PENGECUALIAN

1.

Bagi maksud penyelenggaraan, pembaikan, peningkatan, pembersihan dan pemugaran bahagian jalan yang dinyatakan dalam ruang (1) Jadual Pertama.

2.

Bagi maksud pemacakan, pemasangan, penyelenggaraan, pengubahan atau pengalihan mana-mana struktur, kerja, peralatan atau apa-apa benda di dalam, pada, di bawah atau di atas bahagian jalan yang dinyatakan dalam ruang (1)

Jadual Pertama.

Bagi maksud diangkut di atas kenderaan selain kenderaan berat.

4.

Bagi maksud perkhidmatan kecemasan dan penguatkuasaan oleh agensi

Kerajaan dan pihak berkuasa tempatan.

5.

Bagi maksud pemeriksaan, pembuangan dan penghantaran sisa domestik oleh kenderaan berat seperti lori sampah, lori pembersihan pembetungan dan lori vakum pembetungan.

6.

Jika disebabkan oleh suatu kecemasan, termasuk banjir, penggunaan mana-mana jalan (yang bukannya bahagian jalan yang dinyatakan dalam ruang (1) Jadual

Pertama) oleh sesuatu kenderaan berat menjadi mustahil atau tidak sesuai,

Pegawai yang Menjaga Daerah Polis yang berkenaan boleh, setakat sebagaimana yang difikirkannya perlu, membenarkan kenderaan berat itu untuk menggunakan bahagian jalan yang dinyatakan dalam ruang (1) Jadual Pertama sebagai jalan alternatif bagi tempoh yang dalamnya penggunaan jalan (yang bukannya bahagian jalan yang dinyatakan dalam ruang (1) Jadual Pertama) oleh kenderaan berat itu berterusan menjadi mustahil atau tidak sesuai.

ROAD TRANSPORT ACT 1987

NOTICE UNDER SECTION 70

The Minister of Works proposes to make an order under section 70 of the

Road Transport Act 1987 [Act 333], the effect of which will be to prohibit the driving or use of motor vehicles and mobile machineries with the unladen weight of five thousand kilogrammes and more (“heavy vehicles”), on the part of the road specified in column (1) of the First Schedule as shown on the map in the Second Schedule, on the day and time specified in column (2) of the First Schedule, with effect from 28 February 2020.

Exemption from such prohibition shall be given for the purposes and in circumstances specified in the Third Schedule.

Objections to the proposal, if any, must be sent in writing to the

Director Road Facilities Maintenance Branch at Block D, Public Works Department

Malaysia Headquarters, Jalan Sultan Salahuddin, 50582 Kuala Lumpur or by e-mail to kuantan@jkr.gov.my, on or before 21 February 2020.

THIRD SCHEDULE

EXEMPTIONS

1.

For the purposes of maintenance, repair, improvement, cleaning and clearance of the part of the road specified in column (1) of the First Schedule.

2.

For the purposes of erection, installation, maintenance, alteration or removal of any structure, works, apparatus or any thing in, on, under or over the part of the road specified in column (1) of the First Schedule.

3.

For the purposes of being transported on a vehicle other than heavy vehicles.

4.

For the purposes of emergency services and enforcement by the Government agencies and local authorities.

5.

For the purposes of checking, disposal and delivery of domestic waste by heavy vehicles such as garbage truck, sewerage cleaning truck and sewerage vacuum truck.

6. Where by reason of an emergency, including flood, the use of any road (not being part of the road specified in column (1) of the First Schedule) by a heavy vehicle is rendered impossible or unsuitable, the relevant Officer in Charge of the Police

District may, in so far as he considers necessary, allow the heavy vehicle to use the part of the road specified in column (1) of the First Schedule as an alternative road for the period during which the use of the road (not being part of the road specified in column (1) of the First Schedule) by the heavy vehicle continues to be impossible or unsuitable.
