 9 2. The Rules of the Court of Appeal 1994 [P.U. (A) 524/1994], which are referred to as the “principal Rules” in these Rules, are amended in rule 9—

(b)

by substituting for subrule (3) the following subrule:

“(3)

If all parties to the appeal consent to the intended withdrawal of the appeal, the appellant may file the documents signifying such consent and signed by the parties or by their solicitors in the Registry and at the same time one copy of such notice under subrule (1) shall be sent by the appellant to the Registry of the High Court. The appeal shall be deemed to have been withdrawn and shall be struck out of the list of appeals by the Registrar and any sum lodged in Court as security for the costs of the appeal shall be paid out to the appellant.”;

by inserting after subrule (3) the following subrule:

“(3A) In the event the respondent is not legally represented and cannot be located resulting in the notice under subrule (1) unsigned,

the appeal shall be withdrawn before the Court with the proof of service of such notice being tendered.”; and

The Registrar shall notify the Registry of the High Court of such withdrawal.”.

Amendment of rule 17 3.

Rule 17 of the principal Rules is amended—

by substituting for subrule (4) the following subrule:

“(4)

The Registrar of the High Court shall on receiving the notice of appeal and the prescribed fee required by subrule (1) being lodged in Court enter the appeal in the list of appeals, stating therein the title of the cause or matter, the name of the appellant and his solicitors, if any, and the date of such entry, and shall inform the Registrar at Putrajaya of such entry.”.

Amendment of rule 18 4.

Subrule 18(3) of the principal Rules is amended by inserting after the words “First Schedule” the words “and signed by the appellant or the appellant’s solicitor”.

Amendment of rule 22 5.

Rule 22 of the principal Rules is amended by inserting after the word “President”

the words “of the Court of Appeal, by filing a Certificate of Urgency with a prescribed fee,”.

Amendment of rule 27 6.

Subrule 27(2) of the principal Rules is amended by inserting after the words

“First Schedule” the words “and signed by the applicant or the applicant’s solicitor”.

Amendment of rule 28 7.

Rule 28 of the principal Rules is amended—

by substituting for subrule (3) the following subrule:

“(3)

All applications shall be made by filing one copy of the notice of motion and of every affidavit intended to be used in support thereof.

A copy of the said documents shall be filed in the Registry and served to the

Registry of the

High

Court at the place where the judgment, order or decision complained of was given or made.

Copies of such application and affidavits shall at the same time be served on all necessary parties. The Registrar shall follow a procedure similar so far as possible to the procedure relating to the entry of appeals.

On receipt from the Registrar of information regarding the number of the application and in cases coming within subrule (4) the information on the place and date of hearing, the applicant's solicitor shall immediately notify the respondents to the application or their solicitors.”; and

by substituting for subrule (4) the following subrule:

“(4)

At the time of filing any application, the appellant's solicitor may, in the case of urgency, apply in writing to the President of the Court of Appeal, by filing a Certificate of Urgency with a prescribed fee, who, if satisfied that it is a proper case for an urgent hearing of the application, may order the application to be heard at such time convenient to the Court but may require the applicant to give security for the respondent's costs of the application.”.

Amendment of rule 58 8.

Subrule 58(1) of the principal Rules is amended by substituting for the words

“a Notice of Appeal and eight copies thereof. A copy of the Notice of Appeal shall be sent by the appellant to the Registrar of the Court of Appeal.” the words “a Notice of Appeal.”.

Amendment of rule 59 9.

Subrule 59(2) of the principal Rules is amended—

by substituting for the words “deliver the same or send the same by registered post to the Registry of the High Court at the place where the decision appealed against was given, and a copy to the Registrar of the Court of Appeal” the words “file the same to the Registry of the

Amendment of rule 60 10.

Rule 60 of the principal Rules is amended by substituting for the words

“such Notice and three copies thereof to the Registrar of the Court at Putrajaya and shall send one copy thereof to the respondent” the words “such Notice of Appeal to the Registrar at Putrajaya and shall send such Notice of Appeal to the respondent”.

Amendment of rule 61 11.

Rule 61 of the principal Rules is amended—

Rule 69 of the principal Rules is amended—

by substituting for subrule (1) the following subrule:

“(1)

All applications to the Court in pending appeals shall be made by filing the Notice of Motion and every affidavit intended to be used in support thereof. Sufficient copies of the documents shall be filed in the Registry with a copy to be forwarded to the High Court at the place where the judgment, order or decision complained of was given or made.

Copies of such application and affidavits shall at the same time be sent to all necessary parties.”; and

in subrule (2), by deleting the words “and the Registrar of the High Court”.

Rule 73 of the principal Rules is amended by substituting for subrule (1)

Where an appellant, at any time before the commencement of the hearing, wishes to withdraw or discontinue his appeal, he may do so without the leave of the Court by filing with the Registrar a notice in Form 11

in the First Schedule and the Registrar shall notify the Registry of the High Court of such withdrawal.”.

Amendment of rule 81 16.

Rule 81 of the principal Rules is amended by inserting after the words

“in writing” the words “or through electronic filing”.

Substitution of rule 89 17.

The principal Rules is amended by substituting for rule 89 the following rule:
