Preamble

BAHAWASANYA, melalui Pemberitahuan No. 2879/1937 yang disiarkan dalam Warta Kerajaan Negeri-Negeri Melayu Bersekutu pada 11 Jun 1937, pada menjalankan kuasa yang terletak hak padanya oleh seksyen 24(i) Kanun Tanah (Cap. 138), Residen Selangor telah mengisytiharkan bahawa petak tanah yang terletak di mukim Kuala Lumpur, seperti yang diperihalkan dalam Jadual dan ditandakan di atas pelan ukur hasil No. 18,988, yang disimpan di Pejabat Penguasa Hasil Ukur, Selangor dan Negri Sembilan, menjadi suatu rizab bagi maksud pengebumian orang mati bagi komuniti Islam Borah, yang disenggarakan oleh Tetuan Tyebally Kaderbhoy, R.H. Dawoodbhoy, Abasbhoy, Haji Daudbhoy dan G.M. Esmailjee atau mana-mana orang yang dilantik dari semasa ke semasa oleh Pegawai Daerah: DAN BAHAWASANYA, melalui P.U. (B) 108/2003 yang disiarkan dalam Warta Kerajaan Persekutuan pada 3 Mac 2003, Kerajaan Persekutuan telah mewakilkan penjalanan kuasanya di bawah seksyen 64 Kanun Tanah Negara kepada Jawatankuasa Kerja Tanah Wilayah Persekutuan Kuala Lumpur: DAN BAHAWASANYA, didapati suai manfaat sekarang oleh Jawatankuasa Kerja Tanah Wilayah Persekutuan Kuala Lumpur supaya keseluruhan perizaban yang disebut terdahulu itu dibatalkan: MAKA OLEH YANG DEMIKIAN, Jawatankuasa Kerja Tanah Wilayah Persekutuan Kuala Lumpur, pada menjalankan kuasa yang diberikan oleh subseksyen 64(1) Kanun Tanah Negara yang diberikan kepada Kerajaan Persekutuan dan diwakilkan kepadanya, memberikan notis di bawah subseksyen 64(2) Kanun Tanah Negara mengenai cadangan untuk membatalkan keseluruhan perizaban yang disebut terdahulu itu sebagaimana yang diperihalkan dalam Jadual dan bahawa mana-mana orang yang berhasrat untuk membantah terhadap pembatalan itu akan didengar oleh Pentadbir Tanah Wilayah Persekutuan Kuala Lumpur dalam suatu siasatan yang akan diadakan di Pejabat Pengarah Tanah dan Galian Wilayah Persekutuan Kuala Lumpur, P.U. (B) 158 3 Tingkat 2, 3 dan 4, Rumah Persekutuan, Jalan Sultan Hishamuddin, Kuala Lumpur mulai pukul 9.00 pagi hingga 4.00 petang pada 4 April 2017.

NATIONAL LAND CODE

NOTICE OF PROPOSED REVOCATION OF RESERVATION OF LAND FOR

PUBLIC PURPOSE

WHEREAS, by Notification No. 2879/1937 published in the Government Gazette of the

Federated Malay State on 11 June 1937, in exercise of the powers vested in him by section 24(i) of the Land Code (Cap. 138), the Resident of Selangor has proclaimed that the parcel of land situated in the mukim of Kuala Lumpur, described in the Schedule hereto, and delineated upon revenue survey plan No. 18,988, deposited in the office of the Superintendent of Revenue Surveys, Selangor and Negri Sembilan, to be a reserve for the purpose of interment of the dead of the Borah Muslim community, to be maintained by Messrs. Tyebally Kaderbhoy, R. H. Dawoodbhoy, Abasbhoy, Haji Daudbhoy and

G. M. Esmailjee or such other persons as the District Officer, from time to time, appoints:

AND WHEREAS, by P.U. (B) 108/2003 published in the Gazette of the

Government of the Federation on 3 March 2003, the Government of the Federation has delegated the exercise of its powers under section 64 of the National Land Code to the

Land Executive Committee of the Federal Territory of Kuala Lumpur:

AND WHEREAS, it now appears expedient to the Land Executive Committee of the

Federal Territory of Kuala Lumpur that the whole of the aforesaid reservation be revoked:

NOW THEREFORE, the Land Executive Committee of the Federal Territory of

Kuala Lumpur, in exercise of the powers conferred by subsection 64(1) of the

National Land Code conferred upon the Government of the Federation and delegated to it, gives notice under subsection 64(2) of the National Land Code of the proposal to revoke the whole of the aforesaid reservation as described in the Schedule and that any person who desires to object against such revocation will be heard by the Land Administrator of the Federal Territory of Kuala Lumpur at an enquiry to be held at the Office of Director of Lands and Mines of the Federal Territory of

Kuala Lumpur, 2nd, 3rd and 4th Floors, Federal House, Jalan Sultan Hishamuddin, Kuala

Lumpur from 9.00 a.m until 4.00 p.m on 4 April 2017.
