6. Fi untuk kajian kebolehlaksanaan:

Fi yang dikenakan hendaklah berdasarkan kepada ruang lingkup kerja dan adalah tertakluk kepada budi bicara Ketua Pengarah yang boleh menggunakan skala fi bagi penilaian modal sebagai panduan.

Fi yang dikenakan hendaklah ditetapkan dan dipersetujui oleh klien sebelum kerja dimulakan.

7. Fi untuk perundingan:

Fi hendaklah dihitung pada kadar RM200 sejam atau sebahagian daripadanya.

8. Fi untuk penilaian pelelongan:

Fi hendaklah berdasarkan kepada skala fi bagi penilaian modal dan fi maksimum yang boleh dikenakan adalah RM20,000.

9. Fi untuk pengurusan harta:

(a)

fi bulanan:

(i)

3.0% daripada terimaan kasar atas RM50,000 yang pertama;

(ii)

2.0% daripada terimaan kasar ke atas bakinya sehingga RM100,000; dan

(iii)

1.0% daripada terimaan kasar yang melebihi RM100,000;

(b)

fi minimum: RM25 bagi setiap unit boleh disewa; dan

(c)

fi maksimum: RM20,000.

“terimaan kasar” ertinya sewa yang ditetapkan dalam pemajakan atau penyewaan tambah apa-apa terimaan sampingan yang dipungut atau diambil kira atau kedua-duanya dalam menjalankan pengurusan.

10. Fi untuk penjualan atau pembelian dalam agensi harta tanah:

1.5% atas harga yang diuruskan tertakluk kepada fi minimum sebanyak RM200 dan fi maksimum yang boleh dikenakan adalah RM20,000.

11. Fi untuk penyewaan dalam agensi harta tanah:

Tempoh

Jika penyewaan adalah untuk 12 bulan atau lebih

Sewa satu bulan

Jika penyewaan adalah berdasarkan penyewaan bulanan

Sewa setengah bulan

Jika sewa berbentuk sewa progresif, fi adalah berdasarkan kepada sewa purata bagi tempoh yang dikontrakkan di bawah terma penyewaan. Fi maksimum yang boleh dikenakan adalah RM20,000.

12. Fi untuk penilaian pinjaman perumahan bagi pihak berkuasa tempatan dan badan berkanun:

(a)

RM1.00 bagi tiap-tiap RM1,000 atau sebahagian daripadanya bagi pinjaman yang diminta, tertakluk kepada fi minimum sebanyak RM50.00.

(b)

RM2.00 bagi tiap-tiap RM1,000 atau sebahagian daripadanya bagi jumlah yang dikehendaki dalam mana-mana permintaan berikutnya bagi penilaian untuk kerja atau pinjaman tambahan, tertakluk kepada fi minimum sebanyak RM50.00.

13. Pembayaran Tambahan

Kecuali bagi subperenggan 5(b) dan perenggan 12, sebagai tambahan kepada fi yang dinyatakan di atas caj yang berikut hendaklah dikenakan:

(a)

pengangkutan dan perjalanan: tuntutan sebenar sebagaimana yang dibuat mengikut pekeliling Kerajaan;

(b)

elaun sara hidup: tuntutan sebenar sebagaimana yang dibuat mengikut pekeliling Kerajaan;

(c)

ganti bayaran: kos sebenar pelan, salinan dokumen dan litografi, carian hakmilik dan kos sebenar lain yang dilakukan; dan

(d)

menghadiri persidangan, mahkamah, siasatan dsb: fi hendaklah dibayar pada kadar

RM50 sejam atau sebahagian daripadanya.”.

VALUATION AND PROPERTY SERVICES (AMENDMENT) (NO. 3) RULES 2018

IN exercise of the powers conferred by section 8

of the

Valuers, Appraisers, Estate Agents and Property Managers Act 1981 [Act 242], the Minister makes the following rules:

Citation and commencement 1.

(1)

These rules may be cited as the Valuation and Property Services

(Amendment) (No. 3) Rules 2018.

(2)

These Rules come into operation on 2 June 2018.

Substitution of Fourth Schedule, Fifth Schedule and Sixth Schedule 2.

The Valuation and Property Services Rules 1999 [P.U. (A) 382/1999] are amended by substituting for the Fourth Schedule, Fifth Schedule and Sixth Schedule the following schedules:

The above fees are inclusive of costs and shall be the maximum fees that can be charged

6. Fee for feasibility studies:

The fee charged shall be on the scope of work and shall be subject to the discretion of the

Director General who may use the scale of fees for capital valuation as a guide. The fee charged shall be fixed and agreed upon by the client before work commences.

7. Fee for consultancy:

The fee shall be calculated at rate of RM200 per hour a part thereof.

8. Fee for auction valuations:

The fee shall be based on the scale of fees for capital valuations and the maximum fee chargeable is RM20,000.

9. Fees for property management:

(a)

monthly fee:

(i)

3.0% of gross receipts on the first RM50,000;

(ii)

2.0% of gross receipts on the residue up to RM100,000; and

(iii)

1.0% of gross receipts on the residue over RM100,000;

(b)

minimum fee: RM25 per lettable unit; and

(c)

maximum fee: RM20,000.

“gross receipts” means the rents reserved by the leases or lettings plus any incidental receipts collected or accounted for or both in the course of management.

10. Fee for sales or purchases in estate agency:

1.5% on the transacted price subject to a minimum fee of RM200 and the maximum fee chargeable is RM20,000.

11. Fees for lettings in estate agency:

Should the rent be a progressive one, the fee will be based on the average rent for the period contracted for under the terms of the tenancy. The maximum fee chargeable is RM20,000.

12. Fees for housing loan valuations for local authorities and statutory bodies:

(a)

RM1.00 per RM1,000 or part thereof of the loan requested, subject to a minimum fee of RM50.00.

(b)

RM2.00 per RM1,000 or part thereof of the amount required in any subsequent request for a valuation for additional works or loan, subject to a minimum fee of RM50.00.

13. Additional payments

Except for subparagraph 5(b) and paragraph 12, in addition to the fees specified above the following charges shall be chargeable:

(a)

transport and travelling : actual claims as made in accordance with the Government circulars;

(b)

subsistence allowances : actual claims as made in accordance with the Government circulars ;

(c)

disbursements: actual cost of plans, copies of documents and lithography, title searches and other actual costs incurred; and

(d)

attendance at conferences, courts, inquires, etc. : a fee shall be paid at the rate of

RM50 per hour or part thereof.”.
