COUNTERVAILING AND ANTI-DUMPING DUTIES ACT 1993
NOTICE OF INITIATION OF EXPEDITED REVIEW OF THE ANTI-DUMPING DUTIES WITH
RESPECT TO THE IMPORTS OF ELECTROLYTIC TINPLATE ORIGINATING IN OR
EXPORTED FROM NOVOWELL ETP LIMITED FROM THE PEOPLE’S REPUBLIC OF CHINA

FOLLOWING the publication of a Notice of Affirmative Final Determination of An
Anti-Dumping Duty Investigation with respect to the Imports of Electrolytic Tinplate which is classified under the Harmonised System Code (H.S. Code) Number 7210.12.200
originating in or exported from the People’s Republic of China and the Republic of Korea on 15 November 2013 [P.U. (B) 466/2013], the Government of Malaysia has received a request for expedited review pursuant to subsection 28B(1) of the Countervailing and
Anti-Dumping Duties Act 1993 [Act 504].
Request for Review 1.
The request was lodged by—
Novowell ETP Limited
Xinyuan Light Industry Science and Technology Zone
Daduo Town, Xinghua City
Jiangsu Province China, the producer of electrolytic tinplate from the People’s Republic of China.
Product 2.
The subject merchandise under review is the electrolytic tinplate which is classified under Harmonized System Code (H. S. Code) Number 7210.12.

Code Number is given only for information but have no binding effect on the classification of the subject merchandise.

Existing Anti-Dumping Duties 3.
(1)
The duties currently in force on the subject merchandise are definitive anti-dumping duties imposed by Customs (Anti-Dumping Duties) (No. 3) Order 2013
[P.U. (A) 339/2013].
(2)
No anti-dumping duty shall be imposed on the subject merchandise originating in or exported from Novowell ETP Limited from the People’s Republic of China while the review is being carried out.
Grounds for the Review 4.
(1)
The request is based on the grounds that the producer has not exported the subject merchandise to Malaysia during the period of investigation and that the producer is not related to any of the exporters or producers in the exporting country who are subject to the anti-dumping duties on the subject matter merchandise.
(2)
The Government is satisfied that the request carries sufficient grounds to initiate a review.
(3)
In coming to this decision, the Government has also examined the conditions to initiate the review pursuant to subsection 28B(1) of the Act.
Procedure 5.
(1)
Having determined that sufficient evidence exists to warrant an expedited review with regard to imports of electrolytic tinplate originating in or exported from
Novowell ETP Limited from the People’s Republic of China, the Government initiates an expedited review pursuant to subsection 28B(1) of the Act.
(2)
The investigation will establish an individual anti-dumping duty rate for
Novowell ETP Limited from the People’s Republic of China.

Questionnaires 6.
(1)
In order to obtain information deemed necessary for its review, the Government will send questionnaires to the Malaysian industry and to any association of producers in Malaysia and to the importers.
(2)
In any event, all interested parties not contacted by the Ministry of
International Trade and Industry (MITI) are invited to contact MITI in writing in order to find out whether they are listed in the request. If necessary, such interested parties may request for a copy of the questionnaire by identifying the nature of their business activities in relation to this review.
Collection of Information 7.
All interested parties are invited to make their views known in writing, in particular by replying to the questionnaires addressed to them and by providing supporting evidence.
Time Limit 8.
(1)
Any interested party requesting for a questionnaire shall do so not later than 15 days after the publication of this notice in the Gazette.
(2)
All interested parties must present their views in writing and submit questionnaire responses within 30 days of the date of publication of this notice if such views and submissions are to be taken into consideration during the investigation, unless otherwise specified.

All submissions, questionnaire responses and correspondences and requests must be made in writing and sent by post, e-mail or facsimile and with clear indication of the name, address, e-mail address, telephone and facsimile numbers of the interested parties to:

If the interested parties do not provide the necessary information or the information and views are not received in adequate form within the specified time limit, the Government may make determination on the basis of the facts available in accordance with section 41 of the Act.
