Tertakluk kepada perenggan 76(a) Kanun, tiap-tiap permohonan oleh tuan punya tanah untuk pelanjutan pemberian hakmilik untuk suatu tempoh beberapa tahun tidak melebihi sembilan puluh sembilan tahun di bawah seksyen 90A Kanun hendaklah dibuat dalam Borang 1A Jadual Pertama dan hendaklah dikemukakan kepada Pendaftar.

Tiap-tiap permohonan di bawah subkaedah (1) hendaklah—

(i)

fi sebagaimana yang ditetapkan dalam Jadual Ketiga;

(ii)

suatu surat kebenaran daripada tiap-tiap pihak yang mempunyai kepentingan berdaftar dalam tanah, jika ada; dan

(iii)

dokumen hakmilik keluaran, melainkan jika dokumen hakmilik keluaran itu berada dalam milikan suatu pihak yang mempunyai kepentingan berdaftar dalam tanah; dan

(i)

tuan punya berdaftar;

(ii)

dalam hal suatu syarikat berdaftar atau badan yang diperbadankan, orang yang diberi kuasa secara sah oleh syarikat atau perbadanan itu untuk menandatangani bagi pihaknya; atau

(iii)

dalam hal perbadanan pengurusan sebagaimana yang ditetapkan di bawah Akta Hakmilik Strata 1985

[Akta 318], pengerusi badan pengurusan itu.

Kadar premium yang hendaklah dikenakan ke atas pelanjutan tanah diberi hakmilik untuk suatu tempoh beberapa tahun di bawah seksyen 90A Kanun hendaklah sebagaimana yang berikut:

1/32 x nilai tanah x 1/99 x (tempoh pegangan pajakan baharu-baki tempoh pegangan pajakan sedia ada)

Kategori: Bangunan—

(i)

Kediaman—

1/16 x nilai tanah x 1/99 x (tempoh pegangan baharu-baki tempoh pegangan sedia ada)

(ii)

Perdagangan—

NATIONAL LAND CODE

FEDERAL TERRITORY OF LABUAN LAND (NO. 2) (AMENDMENT) RULES 2024

IN exercise of the powers conferred by section 14 of the National Land Code [Act 828], as modified by the Federal Territory (Extension and Modification of National Land Code)

Order 2009 [P.U. (A) 454/2009], the Minister makes the following rules:

Citation and commencement 1.

(1)

These rules may be cited as the Federal Territory of Labuan Land

(No. 2) (Amendment) Rules 2024.

(2)

These Rules come into operation on 29 January 2024.

New rule 3A

2.

The Federal Territory of Labuan Land (No. 2) Rules 2010 [P.U. (A) 144/2010], which are referred to as the “principal Rules” in these Rules, are amended by inserting after rule 3 the following rule:

“Application for extension of alienation for a term of years under section 90A

3A.

(1)

Subject to paragraph 76(a) of the Code, every application by a proprietor for an extension of alienation for a term of years not exceeding ninety-nine years under section 90A of the Code shall be made in Form 1A of the First Schedule and shall be submitted to the Registrar.

(2)

Every application under subrule (1) shall be—

(a)

submitted in one copy;

(b)

accompanied by—

(i)

the fee as prescribed in the Third Schedule;

(ii)

a consent letter from every party having a registered interest in the land, if any; and

(iii)

issue document of title, unless the issue document of title is in the possession of a party having a registered interest in the land; and

(c)

signed by—

(i)

a registered proprietor;

(ii)

in the case of a registered company or incorporated body, a person who is legally authorized to sign on behalf of the company or corporation; or

(iii)

in the case of a management corporation as prescribed under the Strata Titles Act 1985 [Act 318], the chairman of the management corporation.

(3)

If the applicant fails to comply with subrule (1) or (2), the Registrar shall reject the application.”.

New rule 11A

3.

The principal Rules are amended by inserting after rule 11 the following rule:

“Premium for extension of land alienated for a term of years 11A. (1)

The rate of premium to be charged upon an extension of land alienated for a term of years under section 90A of the Code shall be as follows:

Category: Agriculture—

1/32 x value of land x 1/99 x (holding period of new lease-balance of the holding period of existing lease)

Category: Building—

(i)

Residential—

1/16 x value of land x 1/99 x (new holding period-balance of the existing holding period)

(ii)

Commercial—

1/8 x value of land x 1/99 x (new holding period-balance of the existing holding period)

(iii)

Mixed development—

3/32 x value of land x 1/99 x (new holding period-balance of the existing holding period)

Category: Industry—

1/8 x value of land x 1/99 x (new holding period-balance of the existing holding period)

For purposes other than above—

1/16 x value of land x 1/99 x (new holding period-balance of the existing holding period).

(2)

Where an application made under subsection 90A(1) of the Code is approved by the Government, the Registrar shall issue a notice in Form 5A of the Code requiring the applicant to pay premium and any other payments payable within three months from the date the notice is duly served.”.

Amendment of First Schedule 4.

The principal Rules are amended in the First Schedule by inserting after Form 1

the following form:
